Tertiary Education (Student Representation) Regulations 1995

1.Objective

The objective of these Regulations is to declare the conduct of elections for student representation on the council and certain other bodies established for the purposes of a post-secondary education institution to be an activity of direct benefit to the institution or students at the institution for the purposes of section 12F of the Tertiary Education Act 1993.

2.Commencement

These Regulations come into operation on 1January 1996.

3.Authorising provision

These Regulations are made under section 22 of the Tertiary Education Act 1993.

4.Declaration of elections for student representatives

(1)For the purposes of section 12F of the Tertiary Education Act 1993, the conduct of an election for a student representative on—

(a)the council or governing body of a post-secondary education institution; or

(b)a body established by—

(i)the council or governing body of a post-secondary education institution; or

(ii)the Act or the subordinate instrument (within the meaning of the Interpretation of Legislation Act 1984) which constitutes the post-secondary education institution or its council or governing body; or

(iii)a body established by an Act or subordinate instrument referred to in sub-paragraph (ii)—

to assist in the management or academic development of the institution or part of the institution—

is declared to be an activity of direct benefit to the institution or students of the institution.

(2)A body referred to in sub-regulation (1)(b) does not include an organisation of students.

(3)In this regulation—

"election" means an election in which—

(a)any student; or

(b)any student in a category of students—

of the institution is eligible to stand as candidate and which is conducted by or on behalf of—

(c)the council or governing body of the post-secondary education institution; or

(d)a body referred to in sub-regulation (1)(b)—

but does not include an election in which membership or non-membership of an organisation of students—

(e)is a qualification; or

(f)renders a person ineligible—

to stand as a candidate or to vote;

"conduct of an election"—

(a)includes the preparation or distribution of material or information about the election to students of the institution by the person or body conducting the election;

(b)does not include the preparation or distribution of material or information—

(i)by candidates in the election; or

(ii)on behalf of candidates in the election (except by the person or body conducting the election); or

(iii)by or on behalf of an organisation of students;

"organisation of students" has the same meaning as in section 12A of the Tertiary Education Act 1993.

1.General Information

The Tertiary Education (Student Representation) Regulations 1995, S.R.No.195/1995 were made on 19 December 1995 by the Governor in Council on the recommendation of the Minister for Tertiary Education and Training, the Minister having considered a proposal from the Victorian Vice-Chancellors' Committee, under section 22 of the Tertiary Education Act 1993, No.18/1993 and came into operation on 1 January 1996: regulation 2.

The Tertiary Education (Student Representation) Regulations 1995 will sunset 10 years after the day of making on 19 December 2005 (see section 5 of the Subordinate Legislation Act 1994).
