The Minutes of the 196th Meeting of the NRC held from 3rd April, 2012 to 6th April, 2012

The 196th Meeting of the Northern Regional Committee (NRC), National Council for Teacher Education (NCTE) was held from 3rd April, 2012 to 6thApril, 2012 at NRC, NCTE, Jaipur.

The following were present:

The Regional Director, NRC apprised the Northern Regional Committee about the provision of the NCTE Act, Rules, Regulations and instructions issued from time to time.

With the permission of Chairperson, Dr. Ram Kishor(Convener) presented the Agenda before the Committee. Item-wise decisions taken are as follows:-

Faridabad (Haryana) / B.Ed. / In pursuance of the orders dated 6.7.2011 of the Hon’ble High Court of Punjab & Haryana at Chandigarh passed in the PIL Civil Writ Petition No. 20056 of 2009, the Northern Regional Committee in its 196th meeting held from 3-6 April, 2012 considered the case of the institution in detail.
The Committee after going through the Reports of the affiliating University, VT report alongwith all other related documents submitted by the institution viz a viz provisions of the NCTE Act, Rules & Regulations observed the following:-
(i)The institution was granted recognition for B.Ed course. Only 4 lecturers are available in the institution. Therefore, the institution failed to appoint requisite number of teaching faculty as per NCTE norms. Approval of the affiliating body regarding appointment of staff was also not available. Thus the institution has not fulfilled the pre-conditiion for appointment of eligible teaching staff duly approved by the affiliating body which is a clear cut violation of the provisions of the NCTE Regulation, 2009.
(ii)The land is still in the name of the society. The society/trust has not transferred and vested the title of the land and building in the name of the institution which is a clear violation of provisions of clause 8(7) (iv) of the NCTE Regulation, 2009.
(iii)Class rooms are of smaller sizes and the same are not as per the NCTE norms. The Building Completion Certificate as per prescribed format duly approved by the competent govt. authoirity has not been submitted
(iv)A large number of the students were found to be absent on day of the visit.
(v)The NRC observed that the institution is also running school/other programme inside the campus.
(vi)The institution did not to submit details of salary paid to teachers as per clause 4(v)(d)/4(a) (d) of NCTE norms for respective teacher training course with supporting document.
Hence, the NRC decided to issue Show Cause Notice under section 17 of the NCTE Act, 1993 before withdrawal of recognition of the institution on the above points and directs the instiution to submit its reply accompanied with an affidavit within 21 days.

Hence, the NRC decided to issue Show Cause Notice under section 17 of the NCTE Act, 1993 before withdrawal of recognition of the institution on the above points and directs the instiution to submit its reply accompanied with an affidavit within 21 days.

HR 982 / M.R. College of Education, Sec. 43, Aravali Hills, Post Box No. 52, Delhi-Faridabad Road, Faridabad ( Haryana) / B.Ed. (B.Ed.Addl), M.Ed. & D.Ed. / In pursuance of the orders dated 6.7.2011 of the Hon’ble High Court of Punjab & Haryana at Chandigarh passed in the PIL Civil Writ Petition No. 20056 of 2009, the Northern Regional Committee in its 196th meeting held from 3-6 April, 2012 considered the case of the institution in detail.
The Committee after going through the Reports of the affiliating University, VT report alongwith all other related documents submitted by the institution viz a viz provisions of the NCTE Act, Rules & Regulations observed the following:-
(i)The institution was granted recognition for B.Ed. (B.Ed.Addl), M.Ed. & D.Ed. courses. List of teachers for D.Ed. course approved by the competent authority has not been submitted by the society. As per affidavit submitted to the VT by the society out of the total 20 faculty members only 6 have been approved by the affiliating University. It has also been noticed that only 18 teachers are working whereas the number should have been 26 teachers, Out of there 12 teachers have yet not been approved by the concerned affiliating University (for B.Ed. and M.Ed. courses) or by the competent authority for D.Ed. course as the case may be. Thus the institution has violated the pre-conditiion for appointment of eligible teaching staff duly approved by the affiliating body which is a clear cut violation of the provisions of the NCTE Regulation, 2009.
(ii)Total built up area of the institution is only 3050 sq. meters for all the courses namely D.Ed., B.Ed. (100 seats + 100 seats) and M.Ed. which is less than the required built up area as per NCTE norms.
(iii)The size of multipurpose hall is only 810 sq. feet which is less than the area as per the NCTE norms.
(iv)Library does not have appropriate sized reading room required for 285 students.
(v)The land is yet in the name of the society, thus the institution has not transferred and vested the title of the land and building in the name of the institution which is of provisiosns of clause 8(7) (iv) of the NCTE Regulation, 2009.
(vi)The building roof is made up of tin which refers to a temporary structure and is not as per clause 8(10) of NCTE Regulations, 2009.
Hence, the NRC decided to issue Show Cause Notice under section 17 of the NCTE Act, 1993 before withdrawal of recognition of the institution on the above points and directs the instiution to submit its reply accompanied with an affidavit within 21 days.
4 / HR 558 / Bhartiyam College of Education, Vill. – Panehra Khurd, Tehsil – Ballabhgarh, Distt. Faridabad (Haryana) / B.Ed. / In pursuance of the orders dated 6.7.2011 of the Hon’ble High Court of Punjab & Haryana at Chandigarh passed in the PIL Civil Writ Petition No. 20056 of 2009, the Northern Regional Committee in its 196th meeting held from 3-6 April, 2012 considered the case of the institution in detail.
The Committee after going through the Reports of the affiliating University, VT report alongwith all other related documents submitted by the institution viz a viz provisions of the NCTE Act, Rules & Regulations observed the following:-
(i)The institution was granted recognition for B.Ed. course. As per the VT report there are 3 lecturers and one principal whose appointments have been approved by affiliating M. D. U. University . There are thus 4 lecturers less in the approved. Thus the institution has violated the pre-conditiion for appointment of eligible teaching staff duly approved by the affiliating body which is a clear cut violation of the provisions of the NCTE Regulation, 2009.
(ii)The salary to the staff, as reported by Visiting Team is being paid through cheques. However, no documentary proof has been provided supporting this contention. The institution failed to submit details of salary component and salary paid to teachers as per clause 4(v)(d) of NCTE norms for respective teacher training course with supporting document i.e. statement towards payment of salary through bank alongwith a copy of a Acquittance roll of teachers showing payment of salary as per the NCTE norms.
(iii)The land is still in the name of the society, The society/ trust has not transferred and vested the title of the land and building in the name of the institution which is violation of provisiosns of clause 8(7) (iv) of the NCTE Regulation, 2009.
Hence, the NRC decided to issue Show Cause Notice under section 17 of the NCTE Act, 1993 before withdrawal of recognition of the institution on the above points and directs the instiution to submit its reply accompanied with an affidavit within 21 days.

HR 222 / Shiv College of Education, VPO –Tigaon, Dist.- Faridabad, Haryana / B.Ed. & B.Ed.Addl, D.Ed. & M.Ed. / In pursuance of the orders dated 6.7.2011 of the Hon’ble High Court of Punjab & Haryana at Chandigarh passed in the PIL Civil Writ Petition No. 20056 of 2009, the Northern Regional Committee in its 196th meeting held from 3-6 April, 2012 considered the case of the institution in detail.
The Committee after going through the Reports of the affiliating University, VT report alongwith all other related documents submitted by the institution viz a viz provisions of the NCTE Act, Rules & Regulations observed the following:-
(i)The institution was granted recognition for B.Ed. & B.Ed.Addl, D.Ed. & M.Ed. courses. As per the VT report, out of the total 24 faculty member only 9 have been approved by the Maharishi Dayanand University, Rohtak. Only 24 teachers are working whereas the number should have been 35. Out of these 35 teachers, 26 teachers have yet not been approved by the concerned University and one of the faculty member, Ms. Sarika Garg, shown in the faculty list is working in another college. List of teachers for D.Ed. course approved by the competent authority has not been submitted by the Society. Thus the institution has violated the pre-conditiion for appointment of eligible teaching staff duly approved by the affiliating body which is a clear cut violation of the provisions of the NCTE Regulation, 2009.
(ii)Total built up area of the institution is only 3812 sq. meter for all the courses namely B.Ed., B.Ed. (Addl.), D.Ed., M,Ed. which is less than the required built up area as per NCTE Regulations and norms & standards thereunder.
(iii)Library does not have appropriately sized reading room for the students. The size of the library is less than the required for 435 students.
(iv)The land is in the name of the society, thus the institution has not transferred and vested the title of the land and building in the name of the institution which is a clear violation of provisions of clause 8(7) (iv) of the NCTE Regulation, 2009.
(v)The institution did not submit details of salary paid to teachers as per clause 4(v)(d)/4(a) (d) of NCTE norms for respective teacher training courses with supporting documents.
(vi)The NRC observed that the institution is also running school/other programme inside their campus.
Hence, the NRC decided to issue Show Cause Notice under section 17 of the NCTE Act, 1993 before withdrawal of recognition of the institution on the above points and directs the instiution to submit its reply accompanied with an affidavit within 21 days.

College of Education, Plot No. 48, Khasara No. 45, V&P Deeg, Fatehpur Biloch, Ballabhgarh, Faridabad -121004, State – Haryana / B.Ed. / In pursuance of the orders dated 6.7.2011 of the Hon’ble High Court of Punjab & Haryana at Chandigarh passed in the PIL Civil Writ Petition No. 20056 of 2009, the Northern Regional Committee in its 196th meeting held from 3-6 April, 2012 considered the case of the institution in detail.
The Committee after going through the Reports of the affiliating University, VT report alongwith all other related documents submitted by the institution viz a viz provisions of the NCTE Act, Rules & Regulations observed the following:-
(i)The institution was granted recognition for B.Ed. coruse. As per the VT report, only 5 teachers are working whereas the number should have been 7. Out of these 5 teachers, No teachers has been approved by the concerned affiliating University. Thus the institution has violated the pre-conditiion for appointment of eligible teaching staff duly approved by the affiliating body which is a clear cut violation of the provisions of the NCTE Regulation, 2009.
(ii)The land is still in the name of the society. The society/trust has not transferred and vested the title of the land and building in the name of the institution which is a clear violation of provisions of clause 8(7) (iv) of the NCTE Regulation, 2009.

7 / HR 1256 / Institute of Teacher’s Education, VPO – Immamudin Pur, Tehsil – Ballabgarh, Dist.- Faridabad, Haryana / B.Ed. / In pursuance of the orders dated 6.7.2011 of the Hon’ble High Court of Punjab & Haryana at Chandigarh passed in the PIL Civil Writ Petition No. 20056 of 2009, the Northern Regional Committee in its 196th meeting held from 3-6 April, 2012 considered the case of the institution in detail.
The Committee after going through the Reports of the affiliating University, NRC VT report alongwith all other related documents submitted by the institution viz a viz provisions of the NCTE Act, Rules & Regulations observed the following:-
(i)The institution was granted recognition for B.Ed. course. The institution claims that the candidature of the Principal and one lecturer have been approved by the affiliating university. There is no documentary evidence for this claim. The selection proceedings of five teachers are in process. The above points establish that the institution has not yet appointed faculty members approved by the affiliating university . Thus the institution has made violation of the provisions of the NCTE Regulation, 2009.
(ii)The land is still in the name of the society. The society/trust has not transferred and vested the title of the land and building in the name of the institution which is a clear violation of provisiosns of clause 8(7) (iv) of the NCTE Regulation, 2009.
(iii)The institution did not submit details of salary paid to teachers as per clause 4(v)(d)/4(a) (d) of NCTE norms for respective teacher training course with supporting document.

8 / HR 341 / Rise Max College of Education, C-74, Reshi Nagar, Chawal Colony, Ballabgarh, Distt. – Faridabad (Haryana) / B.Ed. / In pursuance of the orders dated 6.7.2011 of the Hon’ble High Court of Punjab & Haryana at Chandigarh passed in the PIL Civil Writ Petition No. 20056 of 2009, the Northern Regional Committee in its 196th meeting held from 3-6 April, 2012 considered the case of the institution in detail.
The Committee after going through the Reports of the affiliating University, VT report alongwith all other related documents submitted by the institution viz a viz provisions of the NCTE Act, Rules & Regulations observed the following:-
(i)The institution was recognised for B.Ed. course. The college has submitted the list of one Principal and 16 lecturers. The college has not submitted the list of teachers approved by the affiliating university. The proforma submitted by the college regarding Principals teaching experience (Col.13), teaching experience in B.Ed. college (Col. 14) and date of initial appointment as per NCTE Regulations (Col. 15)remain blank. The supportive documents have not been enclosed about qualification and teaching experience of the Principal.
There is discrepancy in the names of teachers selected by the Selection Committee and the list submitted by the College. Two teachers names viz. Dr. Sarika Garg and Ms. Manprit Kaur have been shown without enclosure of any Selection Committee recommendation. Moreover, the column concerning percentage of maths in PG course of Mr. Saroj Verma is kept blank, Ms. Usharani has obtained less than 50% marks in MA teaching subject, Mr. Rajiv Gupta has obtained less than 50% marks in M.Com teaching subject.
Thus the institution has violated the pre-conditiion for appointment of eligible teaching staff duly approved by the affiliating body which is a clear cut violation of the provisions of the NCTE Regulation, 2009.
