The Common Council for the City of Faith, South Dakota met in special session on September 29, 2015 at 7:00 P.M. in the Community Room of the Community Center. Mayor Haines called the meeting to order, Brown called roll call, and Mayor Haines led the Pledge of Allegiance.

Council members present: Chapman, Inghram, Berndt, Lightfield, and Hellekson.

Council members absent: Collins.

Others in attendance were: Debbie Brown, Eric Bogue, Barry Vig, Justin Inghram, Tyson Waddell, Dana Keffeler, Fred Hulm, and Jon Collins.

Berndt made a motion, seconded by Lightfield to approve the agenda as presented. Motion carried.

ORDINANCE & RESOLUTIONS:

Ordinance No. 315– Encroachments in the Public Right of Way - Ordinance (1stReading):

Lightfieldmade a motion, seconded by Inghram to approve the first reading of Ordinance No. 315 – Encroachment in the Public Right of Way. All yes votes. Motion carried.

Lightfield introduced the following resolution for it’s adoption:

Resolution 09-29-15-01

A Resolution Passed Pursuant to the Revised Ordinances Title 8 – Utilities Establishing Regulations, Rates, and Charges for Utility Services for the City of Faith, South Dakota:

WHEREAS, pursuant to the Revised Ordinances, Title 8 – Utilities, the Common Council is authorized to establish regulations, rates, and charges for all utility services by Resolution, it is hereby

RESOLVED that the following regulations, rates and changing those rates contained in

RESOLUTION NO. 07-21-15-03 which new rates will be effective on October 1, 2015:

FUSC-Federal Universal Service Charge:

16.7 % on Long Distance, DSL, ARC, PIC Charge and Subscriber Line Charge

Seconded by Hellekson. All yes votes. Motion carried.

Right of Way Encroachment Agreement:

Discussion was held in regards to Keffeler Kreations propane tank and air conditioner unit being in the right of way of the City’s. After much discussion, Berndt made a motion, seconded by Lightfield to approve encroachment application by Dana Keffeler for the placement of a central air conditioning external condensing unit/heat exchanger and a Five Hundred (500) gallon propane tank into the City’s right of way adjacent to her property (North 75' of unplatted portion of Outlot F, excepting therefrom the East 50', City of Faith) on the condition that no further encroachments will be permitted, that the applicant enter into an Right of Way Encroachment Agreement as presented by the City Attorney, and that such Agreement be recorded in the Meade County Register of Deeds office.

Justin Inghram – Waiver:

James Borth, State Plumbing inspector was in Faith for two inspections and was asked to report to City Attorney, Eric Bogue. An atmospheric vacuum breaker is required on hose bid in shop area and a faucet needs installed. Bogue stated that before the City gives a waiver, they need to know what all is needed in the waiver. Bogue has talked with Mike Richards at the State Plumbing Commission and won’t have all of that information until this week or next week. Berndt made a motion, seconded by Hellekson to table. Four - yes votes. Inghram abstained. Motion carried.

Screening Chips:

Lightfield made a motion, seconded by Hellekson to approve to bid screening chips and open at the October 20, 2015 meeting. All yes votes. Motion carried.

Housing Committee:

It has been brought to the attention of the office that Fox Ridge Enterprises, Inc.was the owner of the Countryside Estates and any assets that were the Fox Ridge Enterprises, Inc. were turned over to Prairie Community Health, Inc. Fred Hulm, Clinic President stated that they do not want the Countryside Estates and would like to get it out of their name. City Attorney, Eric Bogue stated that it could be taken over by another likely entity, but that the Clinic’s attorney would need to contact Bogue to work on the process that is needed. Berndt made a motion seconded by Lightfield to table for more information. All yes votes. Motion carried.

Building Permit:

Paul Taylor has submitted a building permit for a garage on Lot 5 & 6, Block 15. Berndt made a motion, seconded by Lightfield to approve Paul Taylor’s building permit for a garage.

Surplus items on Auction:

Mayor Haines suggested that the digger truck and other items that didn’t sell be taken to an area auction. Jon Collins stated that there are some issues with thetruck that he doesn’t think it will go that far without over heating. Chapman made a motion, seconded by Lightfield to table for more information.

EMT Class – Books:

There are 10 from Faith taking the EMT class and it has been discussed to pay for the books which cost $127.44. Berndt made a motion, seconded by Hellekson to pay for half of the book for anyone who is going to be on the Faith Ambulance crew and reimburse them for the other half after one year on the ambulance crew. All yes votes. Motion carried.

EMT Conference is October 22 – 25, 2015 in Spearfish. Inghram made a motion, seconded by Lightfield to approve to pay for rooms and registration and use of the City car for who is going for the Faith Ambulance. All yes votes. Motion carried.

Lightfield made a motion, seconded by Hellekson to adjourn. Motion carried.
