HUD Project Based Rental Assistance (Section 8): HUD's Student rule, effective 1/30/2006. This rule applies to All PART TIME and FULL TIME members 18 & olderattending an institute of Higher education. This rule does NOT apply to students applying for housing with a parent(s).An institute of Higher education can only be determined by the education facility. / Yes or No
Does student(s) have dependent children? If student is 23 or under, count financial aid in excess of tuition as income. If student is older than 23 or older with dependents, do not count financial aid as income.
Students,who are married, count financial aid in excess of tuition as income. Use copy of marriage license or joint income tax return as verification.
Students who are 24 years of age or older. Financial assistance above tuition is counted as income.
Students under the age of 24 that are veterans (military). Count financial aid in excess of tuition as income. Use copy of military discharge papers for verification.
Students under the age of 24 whose parent(s) are Income qualified for section 8 assistance in the county where they live.

Students Under the age of 24 who qualify under the “Independent student rule" * see detail under Student eligibility # 7. A. – i. in Resident Selection Plan
Vulnerable youth students who meet independent student definitions in sections (b)The individual is an orphan, in foster care, or a ward of the court or was an orphan, in foster care, or a ward of the court at any time when the individual was 13 years of age orolder , (c)The individual is, or was immediately prior to attaining the age of majority, an emancipated minor or in legal guardianship as determined by a court of competent jurisdiction in the individual's State of legal residence; or (h) The individual has been verified during the school year in which the application is submitted as either an unaccompanied youth who is a homeless child or youth (as such terms are defined in section 725 of the McKinney-Vento Homeless Assistance Act) (42 U.S.C. 11431 et seq.), or as unaccompanied, at risk of homelessness, and self-supporting, by(i) a local educational agency homeless liaison, designated pursuant to section 722(g)(1)(J) (ii) of the McKinney-Vento Homeless Assistance Act; (ii) the director of a program funded under the Runaway and Homeless Youth Act or a designee of the director; (iii)the director of a program funded under subtitle B of title IV of the McKinney-Vento Homeless Assistance Act (relating to emergency shelter grants) or a designee of the director; or
(iv)a financial aid administrator
Tax Credit Program: The low income housing tax credit student rule applies when ALL members are full time students. This RULE includes minor children K-12 / Yes or No
Households that receive aid for families with dependent children. TANF/welfare cash benefits. This does not include food stamps. Must have third party verification of Public Assistance at initial and every annual.
Households with adult head or co-head that is enrolled in JTPA (job training program) or similar program. MUST be verified through education facility. Must have third party verification at initial and every annual.
Single parent with a dependent child(ren) and you have a copy of income tax return to show that no one (other than another parent for minors) claims the single parent or minor children on their income tax return. Must have copy of income tax return at initial and each subsequent year at annual recert.
Adult student is married and filing a joint income tax return. Management must have a copy of income tax return at initial and each subsequent year at annual.
A student who was previously under the care and placement responsibility of the State agency responsible for administering a plan under part B or part E of title IV of the Social Security Act”.
HUD Section 236 Program: Student must meet all of the following / Yes or No
Be of legal contract age under state law
Have established a household separate from parents or legal guardians for at least one year prior to application for occupancy, or
Meet the U.S. Department of Education’s definition of an independent student. (see definition below of independent student)
Not be claimed as a dependent by parents or legal guardians pursuant to IRS regulations;andObtain a certification of the amount of financial assistance that will be provided by parents, signed by the individual providing the support. This certification is required even if no assistance will be provided.
*** Independent Student To be classified as an independent student, **the student must meet the Independent Student definition for Title IV aid.** The student must meet one or more of the following criteria:
1. Be at least 24 years old by December 31 of the award year for which aid is sought;
2. Be an orphan or a ward of the court through the age of 18;
3. Be a veteran of the U.S. Armed Forces;
4. Have legal dependents other than a spouse (for example, dependent children or an elderly dependent parent);
5. Be a graduate or professional student; or
6. Be married.
