LETTER OF REQUEST FOR PROPERTY TO BE TAKEN INTO TRUST

Please read carefully before completing this form:

Before the Trust Corporation can consider taking a property into trust, it must receive a formal application by way of a resolution passed by the Guider(s) of the unit, or Committee of the area, for whom the property is to be held. The completed form should be returned to the Secretary of the Trust Corporation. This form is to be used for taking a guide property into trust – there is a different form to be completed for taking a joint guide and scout property into trust.

The full name of the unit or area concerned, as registered or intended to be registered with the Charity Commission, should be inserted in each space marked (*)

The form must be completed by the Guide Unit, orDIstrict or Division or County Committee. It should not be completed by a Friends of Guiding Group or other local management committee, even if it has responsibility for the management of the Guide property, because it is essential that the indemnity to meet outgoings is provided by the relevant Guide unit or area itself.

RESOLVED:

1."That the (*)______of the Guide Association should request the Guide Association Trust Corporation to accept the property specified below TO HOLD the same upon Trust for sale and upon Trust to apply the proceeds of sale and the rents and profits thereof until sale and in the case of leaseholds after payment of the rent reserved in respect thereof as trustee for the (*)______of the Guide Association and upon the trusts declared by the Trust Deed under the seal of the said Corporation dated the 18th January 1938 and known as the Guide Association 1938 Trust Deed.

2.That the Secretary be instructed to make the above request and to undertake on behalf of the (*)______of the Guide Association to bear and pay all rent and rates and taxes payable in respect of the said property and to make all repairs and payments in respect of insurance of such property as may be necessary and observe perform and comply with all restrictive covenants and conditions and lease covenants (if any) affecting the same and all statutory or other obligations in respect thereof and to keep the said Corporation indemnified against the same and against all actions proceedings claims and demands costs charges and expenses arising out of the foregoing or any of them or arising out of use and occupation of the said property or any lack of repair or any failure to effect or maintain insurance cover on the said property or any loss or damage which may be caused to any Scout, Guide or other equipment therein".

ON THE JOINT BEHALF OF GUIDE AND SCOUT UNITS

Please read carefully before completing this form:

Before the Trust Corporation can consider taking a property into trust, it must receive a formal application by way of separate resolutions passed by the respective Committees of the area for whom the property is to be held. The completed forms should be returned to the Secretary of the Trust Corporation.

The full name of the Guide unit or area and Scout Group concerned, as registered or intended to be registered with the Charity Commission, should be inserted as appropriate in each space marked (*)

One copy of the letter should be completed by the Guides, and one by the Scouts, each referring to their own unit/area or Group. The form must be completed by the Guide Units, or District, Division or County Committee, and the Scout equivalent. It should not be completed by the joint management committee (or Scout and Guide Group executive committee, if applicable), even if it has responsibility for the management of the joint property, because it is essential that the indemnity to meet outgoings is provided by the relevant Guide unit or area and Scout Group itself.
