INAUGURAL COUNCIL MEETING
MONDAY DECEMBER 4, 2006
1. CALL TO ORDER AND PRAYER
1.1 Call to Order
The 1st session of the 2006 - 2010 Council of the Township of Norwich was held in the Council Chambers, Otterville, Ontario commencing at 11:00 a.m. The meeting was called to order by Clerk-Administrator Betteanne M. Cadman. In attendance were Mayor Elect Donald Doan, Councillors Elect Pat Lee, Lynne DePlancke, Russell Jull and Larry Martin. Also in attendance were Clerk-Administrator Betteanne M. Cadman, Treasurer H. Roy Bauslaugh, Public Works Superintendent Ron Smith, Chief Building Official Brian Reid, Fire Chief Darell Parker, Director of Recreation Parks and Facilities Mary-Lou Ambrose-Little Drainage Superintendent Wray Ramsay and Planner Stephen Couture. Also in attendance were family of the Council elect.
1.2 Declaration of Office
The Declaration of Elected Office was taken by Mayor Doan. The Chain of Office was presented by former Mayor Susan Hampson. The Declaration of Elected Office was then taken by Councillors Lee, DePlancke, Jull and Martin. The Declarations having been taken by all members of Council, Ms. Cadman declared the 2006 – 2010 Council for the Township of Norwich duly constituted and asked Mayor Doan to assume the Chair.
1.3 Prayer delivered by Reverend Allison Playfair, Burgessville and Newark United Church Pastoral Charge
Revered Playfair presented the members of Council with a plant and container, stating that each of the components – earth, air, water and fire were distinct properties, however when combined becomes something new. The container represents the vessel out of which new life and growth emerges. She encouraged the members of Council to make the community vibrant and noted the all members will bring a wealth of experience to office.
1.4 Inaugural Address – Mayor Donald Doan
I would formally welcome each councillor here today. It is a privilege for us to be here. For each of us, we are beginning something new in our lives as we have been entrusted by the citizens of the Township of Norwich to act on their behalf to make our municipality a great place to live and do business.
Currently, there are two subdivisions in the village of Norwich in which houses are being built and in Burgessville the earth has been moved in preparation for house construction. Four more subdivisions for our Township are in the paperwork stage. In Otterville, the golf course property has been sold. We can look forward to working with the new owners to get that project started.
With the new housing developments, it will be necessary to work with the County to ensure a good water supply and adequate sewage capacity. The BR+E project is well underway with capable people at the helm. We can look forward to the results of their hard work and apply the results to better our economic development in the municipality.
Recruitment is the key word for the Medical Centre. We are going to need a group of dedicated people to entice doctors to our rural municipality. Our strong diversified agriculture sector may be a plus for us.
In all of our areas of growth and development, we as Councillors have a knowledgeable and hard working township staff. Each one is an expert in his or her own field and we must rely on their expertise. Many of our decisions will be made from the information provided by our staff. Much of their work is made easier through good communication from this Council. Communication is a key word whether it is to our citizens, to the staff, or between me and the Council. We must strive to keep the lines of communication open at all times.
This is a new Council. We are each in a learning situation. We each have goals which are probably similar but our approaches to reach these goals may be different. I would like to think we can work as a team to accomplish our goals. There will be challenging times and rewarding times. I look forward to working with Councillors and staff to make the Township of Norwich a better place.
Mayor Doan then provided each member of Council the opportunity to speak.
Councillor Martin stated that it was a privilege to be a member of Council and that he would bring a renewed enthusiasm to the table.
Councillor Lee stated that he also felt it a privilege to be a member of Council, thanking the residents for their support and that he was looking forward to working with Council and staff.
Councillor Jull extended appreciation to the individuals at the Inaugural session of Council for their attendance and stated that he was looking forward to working with Mayor Doan and Council members.
Councillor DePlancke stated that she was looking forward to working with Council and staff and stated that she was approachable, open and honest. She noted that it would be a challenge at times, however the experience would be rewarding.
Mayor Doan called a recess at 11:25 a.m. for a reception. The meeting reconvened at 12:39 p.m.

That pursuant to the provisions of Section 45 of the Planning Act, R.S.O. 1990, as amended, Chapter P.13, this Council convene as a Committee of Adjustment in respect of an application for a Minor Variance by Lubbert and Corina VanderWeerd, File No. A-12/06.

Location: Part Lots 9 and 10, Concession 5 (North Norwich) Township of Norwich
Details of Requested Variance: Relief from the provisions of Section 18.2, Zone Provisions, Interior Side Yard; to permit an 18.0 feet interior yard setback in place of the requirement for 49.2 feet to permit expansion of a manufacturing plant.
The applicant, Mr. VanderWeerd was not in attendance.
The Planner, Stephen Couture, outlined the application as contained in Report 2006-377.
There were no questions from Council to Mr. Couture.
There were no interested individuals in attendance that wished to speak in support of or against the application.

That with respect to the application by Lubbert and Corina VanderWeerd, File No. A-12/06, for a Minor Variance for relief from the provisions of Section 18.2 – General Industrial Zone, Table 18.2 – Zone Provisions, to permit an interior side yard setback (to the zone line) of 5.5 m (18.0 ft) in place of the minimum requirement of 15.0 m (49.2 ft), the Council of the Township of Norwich hereby grant the requested Minor Variance.

That pursuant to Section 34(12) of the Planning Act, R.S.O. 1990, as amended, Chapter P.13, this Council conduct a public meeting in respect of an application for an amendment to Zoning By-law 07-2003-Z by Don and Marlene Buck, File ZON 3-06-21.

Mayor Doan advised that this meeting is being constituted as a public meeting held under the Planning Act for the purpose of hearing Zoning Amendment proposals and affording any person in attendance the opportunity to make a presentation to Council.
The Ontario Municipal Board ahs the power to dismiss an appeal under subsection (25) if an appellant has not provided the Council with oral submissions at a public meeting or a written submission before a by-law is passed under this section.

5.3.2 Applicant: Don and Marlene Buck
File No.: ZON 3-06/21

Location: Part Lots 87, 88 and Lot 89, Plan 745 (Village of Norwich) Township of Norwich
Details of Proposed Amendment: To establish appropriate “Special Residential Type 1(R1-special)” zoning for two severed lots to permit development of a single detached dwelling (on each new lot) and to establish a special provision for a reduced lot frontage (4.8 m) for each new lot.
The applicant, Mr. Don Buck was in attendance.
The Planner, Stephen Couture, outlined the application as contained in Report 2006-378.
In response to a question from Council, Mr Couture advised that the Chief Building Official could provide members of Council with the building permit process.
Mr. Buck informed members of Council that he was not aware that the subject lands had fill placed on them, and that he was aware of his obligations under the Building Code as he had spoken with the Chief Building Official. In response to a question from Council, Mr. Buck stated that he was prepared to correct any issue with respect to fill previously placed on site and that his engineer was Mr. Jim Chambers.
Chief Building Official, Brian Reid advised Council that prior to the placement of concrete, a footing inspection is undertaken and if a difficulty would arise, Mr. Buck would have several options available including excavating the material until virgin soil is found or engaging a soils engineer to determine remedial measures. He noted that if the project were abandoned, Mr. Buck would be required to place the property back to its previous state. Mr. Reid further commented that should there be a concern with soil conditions, it would be contained within the building envelope.
Ms. Yvonne Glover, 18 ½ Centre Street stated that there were old tires buried on site and was concerned that the development of the site would cause drainage problems with her property.
Ms. Deb Stubbs requested clarification from the Planner with respect to the existing outbuilding. Mr. Couture responded that the existing large garage situation on the property shall be dedicated to the residential use of the property such as storage of personal items. He also noted that there was a structural limitation on the size of home occupations to a maximum of 265 square feet.
Mr. Les Devos, 16 Centre Street expressed concerns due to his property being at a lower elevation and therefore any construction on the site could potentially cause water to flow onto their land. Mr. Reid stated that prior to a building permit being issued; the Building Code requires that a drainage plan be prepared and that the development cannot adversely drain onto another person’s property.
In response to a question from Councillor DePlancke, Mr. Reid stated that the development on the Buck property cannot increase water onto a neighbouring property nor would it be a requirement to alleviate any existing drainage problem that may flow onto a neighbours’ property.
Ms. Glover enquired if she could obtain a copy of the drainage plan to which Mr. Reid advised that it was not a usual practice to provide an individual with another person’s drainage plan.
In response to a question from Mayor Doan, Mr. Reid stated that the Township has no by-law to require the removal of tires from the property and that he would not be probing the site to determine if tires were buried on site.
Mr. Keith Jull stated that he resides immediately adjacent to the subject lands and that the proposed driveway would be located approximately 25 to 30 feet form his house. Mr. Couture advised that the driveway was a private drive for the two proposed residences only.

That with respect to the application for an amendment to Zoning By-law 07-2003-Z, by Don and Marlene Buck, File No. ZON.3-06/21, for lands described as Part Lots 87, 88 and Lot 89, Plan 745 (Village of Norwich), Township of Norwich from “Development Zone (D)” to “Residential Type 1 Zone (R1)” and “Special Residential Type 1 Zone (R1-17)” to allow development of two residential infilling lots and to implement the conditions of the Oxford Land Division Committee concerning consent applications B-32/06 and B-33/06, the Council of the Township of Norwich hereby approve the zone change.
