Clubhouse Rental Agreement

I/We ______(“Renter”) accept and agree to be bound by all terms and conditions of this rental agreement (“Agreement”) for the rental of the Clubhouse located at the Evergreens Condominiums, Shane Way, Laconia, New Hampshire, as follows:

Renter agrees to indemnify and hold harmless The Evergreens Condominium Association, Management, and the Board of Directors from and against any liability, loss, damage, claim, cause of action, cost, or expense (including, but not limited to, attorneys’ fees and court costs) which may be incurred or sustained by reason of any breach of the terms and conditions of this Agreement or any negligence or willful misconduct on the part of Renter or Renter’s guests, invitees, family members, employees, agents, and licensees.

Renter agrees to comply with all applicable laws and all rules and regulations of The Evergreen Condominium Association during the event and to clean and securely lock the Clubhouse upon completion of the event. An employee of Management and/or a member of the Board of Directors will inspect the Clubhouse after the event in order to assess cleanliness of the Clubhouse and any damage, destruction, theft, or other loss of property that may have occurred during or by reason of the event.

Upon execution of this Agreement, Renter shall pay $250.00 by check made payable to the Evergreens Condominium Association. Renter understands and agrees that this payment represents a security deposit refundable to Renter as follows: After completion of inspection of the Clubhouse, Renter will be refunded the security deposit, provided that there was no damage, destruction, theft, or other loss of property and that the Clubhouse was left in a clean condition. If there was any damage, destruction, theft, or other loss of property, or if the Clubhouse was not left in a clean condition, the costs and expenses associated with the repair or replacement of property or the cleaning of the Clubhouse will be deducted from the amount of security deposit to be refunded to Renter and, in the event those costs and expenses exceed the amount of the security deposit, Renter will be liable for those excess costs and expenses and will pay those costs and expenses immediately upon demand.
