S.R. No. 34/2017

The Judges of the Supreme Court make the following Rules:

1 Object

The object of these Rules is to amend Chapter VI of the Rules of the Supreme Court to further provide for the powers of judicial registrars in relation to matters of a criminal, quasi-criminal orrelated nature and make minor statute law revisions.

2 Authorising provisions

These Rules are made under section 25 of the Supreme Court Act 1986 and all other enabling powers.

3 Commencement

These Rules come into operation on 29 May 2017.

4 Principal Rules

In these Rules, the Supreme Court (Criminal Procedure) Rules 2008[1] are called the Principal Rules.

5 Subpoenas

After Rule 1.12(1) of the Principal Rules insert—

"(1.1) For the purposes of Rule 42.09(3) of ChapterI, as applied by paragraph (1)—

(a) a judicial registrar may hear and determine an application for leave to inspect a document or thing produced, where there is no objection to the inspection;

(b) the judicial registrar constitutes the Trial Division of the Court; and

(c) all the powers of the Trial Division of the Court to hear and determine such an application are delegated to the judicial registrar.".

6 Case conference

For Rule 4.08(2)(b) of the Principal Rules substitute—

"(b) at any time before the trial.".

7 Further authority of judicial registrars

(1) After Rule 4.17(1)(a) of the Principal Rules insert—

"(ab) make an order for the remand or furtherremand of an accused where noapplication for bail is made;

(ac) vary any condition of bail by consent orwhere the application to vary is unopposed;".

(2) At the foot of Rule 4.17(1)(b) of the Principal Rules insert—

"Note

See also Rule 1.12(1.1).".

(3) For Rule 4.17(2)(c) and (d) of the Principal Rules substitute—

"(c) subject to paragraph (1)(ac), to vary any condition of bail; or

(d) subject to paragraph (1)(ab), to remand an accused.".

8 Statute law revision

In the Principal Rules—

(a) in Form 6–6AC, for "serious criminal conduct" substitute "serious criminal activity";

(b) in Form 6–6P, in item 2 of the Particulars ofApplication—

(i) before "Director" insert "Commonwealth"; and

(ii) omit "within the meaning of the Commonwealth Act";

(c) in Form 6–6Q—

(i) for "under 20A" substitute "undersection 20A";

(ii) in item 2 of the Particulars of Application—

(A) before "Director" insert "Commonwealth"; and

(B) omit "within the meaning of theCommonwealth Act";

(d) in Form 6–6R, for "at *at" substitute "*at".
