PURPOSE
To undertake a range of regulatory duties and to provide advice and guidance to elected members, internal and external partners regarding all aspects of Local Authority licensing involving taxis and animal welfare issues, implementation of the smoke free provisions of the Health Act and the management of unauthorised encampments.
CORPORATE RESPONSIBILITIES
- To undertake a range of licensing and enforcement duties in accordance with relevant policy and procedures and delivered to meet customer expectations and the Council’s customer care standards.
- To provide advice and guidance when necessary to senior officers, elected members and service users on statute, guidance and policy
- To ensure services for which the post holder is responsible are delivered to customer expectations and to the council’s standards of customer care
- To support the delivery of the Council’s corporate priorities
- To implement the service delivery plan to ensure service priorities relating to the post holders area of responsibility are delivered
- To undertake all corporate requirements on health and safety, equality and diversity, data protection, risk management and financial regulations
- To manage and develop internal and external networks to maximise professional knowledge and understanding to the benefit of the service and organisation
- To provide advice to senior officers, service users and businesses on areas of specialist/professional knowledge in a timely manner and in accordance with service delivery requirements
- To carry out other duties commensurate with the grade and purpose of the job and the objectives of the Environment Health and Regulatory Services and Council.
OPERATIONAL RESPONSIBILITIES
- To assess compliance with relevant legislation and statutory guidance, provide advice and where necessary take appropriate enforcement action in respect of all taxi licensing matters in line with the Enforcement Policy
- To maintain an up to date knowledge of statutory requirements and have particular regard to the requirements of: the Police & Criminal Evidence Act, Criminal Procedures & Investigations Act, Human Rights Act, Regulation of Investigatory Powers Act and other relevant legislation, Council polices and practices, national guidelines and relevant codes of practice
- To undertake inspections, investigation of complaints, enforcement and processing of applications in respect of all taxi licensing.
- To prepare reports on vehicles / premises / activities inspected following complaints, inspections or as part of surveys and maintain premises, case, and other records in accordance with Council requirements.
- To provide advice and guidance to elected members, senior officers and service users on all matters relating to animal welfare licensing, to prepare and issue licenses regarding pet shops, riding establishments and dangerous wild animals, to monitor compliance with license conditions and to take appropriate proportionate enforcement action as required.
- To carry out investigations, take witness statements and where necessary carry out surveillance in order to undertake required enforcement activity.
- To issue fixed penalty notices when sufficient evidence has been obtained to enforce smoke free legislation
- To prepare reports and prosecution files, in line with legislative requirements and present at meetings and court as required
- To process applications for registration under the Motor Salvage Operators Regulations 2002, to ensure that the relevant register is maintained and updated and to liase with the police as necessary.
- To carry out investigations and liaison with welfare agencies and partners and to initiate appropriate actions regarding unauthorised encampments.
- To work in partnership with other external agencies in relation to enforcement campaigns and initiatives
- To work as part of a team and provide support, cover and assistance to other officers involved in licensing work, when required.
- To work outside normal hours when necessary and to participate in the out of hours standby rota.
