In considering this suspension, a review of the proposed suspension and history of suspensions was conducted by personnel above. It was determined that this suspensiondoes or does not constitute a pattern of suspensions (Note: if a pattern is determined to exist, this is legally an equivalent to an involuntary change in placement and requires Manifestation Determination and a functional behavioral assessment if the misconduct IS a manifestation of the disability. All of the following factors were considered in evaluating whether this suspension constituted a pattern. First, this suspension resulted in more than 10 days in the school year, AND:

IEP meeting for the purpose of:

Conduct a manifestation determination, (mandated to be scheduled within 10 business days from this removal because on review (see above) the suspension did constitute a pattern. (IF behavior IS determined at this IEP meeting to be a manifestation of the disability, then an FBA must be conducted as well).

Consider if behavior is impeding the learning of this student or peers. A Behavior Intervention Plan to designate strategies, including positive behavioral interventions (supports) and strategies may be developed

Review existing behavior intervention plan contents, implementation of existing plan and potential modifications of plan

Include services of a SELPA authorized Behavior Intervention Case Manager (BICM) to determine need for a Functional Analysis Assessment (Ca. Ed. Code) because the behavior was serious by Ca. ed code definition: It was assaultive, self injurious, serious property damage or another pervasive maladaptive behavior.
