State Policy Committee Minutes

1. SPC Roll Call

Mike Markl presided as chairman and called the State Employee Charitable Campaign (SECC) State Policy Committee (SPC) to order at 9:15AM. Roll call was taken. Chairman Markl announced a quorum was present.

2. Approval of May 6, 2011SPC minutes

A motion was made by Louri O’Leary and seconded by Cecile Young to approve the May 6, 2011 minutes. The motion passed.

3. Methodology and process by which contributions are distributed

A presentation was made by Vicki Smith with the Office of the Texas Comptroller. Vicki works in the fiscal management division and helped to develop the rule 5.48 which regulates the SECC. Vicki reviewed each of the responsibilities of her office as it relates to the SECC which are 1. Abide by the administrative rule, 2. Maintain the system for the local campaign managers, 3. Maintain direct deposit, 4. Provide a report monthly to each statewide federation and local campaign manager that shows the amount of money deposited from the comptroller’s office into their system, 5. Assist local campaign managers and statewide federations when they have questions pertaining to deposits, and 6. Community to state agencies and higher education institutions the list of updated organizations to ensure their set up is correct.

It was suggested that the campaign attempt to log volunteer hours for state employees who are volunteering as campaign coordinators to show the true worth of the SECC.

Chair Markl and the committee thanked Vicki Smith and her staff for their time and continued work on the State Employee Charitable Campaign.

4. Approval of statewide materials

Edie Muehlberger, State Advisory Committee (SAC) chair, and the State Campaign Manager presented the statewide materials to the SPC. The SAC met and reviewed all of the materials and is recommending approval of the presented documents.

The SPC reviewed the materials and it was suggested that in the future the SPC have more of integrated role in developing the materials. It was requested that the SCM look into a website portal on the SECC website where documents for review by the SPC could be posted.

A motion was made by Louri O’Leary and seconded by Frances Torres to approve the presented statewide materials. Greg Davidson voted against the motion. The motion passed.

5. Approval of SECC local materials

Edie Muehlberger, State Advisory Committee (SAC) chair, and the State Campaign Manager presented the local materials to the SPC. The SAC met and reviewed all of the materials and is recommending approval of the presented documents.

It was requested that Laredo share any information they have received regarding an increase in givers through their local campaign leadership program.

A motion was made by Greg Davidson and seconded by Raette Hearne to approve the Laredo individual leadership giving level program. The motion passed.

A motion was made by Cecile Young and seconded by Greg Davidson to approve the Laredo pledge form and directory. The motion passed.

A motion was made by Cecile Young and seconded by Greg Davidson to approve the San Antonio pledge form. The motion passed.

A motion was made by Frances Torres and seconded by Louri O’Leary to take a break. The motion passed.

The State Policy Committee meeting reconvened at 10:50 am.

6. SPC Review of local application appeals

Raette Hearne presided as chair.

A motion was made by Mike Markl and seconded by Louri O’Leary to deny Ronald McDonald House Charities of Amarillo due to an insufficient attachment e. The motion passed.

A motion was made by Mike Markl and seconded by Louri O’Leary to approve and grant a waiver to Ascension Academy. Greg Davidson voted against the motion. The motion passed.

No action was taken on the appeal from City of Refuge due to an incomplete application.

A motion was made by Mike Markl and seconded by Greg Davidson to deny Seton Fund due to an insufficient attachment e. The motion passed.

A motion was made by Mike Markl and seconded by Greg Davidson to deny Children’s Medical Center Foundation of Central Texas due to an insufficient attachment e. The motion passed.

A motion was made by Mike Markl and seconded by Louri O’Leary to deny Big Brothers Big Sisters of Central Texas due to an insufficient attachment e. The motion passed.

No action was taken on the appeal from Little Helping Hands due to an incomplete application.

No action was taken on the appeal from Texas School for the Deaf as the organization is ineligible to appeal an over 25% administrative cost cap because they participated for the first time after 2004.

A motion was made by Chris Conradt and seconded by Louri O’Leary to approve and grant a waiver to United Negro College Fund. Greg Davidson voted against the motion. The motion passed.

A motion was made by Chris Conradt and seconded by Raette Hearne to deny Angel Flight South Central due to an insufficient attachment e. The motion passed.

12. Public Comment

A motion was made by Greg Davidson and seconded by Louri O’Leary to hear public comment earlier on the agenda.

Public comment was given by Brian Roe, Executive Director of Community Shares of Texas, and Edie Muehlberger, State Advisory Committee Chair and Co-Director of Earth Share of Texas.

7. SPC Review of statewide federation and affiliate appeals

Community Shares of Texas

The SPC discussed whether they would proceed in reviewing the appeals from affiliates of Community Shares of Texas. Melissa Juarez was consulted regarding the authority of the SPC to review statewide appeals at this particular point in the process. Melissa informed the committee that they did have the authority to review the appeals if they chose to do so.

A motion was made by Raette Hearne and seconded by Frances Torres to review Community Shares of Texas affiliate appeals. The motion passed.

A motion was made by Greg Davidson and seconded by Cecile Young to deny NARAL due to an insufficient health and human service statement. A record vote was taken: Greg Davidson, Louri O’Leary, Raette Hearne, and Cecile Young voted for the motion. Frances Torres and Chris Conradt voted against the motion. The motion passed.

A motion was made by Frances Torres and seconded by Cecile Young to approve Texas Rio Grande Legal aid based on the provided revised health and human service statement. The motion passed.

A motion was made by Raette Hearne and seconded by Chris Conradt to approve Texas Folklife.

The SPC discussed the health and human service provided by Texas Folklife.

Raette Hearne withdrew her motion and made a motion to deny Texas Folklife. The motion was seconded by Greg Davidson. Frances Torres voted against the motion. The motion passed.

A motion was made by Frances Torres and seconded by Chris Conradt to approve Texas Low Income Information Services. Greg Davidson and Raette Hearne voted against the motion. The motion passed.

A motion was made by Cecile Young and seconded by Raette Hearne to deny Texas Educational Broadcast Cooperative (KOOP) due to an insufficient health and human service statement. The motion passed.

10. Recent developments in local and statewide campaign operations

Local Campaign Managers were presented for the Amarillo, Capital Area, Concho Valley, Denton, Greater West Texas, Houston and San Antonio areas.

Local Employee Committee (LEC) chairs were presented for the Amarillo, Capital Area, Denton, Greater West Texas, Houston, and San Antonio campaign areas.

A motion was made by Cecile Young and seconded by Greg Davidson to approve the LEC chairs presented for the Amarillo, Capital Area, Denton, Greater West Texas, Houston, and San Antonio campaign areas. The motion passed.

The SCM provided a legislative update regarding legislation that would allow retirees to participate in the SECC as well as legislation regarding the Adopt-A-Library program.

The SCM shared a list of state agencies that are currently participating in the SECC and those that are not. The SPC discussed working towards engaging those state agencies that are not currently participating in the SECC.

11.Set Next Meeting

The next SPC meeting is tentatively scheduled for June 24, 2011 at 9:00 am.

The next SPC meeting agenda should include agenda item 8 – proposed rules 34 TAC 329.3, 329.5, 330.3, and 330.7 as well as agenda item 9 – rules relating to international organizations.
