BeforewegetstartedIfirstwanttoacknowledgeourteamthatisintheroomhere.Wehaveanumberofthemthatyouwillbehearingfromtoday.Butalotofworkhasbeendonetogetustothispoint.Sowe’llacknowledgetheireffortsandthankthemforthat.

AsmanyofyouknowtheWorkforceInvestmentOpportunityActwassignedintolawthispastJuly -- anamazingnumberofchangesandvocationalrehabilitationaswellasindependentliving.

Thejobstraining,driventrainingisamajorshiftinthenewWIOAlegislation.There’sanemphasisonincreasedservicestotransitioningyouth.Andthere’satremendousamountofopportunitythatisbeingpresentedtouswiththischangeinlegislation.

Forthoseofyouthathavebeenaroundawhileyouwillrecallthatthisisprobablygoingtobethemostsignificantchangesincetheearly1990amendment.Andnodoubtthatthisisalsogoingtobringusalotofchallengesandrequirealotofresources.

Andbrighterresourceswillberequiredforustoidentifytheimpact,developtheimplementation,operation-wisethechangesthatwillbenecessarytocomplywiththenewWIOA.

OneofthethingsthatIwanttoemphasizehereisthatalthoughyou’llhearaboutnewaspectsoftheprogramsbothwithinVRandILnonewfundinghasaccompaniedtheservicesthatarerequiredtobeprovided.

AndasanexampleIwanttouseanexamplethatmanyofyoumayhaveheardmeuseinpriorforums.

Oneofthechangesthatoccursisthatforthefirsttimethereareseveralbudgetspecificitemsinthepieceoflegislation.

Soforexample,transitionservicesrequirethatwespend15%ofourbudgetonthat.

Asanexample,$45millionis15%ofourbudget.Werewetobespending$35milliononthatservicewewouldneedtogenerateanadditional$10millionofservicestocomplywiththestatute.

Thestatuealsoplacesarequirementthatforsupportedemployment50%ofthefundsbeusedforyouthwithmostsignificantdisabilities.

Oneofthethingsthatwereallyneedtothinkaboutandhearfromyouoniswhatarealltheconsiderations,whatarealltheimpactsthatyouhearandseearoundtheimplementationoftheWIOA?

Andwecertainlywanttohearfromyouthisafternoon.We’lllookforotherforumstohearfromyouandtohearaboutanythoughtsorconcernsorrecommendationsthatyouwillhave.

ButbeforeIturnthisovertoJuneyforsomeadditionalcommentsIreallywanttothankyouformakingthetimetobeonthecalltodayandtoparticipateandcontributetotheconversation.

AndCaliforniaisveryfortunatebecauseourDirector,JoeXavierhasbeennominatedbytheCaliforniaHealthandHumanServicesSecretary,DianaDooleyaswellastheCouncilofAdministratorsofVocationalRehabilitationtobepartofthisnewcommittee.

Sowe’rehopefulthatJoe’snominationwillbeacceptedandwe’llbe - hopetotellyoumoreoncewefindoutbuttoletyouknowthiscommitteeischargedwithdevelopingstrategiesforimprovingopportunitiesforcompetitiveandintegratedemploymentforindividualswithdisabilities,especiallythosewiththemostsignificantdisability.

Aswemoveintotoday’spresentationitshouldbenotedthatwe’renotgoingtocoveralloftheelementsofWIOAbutwehavelookedatalotofareas.

Todaywe’regoingtofocusonfixed.Andwe’regoingtowelcomeallofyourcommentsonalltheaspects.Eventhoughwemaynothaveaddressedthemtoday,wedowanttohearfromyouinallofthedifferentareas.

So,tobeginthissessionI’dliketointroduceyoutoourWIOAProjectDirector.ThisisourDORChiefCounsel,KellyHargreaves.ShewillwalkyouthroughDOR’sapproachtoanalyzingandimplementingWIOA.Kelly?

KellyHargreaves:ThankyouJuney.Thankyouallforbeinghere.We’reveryexcitedaboutthisopportunitytoinfluencechangeatthefederalandstateleveltocreatethequalityandquantityoftheservicesthatweprovide.

LetmetellyouwhatitmeanstobetheprojectdirectorforthisWIOAproject.

Ineedtomakesurethatwaswearelookingattherequirementsinthelawthatwedon’tmissopportunitiestoimpactchangetobetterprovideservicesbysuggestingthatRSAandtheDepartmentofLaborchangeexpectationstoeliminaterequirementsthathaven’t(unintelligible)beforethatdonothelpfosterorencourageoureffortsandthatmaystandinthewayforustoservemoreindividuals.

WerecognizethatwithouttheadditionalfundinganddifferentandadditionalexpectationsthatareinWIOAit’llbechallengingforustofindwaystomeetthoseexpectationswithoutjeopardizingalltheimportanceofthingsthatwedo.

Sothatwillbe - thatispartofmychargeismakesurethatevenifsomethingisnotspecificallyaddressedintheWIOAwetakethisopportunitytolookatitandseeifitworksforusandtoproposedregulatorychangestotheRehabServicesAdministrationandDepartmentofLaborwhenwethinkthatitmayhelpusinmovingforwardwithWIOAandinmakingimprovements.

WhatwedidwithafterJuly22isgatherinputinternallyaswellfromcommentsthatwecouldfindthatothershavemaderegardingthechangesandanticipatedimpacttoidentifythehighestpriorityitems.

Weidentifiedninedifferentareasandthenareaswithineachofthoseninethatweshouldlookatfirstandforemost.

Andwecreatedwhatwe’recallingasidebysidedocument.IthasahighlevelsummaryofwhattheWorkforceInvestmentActandtheRehabActassubmittedbytheWorkforceInvestmentActrequiredofusincomparisonwithwhatWIOArequiresofit.

We’llbepostingthathighleveltableonourWebpageinthenearfuture.We’veshareditoutwithouradvisorybody.Andourdirectorhasspokentoindividualsashe’sbeeninvitedtospeakinother - forotherpurposes,youknow,introducetheconceptofWIOAandwhatwe’redoingandencouragedfeedback.

Wearenowintheprocessofidentifyingworkgroupsforeachofthenineareas,sixofwhichwe’lltalkabouttoday.

Andthoseindividualswhohavebeenaskedtoleaveoneoftheworkgroupshavethesameexpectationasofthedirectorateofmewhichistothinkcreatively,thinkabouttakingtheopportunitythatispresentedtopositivelyimpactchangeandtothinkofnewideasofnewwaysofdoingbusinessthatmayormaynotberequiredunderWIOAsothatwecantrytoimpactthosechanges.

InJanuarywe’reexpectedtoseetheFederalDepartmentsofEducation,HealthandHumanServicesfirstdraftoftheirproposedregulations.AndIsaydraftbecausetheyshouldbeexpectingtodosomechangeasaresultofstakeholderinput.

Wewanttoencourageyoutowatchforthoseregulationsandtocomment.Thereisaminimumof30daycommentperiod.Andit’sreallyimportantthatwhilewewillbegatheringyourinputthatyoualsocommentontheregulationsandprovidetheinsightthatwas - thatisimportantforregulatorychanges.

Whatwe’rehopingforareregulationsthatarenotsoprescriptivethattheydon’tallowustoprovideservicesinawaythatismosteffective.

Afterthefederalregulationsarefinalizedthenwewillbemakingchangestoourstateregulationsandprovideanopportunityforyourinputbothinformallyaswellasthroughtheformalrule-makingprocess.

ThethreeitemsthatarenotcoveredtodaybutwillbeinthesidebysidearetheperformancestandardsthatareaddedintheWorkfaceInvestmentandOpportunityAct,thestateplanrequirementsandthecreationoftheadvisorycommitteethatJuneymentionthatourdirectorhadbeennominatedtobepartof.

ForthemostpartormostofthesignificantareasthateffectvocationalrehabilitationofindependentlivingareeffectiveuponthePresident’ssigningoftheactwhichisJuly22,2014withsomeexceptionsincludingsomeperformanceindicators,thenewrequirementsforestateplanandsomeotheritems.

Butweare - againwe’reapproachingthemwhilewe’reprioritizing.We’reapproachingthemallatthe - theyallneedtobeaddressed.

AtthispointIwouldliketoturnthisovernowtomycolleaguetowalkyouthroughsomeofthekeyprovisions.

IappreciatetheopportunitytosharebrieflywithyoutodayaboutafewoftheareasofimpactbroughttoindependentlivingandassistedtechnologybyWIOA.AndIlookforwardtoourfuturedialogueaswegothroughtheimplementation.

WIOAtransfersfederaloversightoftheIndependentLivingServicesandprogramvendoroftheAssistedTechnologyActof1998fromtheRehabilitationServicesAdministrationorRSAtotheAdministrationforCommunityLivingorACLwhichishousedintheFederalDepartmentofHealthandHumanServices.

DuringthetransitiontheDORwillbeengagingwithACLandRSAforILandATfederallevelactivitiessuchasmonitoring,reportingandfunding.

ACLhasassuredthattheyarepartneringwithRSAtoensurecontinuitythroughathoughtfulandcarefullyplannedtransitionthatminimizesprogramdisruption.

IamintouchwiththeTimBeatty,theChiefofIndependentLivingatRSAandSharonLewiswhoisthePrincipalDeputyDirectoratACL.AndIwillcontinuereachingoutsothattheDORworkswithourfederalpartnersduringthetransitionandimplementationofWIOA.

InternallytheDORisengagedinanalysisofthemanyidentifiedareasofimpactonIndependentLivingServiceswhicharereflectedinthesidebysidesummary,highlevelsummarythatKellymentioned.Andwewelcomeyourinputthroughouttheprocess.

Fortoday’scallI’mgoingtotouchonthreeofthemostimportantitemsatthispoint.

Thefirstisthatthesignaturerequirementforboththestateplanforindependentlivingandmoreimportantlyrightnowforanyamendmentstothestateplanforindependentlivinghavebeenchanged.

UnderWIOAitwasthreepartieswhosignedelectronically,theDOR,thestateIndependentLivingCouncilandRSA.

UnderWIOAthosethreepartieswillsignthestateplanforindependentliving.PlusACLhasaskedforhardcopysignaturesfromnotlessthan51%oftheILdirectors.

Theelectronicsystemisundergoingitschangesatthefederallevelsothatfuturesubmissionofreportswillallowthecollectionofallthoseadditionalsignatures.

SecondlytherearenewcapsforonuseofTitleVIIfunds.Nomorethan30%fortheselftocarryoutitsdutiesandnotmorethan5%fortheperformanceofadministrativeservicesfortheprogramunderTitleVIIB.

WeareworkingwithfiscalmanagementintheDepartmentofRehabilitationtoanalyzethatimpactandplanforimplementation.

OneofthesignificantchangesinWIOAthatIhavehadsomeconversationaboutistheadditionofafifthcategoryofindependentlivingcoreservices.

Thiscategorywhichisnewhasthreeparts.Facilitatingthetransitionofindividualswithsignificantdisabilityfromnursinghomesorotherinstitutionstohomeand/orcommunitybasedresidences,providingassistancetoindividualswithsignificantdisabilitieswhoareatriskofenteringinstitutionssothatthoseindividualscouldremaininthecommunityandfacilitatingthetransitionofyouthwithsignificantdisabilitieswhoareeligibleforindividualizededucationplansandhavecompletedtheirsecondaryeducationorleftschooltofacilitatethetransitiontopostsecondarylife.

IlookforwardtotheopportunitiesforbuildingandcreatingpartnershipsunderWIOAandtotheconversationsthatwewillhaveinthefuture.AndI’llturnthisovertoJeff.

WIOAemphasizesservingyouthwithdisabilitiesbyprovidingthemwithopportunitiestopracticeandimprovetheirworkplaceskills.

Thisincludesparticipationininternshipsandapprenticeshipsandpromotingyouthwithdisabilitiesparticipationinpost-secondaryeducation.

AssuchWIOArequiresVRagenciestotrackbothacademicwhichisnewaswellasvocationaloutcomesforyouthtransitioningfromhighschool.

VRagenciesaretoprovideopportunitiesforstudentswithdisabilitiestoobtainandadvanceinhighdemandjobsincludingthoseinscience,technology,engineeringandmathematicscareersotherwiseknownasSTEM.

WIOArequiresthattheVRlocalofficesprovidecoordinatedvocationalservicestostudentswithdisabilitiesthroughpartnershipwithschools,employersandlocalworkforcedevelopmentprogramstosupporttransitionactivities.

Forthefirsttimetheactdefinesagesofyouthfordifferentcategoricalserviceandpurposes.

WIOAhasthedefinitionforyouthwithadisabilityasbeinganindividualwithadisabilitynotyoungerthan14norolderthan24.

Youthwithdisabilitiesmayreceiveexpandedservicesrelatedtosupportofemploymentwhichwillbediscussedlater.

WIOAalsoaddsaseconddefinitionfor“astudentwithadisability”asbeingahighschoolfrom16to21yearsofage.

ThesestudentswithdisabilitieswhoareeitherreceivingspecialedservicesorindividualswithadisabilityforthepurposesofSection504willbeeligibleforamenuofVRservicescalledPre-EmploymentTransitionServicesorPETS.

SpecificallyVRmustprovideyouthwiththefollowingpre-employmenttransitionservices.Thisincludejobexplorationcounseling,workplacelearningexperiences,counselingrelatedtopost-secondaryopportunities,workplacereadinesstrainingandself-advocacytraining.

Thesepre-employmenttransitionservicesaretobeprovidedtoVRconsumerswith - andstudentswithdisabilitieswhoarepotentiallyeligibleforVRservices.

Regulationswilldefinethatfurther.Thispotentiallyincludes160,000specialeducationstudentsinCaliforniawhoare16yearsofageoroldertobeservedbyover100VRteamscorrespondingover550studentvocational(unintelligible)counselorsinthisstate - adauntingtask.

Theactrequiresthat15%ofthefederalportionof(wehavebudget)tobeusedforpre-employmenttransitionservices.Nostatematch,administrativecostsorindirectcostscanbecountedtowardsthismandatedsetasidecost.Andtherearenonewfederalfundsallocatedforthesenewservices.

Wearecurrentlyevaluatingourcurrentallocationofstaffandresourcessowecanmeetthisservicepriority.

AdditionallytheDepartmentofRehabilitationwillbeconductingacomprehensivestatewideneedsassessmentforyouthwithdisabilitiessowecandevelopsuccessfulstrategiestomeetthevocationalandacademicneedsofourstudents.AndwiththatI’llpassthisontoBillMoorewho’sgoingtotalkaboutsupportiveemployment.

I’mgoingtoprovideinformationtoyouonsupportiveemploymentandalsosub- minimumwage.Firstsupportiveemployment.

Changesinsupportiveemploymentalsoincludechangeinthedefinitionofsupportiveemployment.

Thedefinitionofsupportiveemploymenthasbeenmodifiedtoclarifythatsupportiveemploymentisintegratedcompetitiveemploymentoranindividualworkingonashorttermbasisintheintegratednon-competitiveemploymentsettingtowardsintegratedcompetitiveemployment.

Alsocustomizedemploymentisnowincludedwithinthedefinitionofsupportiveemployment.

Inadditionthetime,periodoftimeforjobcoachingserviceshasbeenextended.TheperiodoftimeaVRagencymayprovidejobcoachingserviceshasbeenextendedfrom18to24months.

WIOAalsorequiresthat50%ofthemoneythatstatesreceiveundertheTitleVIIsupportsitsemploymentstategrantbeusedtosupportyou,thatisages14to24withthemostsignificantdisabilities.

Theseyouthalsomayreceiveextendedservices.Andwedefineextendedservicesasongoingsupporttomaintainanindividualinsupportedemploymentafterclosureforuptofouryears.

AnimportantpointtonoteisthesupportiveemploymentallotmentthatDORreceivesistypicallyspentbythesecondmonthofthefiscalyear.

ThesupportiveemploymentallotmentforaDepartmentofRehabilitationdoesnotfullysupportDepartmentofRehabilitation’sAnnualSupportedEmploymentexpenditures.

AdditionallyIshouldsaythestateplanmustalsoprovideadescriptionofhowthestatewillgivebothsupportiveemploymentfundsandpre-employmentfundssectionstoleverageothercoverageandprivateresourcesforextendedservicesandexpandsupportiveemploymentopportunitiesforyouthwiththemostsignificantdisabilities.

NowI’llsharewithyouinformationonsub-minimumwage.

WIOAplacesemphasisoncompetitiveintegratedemploymentandcustomizedemployment.

WIOAincludesanewsection.Andthatnewsectionis511.Section511requireswhichbeganin2016aseriesofactivitiestodeterminewhetheranindividualwithadisabilityiseligibleforVRservicesandwhethertheindividualisabletoworkinanintegratedsetting.

WIOAprohibitsanycontractororsubcontractorfrompayinglessthanthefederalminimumwagetoanyindividualwithadisabilityage14to24withthefollowingexceptions.

AndtheyaretheindividualhasappliedforVRservicesandbeendeterminedineligibleforservicesortheindividualhasbeendeterminedeligibleforVRwithanindividualplanforemployment,hasworkedtowardstheemploymentoutcomestatedintheplanforareasonabletimewithoutsuccessorhashadtheirvocationalrehabilitationcaseclosedandreceivedcareercounselingandinformationaboutotherpublicprogramsandresourcesintheirgeographicalareaofre-employmentseriesandsupport.

Theaforementionedprogramandresourcescannotinvolveemploymentorservicescompensatedatsub-minimumwage.

Alsoanotherexceptionappliestoanindividualwhoisemployedatsub-minimumwageontheeffectivedateofWIOA.

Inthiscircumstancetheemployingentitymaynotcontinuetoemploytheindividualatsubminimumwageunlessatcertainintervals.OnceeverysixmonthsforthefirstyearandannuallythereafterDORprovidescareercounselingandinformationaboutotherpublicprogramsandresourcesintheirgeographicalareaofferingemploymentservicesandsupport.

AdditionallyWIOAprohibitsschoolsfromcontractingwithsubminimumwageproviders.Nowwe’llturnyouovertomycolleagueElena.

AsyoumaybeawareinCaliforniawehave49localworkforcedevelopmentboards.AndeachoneprovidesservicestotheirlocalOne-stopCareerCenterswhicharenowcalledAmerica’sJobCentersofCalifornia.

WIOAdesignatescertainprogramsascoreprogramsintheWorkforceDevelopmentSystem.

ThepublicVRprogramit’sadefinite - it’sdesignatedit’sacoreprogramandwillcontinuetobeamandatorymemberofthestateandlocalworkforcedevelopmentboard.

OthercoreprogramsincludeAdultDislocatedWorkerandYouthWorkforceInvestmentProgram,StateEmployment,program,justa(unintelligible)programandadulteducationandliteracy.

It’simportanttoknowthatthereareanumberofprovisioninWIOAthatemphasizeandincreasetherequirementsfortheGeneralWorkforceDevelopmentSystemandOne-stopJobCenterstomeettheneedsofjobseekerswithdisabilities.

AkeyprovisionsandI’mgoingtocovereightkeyprovisionshere.

ThefirstoneisthattheStateandLocalWorkforceDevelopmentBoardmembersmayincludecommunityorganizationsthatprovideorsupportcompetitiveintegratedemploymentforindividualswithdisabilities.

Anothernumbertwo,localworkforcedevelopmentboardswillhavetoensuretherearesufficientserviceprovidersinthelocalareawithexpertiseandassisttheindividualswithdisabilitieswiththeircareerandtrainingneeds.

TheENoremploymentnetworksandthentheSocialSecurityAdministrativeTickettoWorkprogramarenowoptionalone-stoporjobcareerpartners.

Numberfour,theStateWorkforceDevelopmentBoardwilldevelopstrategiestosupporttheuseofcareerpathwaysforindividualswithdisabilitiestoenterandretainemployment.

AnotherkeyprovisionNumber5,thelocalboardsmayhavestandingcommitteesincludingoneontheprovisionofservicesforindividualswithdisabilities.

Anotherkeyprovisionisthattheannualassessmentofphysicalandprogrammaticassetsontheone-stoporjobcentersforpeoplewithdisabilitiesisnowarequirementunderWIOA.

Seven,disabilityisakeyconsiderationinthedevelopmentofstateperformancerequirementsintheYouthandWorkforceDevelopmentFund,thefundthatisusedtoassistalljobseekers.

AndfinallyNumber8,underWIOAgovernorsmayreserveupto15%ofgeneralworkforcedevelopmentfundsforstatewideemploymentandtrainingactivity.Theremainderofthefundsgotolocalworkforcedevelopmentarea.

Andallowableuseofthesestatewidefundsisimprovingcoordinationofemploymentandtrainingactivitywithprogramsforindividualswithdisability.

InthechangesfromtheWIOAinthecomprehension - comprehensivesystemofpersonneldevelopmentistheVRcounselorstandardthatrequiresthestatetoestablishandmaintaineducationandexperiencerequirementsforitsVRprofessionalstoensurethattheVRpersonnelhavea21stCenturyunderstandingoftheevolvinglaborforceandtheneedsofindividualswithdisabilitiesforaBachelor’sDegree.

ThisisachangefromthepreviousrequirementtohaveaMaster’sDegreeinthefieldofvocationalrehabilitation.ButthisalsodoesnotchangethestandardthatCaliforniamaintainedforitsqualifiedrehabilitationprofessionaltohavetheMaster’sDegree.

Sothatis - thisisanareathatwherewe’recontinuingtoexploreandlookat.Butinthemeantimethere’snochangeintheMaster’sDegreerequirement.I’mgoingtosenditbacktoConnietoopenitup.
