Talent/Model Release

[_] This package contains (1) Instructions and Checklist for Talent/Model Release; (2) Information about Talent/Model Release Forms; (3) Talent/Model Release Form.

[_] A Talent/Model Release allows a photographer (or company) to obtain permission from a Model/Talent to use his or her performance, picture or likeness on film, video or photo, for advertising, trade, or any other lawful purposes.

[_] This Talent/Model Release is for adults (i.e. over the age of 18 or other applicable age of majority). If the Talent/Model is a minor, a different form, called “Talent/Model Release for Minors” needs to be used.

[_] The Talent/Model should hand-write (a) their name at the beginning of the form; (b) their address in the space under their signature; and (c) date and sign the Release.

[_] The photographer or company obtaining the release, should write his/her/its name in the second blank space in the first paragraph.

[_] The photographer or company obtaining the release should keep the original of the signed Release. This document may later be useful to prove that consent to take the pictures or make the film or video was properly obtained and will prevent a claim by the Talent/Model that he or she never gave consent. The Talent/Model should be given a copy of the Release.

Information

Talent/Model Release

When a picture, film or video is taken of a person, the photographer is the owner of the picture (photographer is also meant to include video and filmmakers or any company that produced the pictures, film or video). However, the individual whose picture was taken has rights in his or her likeness. Although the individual photographer owns the picture, it should not be put to any commercial use unless the person in the picture consents. The use of someone’s likeness without their consent, may constitute an invasion of privacy, and subject the user to payment of damages.

A Talent/Model Release allows a photographer or company to obtain permission from a Model/Talent to use his or her performance, picture or likeness on film, video or photo, for advertising, trade, or any other lawful purposes (i.e. in the advertising of a product or service, on a website, in a commercial etc...).

This document may later be useful to prove that consent to take the pictures or make the film or video was properly obtained and will prevent a claim by the Talent/Model that he or she never gave consent.

The rights can be granted to the photographer or to a company (i.e. shooting pictures / video or selling a product or service).

If the Talent/Model is a minor, a different form called “Talent/Model Release for Minors” (available at findlegalforms.com) should be used.

TALENT/MODEL RELEASE

For valuable consideration received, the receipt and sufficiency of which are hereby acknowledged, I ______(name of talent/model) hereby forever grant to ______(name of photographer or company), his/her/its legal representatives, successors, assigns, licensees, advertising agencies, and all persons or corporations acting with his/her/its permission, the irrevocable and unrestricted right to use, re-use, publish and re-publish, and copyright my performance, likeness, picture, portrait, photograph, sound and/or voice recording, includingthe negatives, transparencies, prints, film, video, tapes, digital or other information pertaining to them in all forms of media now or hereafter known and in all manner, including electronic media, in still, single, multiple, moving or video format, in whole or part and/or composite representations, in conjunction with my own or a fictitious name, including alterations, modifications, derivations and composites thereof, throughout the world and universe for advertising, promotion, trade, or any lawful purposes.

This right shall include, but not be limited to, the right to combine my likeness with others and to alter my likeness, by digital means or otherwise, for the purposes set forth herein.

I waive any right to inspect or approve the finished product, including written copy that may be created in connection therewith or the use to which it may be applied.

I acknowledge that the photography session and/or film or video production was conducted in a proper and professional manner, and this release was willingly signed at its termination.

I affirm that I am over the age of majority and that I am fully able to contract in my own name without breach of any prior agreement or applicable law, including but not limited to prior agreements with modeling or talent agencies or any other person, company or entity.

I have read the above release and agreement, prior to its execution; I fully understand the contents and consequences thereof. This agreement shall be binding upon me and my heirs, legal representatives and assigns.
