Even if the city hall allows a married Christian couple to get divorced, there are cases when the church will not give its consent. Even today, divorce is not recognized by the Catholic Church. However, giventhat the situation in today’s society has changed, even Ireland, which is strictly Catholic, voted to legalize divorce in a 1995 referendum. Countries like the Philippinesstill do not allow divorce, but these policies will change. By contrast, divorce is common in western countries. Because of the increase in the divorce rate, a social problem emerges—custody of children has become a heated issue.

Take the USA for example. According to a 1996 survey, there were 3,000 divorces and 7,000 marriages. Up until the late 1970s, it had been common practice to automatically award custody to the mother when a divorce occurred. However, since the 1970s, this practice has been challenged. Most custody battles today are decided, in theory, on the basis of who is the more fit parent for the child.

This legal change was the result of the social changes that took place in the USAduring the 1960s and 1970s. These changes challenged many of the traditional roles men and women were expected to play. As a consequence, it is not uncommon nowadays to find women working outside their homes and being very concerned about their careers and personal lives. Likewise, it is not unusual to see men accepting roles that were once considered the exclusive domain of women likeshopping for groceries. Because the change in the roles that men and women in the family and society is inevitable, the attitude of the judicial system toward child custody is changing. For these reasons, more and more men have started to fight for and win custody of their children when divorce occurs.
