RESOLUTION NO. 3718

A RESOLUTION ESTABLISHING FEES FOR THE USE OF CITY-OWNED SWIMMING POOLS AND AUTHORIZING RULES AND PROCEDURES FOR THE OPERATION OF THE SAME IN ACCORDANCE WITH OVERLAND PARK MUNICIPAL CODE 10.04; RESCINDING RESOLUTION NO. 3566.

WHEREAS, the City of Overland Park, Kansas, owns and operates six (6) public swimming pools: Young’s Park Pool, Roe Pool, Bluejacket Pool, Stonegate Pool, Marty Pool, and Tomahawk Ridge Aquatic Center for public recreation purposes; and

WHEREAS, the City of Overland Park, Kansas, establishes and administers rules, regulations and fees for use of said swimming pools.

NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF OVERLAND PARK, KANSAS, THAT THE FOLLOWING POLICIES AND FEES BE ESTABLISHED:

A.The City Manager, through the Director of Parks and Recreation, shall have the authority to establish rules, regulations and procedures for use of the public swimming pools.

B.The Aquatics Supervisor shall administer said rules, regulations and procedures as directed by the City Manager through the Director of Parks & Recreation.

C.The City Manager, through the Director of Parks & Recreation, shall have the authority to establish promotional and/or introductory rates for memberships and programs.

D.The City Manager, through the Parks and Recreation Department shall have the authority to establish fees of $100 or less per person for programs, such as swim and dive teams, clinics, special events or classes, for the purpose of offsetting the costs incurred to sponsor the program.

E.Fees for use of said public swimming pools shall be as follows:

Caregiver admitted at no charge.

(Overland Park residents will receive a $1.00 discount on daily fees with proof of residency).

Other Fees:

Not-for-profit group care homes accommodating 12 persons or less which possess a current and valid special use permit pursuant to O.P.M.C. Section 18.36.010, paragraph 31, if required, and are licensed by the appropriate state licensing agency will be eligible for family season memberships.

This resolution shall take effect and be in force from and afterJanuary 13, 2009.

RESOLUTION NO. 3566 is hereby rescinded.
