The issue of procedural criminal law

Objectives. To increase the knowledge of procedural criminal law with emphasis on the theoretical background and theoretical problems of the branch and on the parts of procedural criminal law, which were not the centre of teaching in the Bachelor's degree. Teaching is aimed at achievement of comprehensive knowledge of the branch for the needs of managers, for which it is predicted this range of knowledge with regard to the methodological guidance of subordinate.

Prospective skills. After passing the course the student gains knowledge of criminal law procedure. Such knowledge is essential in the activities of police officers and Police of the Czech Republic.

Summary. This is a theoretical subject, which is focused on content adaptation process of subjects of criminal procedural relations, in particular law enforcement authorities, in the detection of crime, detection of the offenders and deciding on them, as well as the implementation of the performance of these decisions.

Teaching is also focused on the constitutional principles of criminal process, guarantees of fundamental human rights and freedoms in accordance with international conventions, theoretical problems of evidence, court proceedings, redress procedures and principles of the correction procedure, the legal relations with foreign organizations and issues of justice and public prosecution.

Knowledge of criminal law are necessary in the activities of police authorities and police management functions included in the service of Police of the Czech Republic, regardless of whether the police is engaged in criminal procedural activity or not. During the teaching students are familiarized with the whole range of subject.

Topic 1. Introduction to the study of procedural criminal law. The concept and subject of procedural criminal law and criminal procedure. Interpretation of basic concepts. Basic principles of criminal procedure. Acts of criminal procedure. Bodies of criminal procedure.

Topic 2. Bodies of criminal procedure. Parties of criminal procedure. Law enforcement authorities. Person against whom the criminal procedure is held. Advocate. Damaged. Concerned person. Other bodies of criminal procedure.

Topic 3. Acts of criminal procedure. The decision in criminal procedure.Legal power and enforceable.

Topic 4. Ensuring people relevant to criminal procedure. Binding. Arrest. Detention

Topic 5. Seizure things important for criminal procedure. Call to release things. Withdrawal of the thing and similar acts. Tours. Shipments. Interception and recording of telecommunication traffic.

Topic 6. Evidence in criminal procedure. Principles of evidence. General concepts of evidence. Grading evidence

Topic 7. Evidence in criminal procedure. Evidence means separately.

Topic 8. Stages of criminal procedure. Procedure before the criminal prosecution. Shortened pre-trial

Topic 9. Investigation. Supervision of the prosecutor's preparatory procedure. Meritorious decision in the pre-trial

Topic 10. Judicial proceedings. (Preliminary hearings and the trial.) Specific methods of proceedings.

Topic 11. Remedies, features, types, principles, proper appeals and extraordinary appeals
