PUBLIC COMMENT POLICY-It is the policy of the Naches Town Council to accept public comment on agenda items at the time the item is being discussed during the study session. Public comments regarding items not on the agenda will be heard at the end of the meeting. During the Regular Council Meeting Public Comments will be accepted at the end of the meeting.

All matters listed within the consent agenda have been distributed to each member of the Naches Town Council for reading and study, are considered to be routine, and will be enacted by one motion of the Council with no separate discussion. If separate discussion is desired, that item may be removed from the consent agenda and placed on the regular agenda by motion of the Council.

a)  Approve minutes of 9/14/09 Study Session.

b)  Approve minutes of 9/14/09 Regular Council Meeting.

c)  Approve those Claim Checks dated through October 12, 2009 in the amount of $298,582.07 Check #’s 13088-13134. (Holding the checks for Columbia Asphalt & Huibregtse Louman in the amounts of $209,680.41 & 20,973.72 until we have been reimbursed for the expenses.)

d)  Approve those Payroll Checks dated through September 30, 2009 in the amount of $26,795.14; Check #’s 5294-5308 & 995308.

7)  REPORTS/ANNOUNCEMENTS

a)  Planning Commission Report-There was no Planning Commission Meeting Held on Monday, October 5, 2009

a)  Set Public Hearing for 2010 Budget 11/09/09 and 12/14/09

10) UNFINISHED BUSINESS

a)  Naches Depot and Trail Project Phase 2- Release retainage on the Naches Depot & Trail Project Phase II

b)  ARRA Construction-Accept Project as Complete

c)  Allan Road Study

d)  Transfer of Almega Cable Inc. to J&N Cable-Still waiting on Cable Company to return appropriate paperwork

e)  New Proposed Animal Ordinance Council has the option to review these ordinances and accept them as is, change the ordinance to reflect their different views, table the ordinance, or instruct Attorney Watkins to re-draft and come back next month with the changes.

f)  Street location Amendment for Skateboard Ordinance 649

g)  The release of retainage on the Clarifier Mechanism Installation Project.

11) NEW BUSINESS

a)  Amend Funding Source on the 6-Yr. TIP

b)  Approval to allow clerk to transfer monies back into the CE, St Construction and Capital Improvement Funds from the Misc. Capital Improvement Fund. We originally transferred $100,000 into the Depot fund for the Town’s portion of funding. Not all monies were needed. (CE $3,707.57, St Const. $7,415.15 and Capital Improvements. $13,594.43. total transfer from 310 Misc. Capital Const. $24,717.15)

12) RESOLUTIONS AND ORDINANCES

a)  Proposed Resolution No. 2009-11 allowing the Town Clerk to release the retainage on the Naches Depot and Trail Project to Granite Northwest Inc. (In the amount of $13,565.48.)

b)  Proposed Resolution 2009-12 allowing the Town Clerk to release the retainage on the Clarifier Mechanism Project to TTC Construction LLC. ( In the amount of $1,526.30.)

c)  Proposed Resolution 2009-13 authorizing the Mayor to accept the 2nd and 3rd Street Resurfacing Improvements as complete and allow for 100% payment, less retainage bond, to the contractor

13) AUDIENCE PARTICIPATION

Limit of approximately 3 minutes per person from the public with a limit of 20 minutes total. All New Business will be taken under advisement and any further action will be handled at the next meeting.

a)  Auditor left on Friday, September 18, 2009, the Town faired well.

b)  2010 YVCOG Budget

c)  Thank you letter for improvements-Reeder Family

d)  Complaint letter for noise on Hwy. 12 during construction phase

e)  E-mail from Kit Hawver in regards to Park Hours/Response from Adm. Ranger

f)  CA Agreement with Yakima County for Naches Avenue Improvements was signed by the Yakima County Commissioners at their Regularly scheduled meeting held on Tuesday, October 6, 2009
