THE PROCUREMENT

1.  GENERAL INFORMATION

1.1. Procurement Identification Number JMRMV/2014/1. The Acquisition of Musical Instruments for Jazeps Medins Riga Music Secondary School.

1.4. The Commission of the Procurement (hereinafter – the Commission) confirmed by the principal’s order No. 43 26.09.2014.

1.5. The Method of the Procurement – the open tender in accordance with the Public Procurement Law article 8.2 The Procurement Regulations and its attachments are open to public access in the Internet in JMRMV homepage: www.jmrmv.lv section Procurements.

1.6. The place, date, time and schedule of the Contract Performance

1.6.1.  The offer shall be submitted from the Tenderer in person until the 4th of November, 2014, 11:00 o’clock, 10/4 Stabu Street, Riga, Secretariat of JMRMV (4th floor, Room 414, opening hours on business days from 9:00 – 17:00)

1.6.2.  Offers can be delivered by post. The Tenderer is responsible for the offer sent to the specified address (10/4 Stabu Street, Riga, LV-1010) before the determined deadline in paragraph 1.6.1.

1.6.3.  All offers delivered after the determined deadline in paragraph 1.6.1. will not be accepted.

1.7. The Execution of the Offers and the Content

1.7.1.  The offer documents shall be submitted in one envelope;

1.7.2.  The pages of the document should be numbered;

1.7.3.  The offer documents should be clearly legible, without any corrections and deletions;

1.7.4.  The offer documents should be submitted in one copy (the original);

1.7.5.  The prices of the Financial Bid should be set in Euros, also specifying the price without and with VAT. The technical and financial offer should be prepared in accordance with the form in Annex 3., Annex 4.

1.7.6.  The price of the offer should include all the expenses for the musical instruments required in the procurement, thereby showing the total price of the contract for the procurement.

1.7.7.  The offer should be submitted in closed and sealed envelope. The following information shall be indicated on the envelope:

2.  Information on the Subject of the Procurement

The description of the Procurement subject – the subject of the Procurement: CPV reference number 37310000-4 – musical instruments (Annex 2)

The subject of the Procurement may be divided in 2 parts. Part one: oboe, saxophone, piano. The second part: bassoon.

The Purchaser has the right to reduce the amount of the Procurement, if the Tenderer’s Financial Bid exceeds the financial resources earmarked for the Procurement.

3.  The Requirements for the Tenderers:

3.1. The Tenderer has been registered in accordance with the requirements of laws and regulations of the respective country and has all the documents (certificates, licenses etc)to carry on the trade of the determined goods in technical specification of the Republic of Latvia

3.2. The Tenderer (legal person) has not been announced the insolvency process (except the case when there is a rehabilitation or any other similar type of order that has been drawn on the insolvent debtor’s possible prevention of bankruptcy and the restoration of the insolvency), the Tenderer’s business activity has not been suspended or terminated, the bankruptcy proceedings are not initiated, or it has not been established that the Tenderer will be liquidated.

3.3. The Tenderer in Latvia or in the country of registration and habitual residence has no tax arrears, including compulsory social security contribution arrears, exceeding 150 Euros in total in each country.

4.  The Offer Documents

4.1. The copy of the registration certificate of the applicant registered in the Enterprise Register of the Republic of Latvia or in any other similar entrepreneurship/ business activity recording establishment abroad.

4.2. Application for the participation in the Procurement (the form enclosed as Annex 1).

4.3. Technical specification (the form enclosed as Annex 2) and Financial Bid (the form enclosed as Annex 4). All expenses should be included in the price.

4.4  The Tenderer registered or having habitual residence outside of Latvia has to include with the Procurement Offer the relevant foreign country’s competent institution’s certificate which certifies that the conditions of the Public Procurement Law’s fifth part of the article 8.2 are not applied on him - The Tenderer (legal person) has been announced the insolvency process (except the case when there is a rehabilitation or any other similar type of order that has been drawn on the insolvent debtor’s possible prevention of bankruptcy and the restoration of the insolvency), the Tenderer’s business activity has been suspended or terminated, the bankruptcy proceedings are initiated, or it has been established that the Tenderer will be liquidated; The Tenderer in the country of registration and habitual residence has tax arrears, including compulsory social security contribution arrears, exceeding 150 Euros in total in each country.

5.  Evaluation of the Offers

5.1. The offers of the Tenderers will be evaluated by the Commission and the winner of the Procurement will be determined in a closed commission’s sitting on the 04th of November, 2014, at 11:00 o’clock.

5.2. Information about the examination, explanation, evaluation, comparison of Tenders and the determination of the choice of the winner will not be made known to other Tenderers or any other persons who are not officially involved in the process until the winner of the Procurement is announced.

5.3. The Commission of the Procurement will choose the lowest price of the offer if the required musical instrument complies with the requirements of the Regulations.

5.4. If the musical instrument is offered as equivalent, the Commission of the Procurement shall be entitled to invite experts on testing and evaluating the musical instrument’s compliance status of equivalent.

5.5. The Commission of the Procurement will check all the necessary information in the competent authority, publicly accessible database or any other publicly available sources if it is necessary for the conformity check of the offers, the Tenderers selection, offer evaluation and comparison, and the commission will also plead the Tenderers or competent authorities to supplement or explain the certificates and documents delivered to the commission.
