Terms For The Request and Supply of Special

Police Services Under Section 25 Police Act 1996

I duly authorised by and acting on behalf of [name of Club] Football Club (the Club) hereby request the provision of Special Police Services (SPS) by the Chief Constable of Kent Police upon the following terms and conditions:

  1. The Chief Constable of Kent Police will provide to the Club SPS under Section 25 of the Police Act 1996 as set out in Schedule 3 of this agreement. In determining the level of SPS to be provided for a particular fixture, the parties shall have regard to the appropriate table at Schedule 2, which indicates the number and level of police personnel normally to be allocated to fixtures of a specific category and the length of time they are to be deployed. Such police personnel shall be deployed by the Chief Constable within the area at or near the premises of the Club, being the area shown delineated in red on the attached plan at Schedule 1.
  1. The Club will pay charges for SPS at the rates determined from time to time by the Police & Crime Commissioner for Kent (PCC).
  1. The amount of time each relevant member of police personnel is to be deployed at a fixture for the purposes of the relevant tables in Schedule 2 (and for the purposes of being considered SPS) shall include the following:

i) Travelling from home Place of Duty to the Police Briefing Point and/or where the event takes place

ii) Briefing instructions

iii) Pre-match crowd control

iv) The match itself and crowd dispersal

v) De-briefing

vi) Travel to home Place of Duty

  1. The number, rank and specialist skills of officers and staff supplied by police at any fixture, and the time for which they are deployed, will be as determined appropriate by the Chief Constable (or authorised representative). Schedule 2 categorises fixtures as Club Security, A,B, C or C-IR and indicates the 'normal breakdown' of the SPS for which a charge will be made for a fixture in that category, unless otherwise determined by the Chief Constable (or his authorised representative) having regard to further intelligence, any representations from the Club and any other relevant matters.
  1. VAT will be added to all charges made under this agreement. Payment by the Club to the Police & Crime Commissioner for Kent will be made before the commencement of each fixture. If payment is made by cheque then it must be received in sufficient time for it to be cleared by the bank clearing system before the commencement of the Fixture. If the payment is not made as required the PCC will charge interest at the rate of 3% above the lending rate of the PCC Bankers from the date of the invoice until the date of settlement. The PCC reserves the right to commence proceedings for the recovery of any debt outstanding including unpaid interest after the expiry of the agreed payment date.
  1. If the request for SPS in respect of any fixture specified in Schedule 3 of this agreement is cancelled then provided at least 15 working days written notice of cancellation is given by the Club to the Police prior to the scheduled kick-off time of the fixture no charge will be made. If less than 15 working days’ notice is given then the Club will be liable for 100% of the agreed costs. Where the fixture is abandoned after kick-off the club will be obliged to pay the agreed costs as if the fixture had concluded.
  1. The level of SPS to be provided in respect of the fixtures in Schedule 3 will be reviewed in accordance with the procedure in Schedule 5. If, following that procedure, the Chief Constable or authorised representative (normally the match commander) determines that the level of SPS at a specific fixture should be varied, the Club will request that varied level of SPS by use of the form at Schedule 5. The Club agrees that a request signed by any of the following shall be a valid request on behalf of the Club for SPS:

  1. In the case of any additional fixtures not referred to in Schedule 3 (including, but not necessarily limited to, cup ties, replays, and rearranged fixtures), the level of SPS to be requested by the Club and provided by the Police will be determined in accordance with the procedure in Schedule 4. Following that procedure, the Chief Constable or authorised representative (normally the match commander) will determine the level of SPS to be provided. The Club will request that varied level of SPS by use of the form at Schedule 5. The Club agrees that a request signed by any of the following shall be a valid request on behalf of the Club for SPS:

  1. If the Chief Constable subsequently agrees that SPS should not be provided for any fixtures in Schedule 3, or SPS are not requested for any additional fixtures, or payment for SPS is not made as required by this agreement, there will be no police officers on duty deployed within the ground whatsoever and the Chief Constable shall be under no obligation to the Club whatsoever to maintain sufficient availability or any officers on standby.
  1. The Chief Constable may, on occasions where SPS are not provided, deploy any officer(s) inside the ground for the purpose of intelligence gathering. The Club will not be charged for the deployment of these officer(s), nor will it charge entrance fees for the officer(s) unless previously agreed by both parties. Any officer deployed inside the ground in these circumstances will be under no obligation to the Club whatsoever to assume responsibility for any situation that may arise during the course of the match, irrespective of whether or not it would seem the most appropriate course of action
  1. All reasonable steps will be taken by the Chief Constable to provide the level of SPS requested in the case of each fixture. The Club accepts that in instances of operational emergency the Chief Constable or his representative may direct officers to other duties without incurring any liability whatsoever for any cancellation or amendment to match schedules, or any other consequences flowing from the redeployment of officers.
  1. The Club agrees that it is solely responsible for public safety at the Stadium and that it will take all appropriate steps to ensure public safety and compliance with the terms of the Safety Certificate for the Stadium.

Procedure for reviewing level of SPS for fixtures in Schedule 4 or determining level of SPS for additional fixtures

  1. In the case of fixtures in Schedule 4, a meeting between Police and Club shall take place no less than [15 ] days before the fixture. In respect of any particular fixture, the Police and Club may jointly agree that such a meeting is unnecessary, in which case the level of SPS will be as set out in Schedule 4.
  1. In the case of additional fixtures, the Club will notify the date and time of the fixture to the Police as soon as it is known to the Club. A meeting will take place between Police and Club as soon as possible thereafter.
  1. It will be the responsibility of the Police to provide to the meeting an intelligence input, an operationally and occupationally competent Public Order Commander and an accredited Tactical Advisor. Other officers may attend as required at the discretion of the Chief Constable.
  1. It will be the responsibility of the Club to provide to the meeting the ground safety officer or head steward. In addition, the Club must provide to the meeting a person authorised by the Club to make a request for the provision of SPS in accordance with this agreement (if the ground safety officer or head steward is not so authorised). Other club members or employees who may assist in assessment of the safety, crime and disorder risks may attend as required.
  1. The meeting will review the available intelligence and other information, following which a determination will be made of the necessary levels of policing and stewarding for each fixture. The resource levels may differ to those set out in Schedule 2 as the normal levels for each match categorisation. This will be based on relevant intelligence, history and all other information.
  1. The decision as to the appropriate level of police resources to be provided as SPS will be made by the Police Public Order Commander, on behalf of the Chief Constable, taking into account the views of the Club and others at the meeting. Once the Police Public Order Commander has determined the level of SPS to be provided, the Club will make a formal request for those SPS using the form at Schedule 6. However, where the level of SPS to be provided at the fixture remains as set out in Schedule 3, the form at Schedule 5 is not required.
  1. The Public Order Commander may review the determination of the level of SPS to be provided at any time before the start of the fixture, in the light of any new or updated information or intelligence. The Police Public Order Commander will consult with the Club before making any such determination. Where the Police Public Order Commander determines that a different level of SPS need to be provided, the Club will make a formal request for those SPS using the form at Schedule 5. However, it is anticipated that only exceptionally will the determination vary from that made at the meeting referred to above.
