CIRCULAR

Stipulating operation of Vietnam Post in International postal agencies

Pursuant to Posts law dated on June 17th 2010;

Pursuant to Decree No 47/2011/NĐ-CP on June 17th 2011 of the Government stipulating in details execution of some contents of Posts Law;

Pursuant to Decree No 187/2007/NĐ-CP dated December 12th 2007 of the Government stipulating function, duty, right and organizational structure of Ministry of Information and Communication; Decree No 50/2011/NĐ-CP dated on June 24th 2001 of Government on modification and supplementation of some articles in Decree No 187/2007/NĐ-CP on December 25th 2007;

Pursuant to Decision No 41/2011/QĐ-TTg dated on August 03rd 2011 of the Prime Minister on designating enterprises to maintain, manage public postal network, supply public postal service, international postal service;

Pursuant to Decision No 1746/QĐ-TTg dated on November 16th 2012 of the Prime Minister on transferring representative right of state – ownership in Vietnam Post from Vietnam Posts and Telecommunications Group to Ministry of Information and Communication;

Pursuant to proposal of Moderator of Vietnam Posts Authority,

Minister of Information and Communication enacted Circular stipulating operation of Vietnam Post in International postal agencies

Article 1: Governing scope

This circularstipulates role, content, right and obligation of Vietnam post when showing their activities in international postal agencies

Article 2: Applicable entities

This Circular is applied for Vietnam Post and other organizations and individuals relating to operation of Vietnam Post in international postal agencies

Article 3: Explanation for some terms

In this circular, some terms will be understood as follows:

  1. International convention on post in which Socialist Republic of Vietnam became a member is an international convention coming into effect in this country (hereafter referred as international convention), including charters, conventions, rules, agreements, final protocols and other regulations of international postal agencies
  2. International postal service and others in scale of international convention on post (hereafter referred as international postal service) are activities or postal services stipulated in international conventions

Article 4: International postal agencies

International postal agencies in which Socialist republic of Vietnam became a member (hereafter referred as international postal agencies) consist of:

  1. Universal post union including Congress, Council of Administration, Postal Operations Council, International office, committees and associations directly under
  2. Asia – Pacific postal union composing of Congress, executive council, office and agencies and associations directly under

Article 5: Enterprises appointed to take part in operation of international postal agencies

Vietnam Post, a state – ownership enterprise is appointed to supply international postal services and take part in operation of international postal agencies in scope of international convention on post stipulated in this Circular and other regulations of relevant law of Vietnam

Article 6: Contents for Vietnam Post’s participation in International postal agencies’ operation

Vietnam post presented their activities in International postal agencies with following contents:

  1. Supply international postal services in scale of international convention on post
  2. Take part in Postal Operations Council and associations directly under international postal agencies
  3. Perform projects, program with technical cooperation and sustainable development on post in universal and regional scale
  4. Participate in Universal post union and Asia – Pacific postal union congress
  5. Become a member in process of implementing international convention and general strategies and plans, action programs of international postal agencies
  6. Contribute to execution of agreements signed between Ministry of Information and Communication with members of international postal agencies to implement international conventions on post

Article 7: Duties and rights of Vietnam Post when becoming a member of international postal agencies

When undertaking some activities in International postal agencies, Vietnam Post is required to respect duties and rights as follows:

  1. Comply with regulations, requirements on postal profession to enterprises appointed in international conventions on post
  2. Follow up regulations of law of Vietnam on participating in activities of international agencies and providing international postal services
  3. On supply of international postal services in scope of international convention on post:

a)Build, maintain, manage and exploit international postal network and ensure that supply of international postal services complying with regulations of international convention on post and law of Vietnam

b)Prepare infrastructure and necessary conditions to provide sustainable and effect international postal services

  1. On participation in Postal operations Council and other associations directly under international postal agencies:

a)Take part in Postal Operations Council as an enterprise assigned officially by Government of Vietnam

b)Be active in making decision for participation in associations directly under international postal agencies

c)Be active in taking part in international cooperation activities, conferences, workshops with content of post

d)Play key role in researching and preparing contents of postal profession relating to exploitation, business, technique, economy and technical cooperation

  1. On performance of projects, technical cooperation programs, sustainable development activities relating to post in universal and regional scale:

a)Be active in making decision for participation in projects, technical cooperation programs, sustainable development activities relating to post in universal and regional scale;

b)Play key role in building projects, plans, preparing infrastructure, conditions on human resources and finance

c)Organize implementation of projects, technical cooperation programs, and other activities with participation in the past

  1. On participation in Universal post union and Asia – Pacific postal union:

a)To become some member of Vietnamese delegation to take part in Congress, meetings of Councils, Committees, working groups of international postal agencies;

b)Take the initiative in researching and proposing to Ministry of Information and Communication ideas for modifications, supplement to international convention and other contents relating to postal profession;

c)Co-ordinate to prepare contents and other relevant works under requests of Ministry of Information and Communication

  1. On participation in implementing international convention, general strategies and plans, action programs of international postal agencies and agreements stipulated in Clause 6 Article 6 of this Circular

a)Co-ordinate with Ministry of Information and Communication and other relevant organizations, units to perform international convention and agreements stipulated in Clause 6 Article 6 of this Circular

b)Take the initiative in implementing general strategies and plans, action programs with contents relating to postal enterprises appointed

c)Sponsor communication and popularization of international convention on post in the whole of public postal network

  1. Contribute finance in accordance with regulations of international postal agencies to relevant activities
  2. Carry out reports pursuant to regulations in Article 8 of this Circular
  3. Provide sufficiently and timely relevant information for Ministry of Information and Communication aiming to serve state management as well as guide and support execution process
  4. Implement other activities designed by international postal agencies in scale of Enterprise’s capacity and conditions and under requirements of Ministry of Information and Communication

Article 8: Report

  1. Vietnam Post has a liability to report:

a)Participation in Postal operations council; participation in associations directly under international postal agencies stipulated in section b clause 4 Article 7 of this Circular;

b)Results of participation in conferences, workshops, meetings mentioned to in section c clause 4 and section a clause 6 Article 7 of this Circular, without excess of 15 days as from terminating above events;

c)Results or implementation progress of contents stipulated in clause 5 Article 7 of this Circular, without excess of 30 days as from finishing implementation or report on progress of activities, projects and technical cooperation programs

d)Under requirements of international postal agencies and Ministry of Information and Communication

  1. For report stipulated in clause 1 of this Article is required to satisfy requirements as follows:

a)Accuracy about time as stipulated;

b)Consistency and accuracy of contents and figures of report

c)Delivery of a document in writing with electronic form to Ministry of Information and Communication

  1. In the event that Ministry of Information and Communication appoint Vietnam Post to send directly report to international postal agencies, Vietnam post must take responsibility of delivering copy of this report to Ministry of Information and Communication within 05 working days as from sending report
  2. Report on activities of Vietnam post in international postal agencies and other international cooperation activities must to be carried out according to regulations stipulated in this Circular and other posts laws

Article 9 Executive effect

  1. This circular comes into effect as from February 01st 2013
  2. This circular shall replace Decision No 818/QĐ-BTTTT dated on June 04th 2010 of Minister of Information and Communication on appointing Vietnam post to participate in some activities of Postal operations council (OPC), Decision No 835/QĐ-BTTTT dated on June 04th 2010 of Minister of Information and Communication on appointing Vietnam post to participate in APP association of APPU

Article 10: Implementation

Chief of the Secretariat, Moderator of Vietnam Posts Authority, Chief of Department of International cooperation, Head of organizations and units directly under Ministry, General Director of Vietnam Post and other relevant agencies and individuals have liability to execute this Circular
