Sub-delegations to Council Officers from the General Manager

Purpose

To devolve accountability to the Council Officer responsible and to remove the uncertainty associated with limit of authority, responsibility and accountability which will improve Council’s service through speedier resolution for the organisation and customer needs.

Background

Under Section 377 of the Local Government Act 1993 (the Act), Council may, by resolution, delegate to the General Manager certain functions , and further, under Section 378 of the Act, the General Manager may sub-delegate any of the functions to other employees of the Council. As such, the Act clearly separates the responsibility of the elected Council to define policy and of the General Manager and staff to operationally implement the Policy.

In formulating these sub-delegations, the principle that has been followed is that decisions, actions, authorities etc., should be sub-delegated to the lowest level practicable, thereby balancing the customer’s need for an expeditious result with the Council’s requirement for a considered and informed decision to be made at all times.

The benefits of these sub-delegations are that they devolve accountability to the Council Officer responsible for initiating and actioning the necessary outcomes (i.e. single point accountability) and remove the uncertainty sometimes associated with lines of authority, responsibility and accountability.

Authority of COUNCIL Officer Acting in a Higher Position within the Organisation Structure /
A Council Officer acting in a higher position assumes the sub-delegations of that higher position.
GENERAL INFORMATION
Budget
Council Officers can only authorise expenditure within their own Business Unit/Team budgets and must ensure that there are sufficient funds available.
Council Officers cannot authorise or sign matters relating to their own expenditure or personal affairs.
Extent of Delegations
Council Officers utilising delegated powers under the authority of this document will be held responsible and accountable for any outcomes. Managers within the organisation will be advised and given the opportunity to respond, if any difficulties arise as a result of these sub-delegations. These sub-delegations apply to the lowest possible officer within the organisation structure. An officer holding a higher position within the organisation structure and having direct reporting line to the delegated position will also be entitled to carry out that sub-delegation.

§  Applications having a major environmental impact on the locality and which involve land owned by Council.
