RELEASE AND DISCLAIMER/INDEMNITY FOR LIVE WORK ACTIVITIES
READ CAREFULLY
In this document, Live Work Activity means a good supplied or a service performed by a student or trainee, in this case - …………………………………………………… (insert description eg furniture repair, sculpture, cubby house construction, motor vehicle repair).
I request to participate in a Live Work Activity provided by a student / trainee of the …………………………….. Institute of TAFE (“the Institute”).
In consideration of my request being granted, I acknowledge that I participate in the Live Work Activity of my own free will and I agree as follows:
(a) I understand the Live Work Activity is being performed/supplied by students/trainees only and the quality of the Live Work Activity may not necessarily meet the standards of a professional qualified in the relevant industry;
(b) I agree that the Live Work Activity performed/supplied shall be entirely at my own risk and I shall not make any claim against the State of Queensland, the Institute or its students/trainees arising out of the performance of the Live Work Activity or the use of the product resulting from the Live Work Activity;
(c) I agree that the State of Queensland, the Institute and its students/trainees shall not be liable for any loss or damage (including consequential loss or damage and loss of profits) however caused (including by negligence) arising out of the performance of the Live Work Activity or the use of the product resulting from the Live Work Activity;
(d) I agree to indemnify the State of Queensland, the Institute and its students against any loss, damage or expense (including legal expenses) arising from any claim, demand, action, suit or proceeding that may be made or brought against them for personal injury to, or the death of any person or loss or damage to any property as a result of the performance of the Live Work Activity or the use of the product resulting from the Live Work Activity whether or not the claim or proceeding is due to the negligence of the State of Queensland, the Institute or its students, and
(e) I release and discharge the State of Queensland from any such claim or action which, but for the provisions of this Agreement, might be made on the State.
I fully understand that I –
· Am only allowed to participate in the Live Work Activity if I agree to do so at my own risk;
· Must not cause damage or any disturbance or nuisance to the person or property of the Institute or of others;
· Must comply with all rules published or directions given by the Institute regulating the conduct of persons for the safety, care, good order and cleanliness of the Institute; and
· Consent to any medical treatment that the Institute considers necessary for my personal health and safety.
