Amendments to Cabinet Regulation No 991 of 5 December 2006„The Procedure for Determination of Payments for the Services of Air Navigation andfor Utilisation of the Services of theStateJointStockCompanyRigaInternationalAirport, and the Procedure for Distribution of Payments”
Issued in accordance with
the law “On Aviation”,
Section28, parts two, three and four
1.Cabinet Regulation No 991 of 5 December 2006 „The Procedure for Determination of Payments for the Services of Air Navigation and Utilisation of the Services of the State Joint Stock Company Ŗiga International Airport, and the Procedure for Distribution of Payments” (Latvijas Vēstnesis, 2006, No 201; 2007, No 191; 2008, No 190; 2009. No 36) shall be amended as follows:
1.1. A second sentence to Item 1 of the Regulations shall be added in the following wording:
“These Regulations do not apply to the payments for providing civil aviation security services in accordance with the national and international lawsand the laws of the European Community.”
1.2. Item 3 shall be expressed in the following wording:
“3. Payment for the services of RigaAirportshall be determined as follows:
3.1. For utilisation of the airport infrastructure: the runway, taxiways, lighting of the runway and taxiways, the services of the airfield management and other airfield infrastructure necessary for aircraft take-off and landing at Riga International Airport the charge is set at 2.05 euros (or the equivalent sum in LVL according to the exchange rate quoted by the Bank of Latvia) per every 1000 kg of the Maximum Total Weight Authorised of the aircraft (rounded up to full 10 kg) per each landing/take-off of the aircraft;
3.2. One hour of a training flight shall be deemed equal to one take-off /landing and for every following hour a ratio of 0.75 shall be applied;
3.3.For an aircraft stand on the apron:
3.3.1. The first hour is free of charge;
3.3.2. For every hour subsequent to the time specified in sub-point 3.3.1 of these Regulations per every 1000 kg of the Maximum Total Weight Authorised : 0.14 euros or the equivalent sum in LVL according to the exchange rate quoted by the Bank of Latvia;
3.3.3. minimum charge for the use of the apron stand after the time specified in sub-point 3.3.1 of these Regulations – 30 euros or the equivalent sum in LVL according to the exchange rate quoted by the Bank of Latvia.
3.4. For utilisation of the passenger terminal infrastructure - the passenger and public waiting areas and passageways and for utilisation of other passenger terminal infrastructure required for passenger services at Riga Airport - the passenger service charge is set at 2.18 lats or the equivalent sum in euros according to the exchange rate quoted by the Bank of Latviaper each departing passenger. The passenger service charge shall not be applied to the passengers who are charged the payment specified in sub-point 3.5 of these Regulations;
3.5. For transit and transfer passengers, i.e., the passengers departing from Riga Airport by the same aircraft by which they arrived or by a different aircraft, who at the time of staying at the airport do not need to leave the airside territory, for utilisation of the passenger terminal infrastructure at Riga Airport a transit passenger service charge of 0.70 lats or the equivalent sum in euros according to the exchange rate quoted by the Bank of Latvia is set per each departing transit and transfer passenger.”
1.3. Items 61, 62and 63 shall be deleted.
1.4. Sub-item 7.2 shall be deleted.
1.5. In the first sentence of sub-item 7.4 the word “payments” shall be replaced with words “air navigation service charges”.
1.6. Sub-point 7.4 1 shall be added to the Regulations in the following wording:
“7.4. 1 Payments for the services of RigaAirport shall be made for each calendar month by the 15th day of the subsequent month in accordance with the invoices submitted by RigaAirport”.
1.7.Sub-point7.6 shall be added to the Regulations in the following wording:
“7.6. For overdue payments a fine of 0.05 percent of the outstanding principal amount shall be charged for each day of delay.”
1.8. In Item 10 the words “once a month (by the twenty fifth day)” shall be replaced with words “on the first working day of each subsequent month”.
1.9. Point 10.1 shall be added to the Regulations in the following wording:
“10.1 The payments specified in Item 3 of these Regulations shall be transferred by 31 December 2010 at the latest.”
2. Sub-points 1.2 and 1.9 of these Regulations shall enter into force on 1 November 2009.
