USEFUL, USABILITY, DISPOSABILITY (UUD) is a project which addresses the issue of plastic invasion of our communities and households with a purpose to bring the message of a safe and healthy environment closer to the citizens through civic education enabled by land art installation.

Five organizations decided to use their capabilities and expertise to produce a Moodle based e-learning platform with content capable to serve the project needs. For this reason we are preparing Training needs assessments on Moodle based e-learning platform for organizations, which works with children, youth, seniors, artists, and disadvantaged persons.

Desk research will be carried out by partners in Romania, Bulgaria, Spain, Italy and Lithuania in order to find out each country policy framework, active organizations, popular civic events and training offer in each country.

The data provided will just be used in the framework of the Useful usability disposability project and only the project partners and the European Commission will have access to them.

1 / Public policies supporting the reduction of the plastic consumption in your country / Decision of the Gov of Romania on National Waste Management Strategy 2014-2020 issued by the Romanian Ministry of Environment and Climate Change published in in Monitorul Oficial, Partea I nr. 750 din 04/12/2013.
It regards the government responsibility to prevent and manage wastes drawing on costs and benefits for environment, society and economy as well as the limits of the natural capital.
Efforts are to be made in view of
- wastes management from prevention through recycling to elimination;
- measures to encourage waste prevention and reuse towards sustainable resource use;
- recycling rate increase and improvement of recycled materials quality;
- promoting packaging wastes recycling ;
- reducing the carbon impact of waste ;
- encouraging power production based on wastes which cannot be recycled;
- setting up a national database for a more effective monitoring process;
- implementing the concept of “life cycle analysis” in the wastes management policy
In view of population and business service improvement the Strategy supports :
- green investment
- initiatives to raise population responsibility on reducing, reusing, recycling and valorization of household wastes;
- cooperation with local public authorities to increase the effeciency and quality of collected wastes,making them easier to recycle and valorize;
- cooperation with the local public authorities and the businesses with a purpose to improve wastes separate collection and treatment şi sectorul
The Strategy indicates the approach acc to the New Framework Directive :
-  municipality wastes as coming from commerce, industry, institutions as well as fractions collected separately;
-  wastes specific flows: biodwastes, pakaging wastes.building and demolishing wastes, electrical equipmemt wastes, used oil wastes, used tyres, wastes containing asbestos, medical wastes and related.
The National Stratgey for Sustainable Development Horizons 2013-2020-2030 – is built around the value of wastes as resources based on the wastes hierarchy from Directive 2008/98 EC.The guiding principles of the strategty include:
-  waste generation prevention –maximum priority
-  prep for reuse, recycling and valorization
-  elimination (disposal)- lowest priroity
Responsibility for packaging wastes management and data provision on packages enntering the market should belong with companies from the production loop : maker, wrapper, distributor, importer) . In the EU, Denmark excepted, the industry (individual businesses) set up organizations to comply with the national law . Individual business transfer their obligations to the organization
2 / Transposition of European directives to national contexts / Directive 94/62/EC concerning packages and packaging wastes with a period of tranposition until 2013, transposed into national law through Gov Decision no.. 621/2005 with subsequent changes and additions;
Directive 2001/42/CE – transposed into the Gov Decision nr. 1.076/8 July 2004 – establishes the the enviroment assessment in view of issuing plans and programs
Directive of the Council 2000/76/EC on wastes incineration transposed into national law Gov Decision no. 128/2002 with a transition until 2009
Directive 2008/98/CE of the European Parliament and Council regarding wastes(the New Framework Directive) was transposed into the national Law no. 211/2011 – concerning waste management; it introduced the new European concept concerning the need to approach wastes as resources as well as the principle of the producers’ extended responsibility.
Directive 99/31/EC on wastes disposal with a period of transposition until 2017, tranposed into national law through Gov. Decision 349/2005 With its changes and additions to date acc to the mentioned Directive.
Law 249 /2015 regards packaging and packaging wastes management .It sets priority measures to prevent packaging wastes production, wastes reuse, recycling, valorization and other ways leading to reducing the final elimination of such wastes.
Romanian standards for packaging wastes quality allowed on the market are compliant with EU Regulation 1025/2012 of the European Parliament and Council
3 / Implementation of the national laws: impact, quality, controls in the field / Policy and Decision making+ control -http://www.mmediu.ro/ The Ministry for Environment, Waters and Forests sets the national policies in the fields of enviroment, waters and forests management. It ensures the state coordination and control authority directly or through specialist bodies, authorities and technical authorities or public institutions under the authority of the Ministry.
http://www.anpm.ro/ National Agency for Environment protection reports to the Ministry and is the policy implementing body and law enforcement accross the country according to the Gov Decision 1000/2012.The Environment Agency has got 42 county branches which account for policy implementation and law enforcement at a local level.
Regarding waste management, the Agency :monitors law implementation at a national level, provides for data colletion, processing and validation in relation with the EU and national law implementation, ensures public access to waste management data by law, reports on the environment state in relation with waste management, cooperates with EU and Member states and other local and international bodies based on a mandate by the Agency President and with the approval of the central authority for environment protection
http://www.afm.ro/ The Environment Fund Administration reports to the Ministry Of Environment and ensures financial support to environment programs in compliance with the EU principles “the polluter pays” and “producer’s responsibility

http://www.gnm.ro/sitenou/ The Nationl Environment Guard is the ‘police’ arm of the Ministry, controls legal compliance with environement law at a central and local level, reports on breach of law to competent bodies, issues penalties for non-compliance with environment acts in all walks of life, checks on activities with an impact on environment and applies sanctions, checks legal compliance of authorizations, dangers of major accidents with a crossbroder impact in view of risk prevention, etc
Penalties for non-compliance with Law 249/2015 concerning packaging and packaging wastes management:
-400-800 Lei for citizens and 10,000-20,000lei for companies not disposing wastes in specific places or with the sanitation services of the locality.
-2000-8000lei to companies for not separating municipal wastes from recyclable wastes; not disposing off wastes to bodies authorized to valorize or incinerate packaging wastes;
-8000-15000 lei for improper waste management hidering production
-10000-20000 lei for inacurate data provision to responsible bodies and the EC concerning packaging wastes collection,recycling, re-use, disposal and incineration
- non-compliance with the provisions of art 16 which provides for collection and recycling responsibility based on wastes origin.
-non-compliance with quality standards harmonized with the EC ones of wastes entering the market of stopping the compliant ones to enter the market.
Impact of Eco-tax for discuoraging non-degradable plastic bags consumption ...in 2009 the authority introduced an eco-tax og 0.2 lei per plastic bag which lead to a decfrease of 30% of the plastic bags nuber over 2008. The authority decreased the eco-tax per plastic bag 0.1 lei. The result was that by 2011 the income on eco-tax more than doubled, and in 2014 more than dobled again which means that the Romanins put on the market more than 400 mil non-biodegradable plastic bags. The collected sums are onky related to the population consumption.

-  environment overtaxation by 2lei/kg due by companies producing packaging according to 196/2005 Gov Decision, amounts to 230-250 mil Eur in 2016 which leads to food price increase .
-  The Responsiblity Transfer Organizations (collecting wastes for recycling, incineration or dumping from member companie) were audited in 2015 by the National Environment Fund and incorrect reporting by 55000 t was found which leads to an additional environment tax payment of app. Of 25 mil tones
-  an infrigement procedure is expected from the EC for bad packaging waste management with a penalty of 200000 eur /day ; it will be reflected in the taxes at the population level .
-  Ministry will work on the waste management system improvement to get the infringement to an end as soon as possible,
