AFFIDAVIT OF PROBABLE CAUSE FOR
ISSUANCE OF FELONY ARREST WARRANT FOR
JASON CLINE

Charges:
Count One: Murder I 21OS-701.7C
Patrick Vance, being duly sworn and upon his oath, states as follows:
1. I am a C.L.E.E.T. certified law enforcement officer and District Attorney’s investigator employed by the District Attorney for the 23rd Judicial District, Drug Task Force, where I have been so employed for approximately 13 years.
2. On 10/05/2010 at about 12:37 pm, Jason Cline called the Lincoln County 911 Center to request an ambulance at 30210 Oklahoma St. in McLoud, Pottawatomie County, Oklahoma. During this 911 call, Cline reported a 3 year old wasn't breathing and that he wanted to start CPR.
3. REACT Ambulance and McLoud First Responders including McLoud Police Chief Gary Roe and McLoud Police Officer Michael Randall responded to the Jason Cline and Amanda Cheek residence. Upon arrival REACT Ambulance began treating 3 year old Cody Chama, who was unresponsive. Officer Randall met with Cody's mother Amanda and her boyfriend Jason Cline outside the residence. Officer Randall was consoling Amanda, when Cline looked at Officer Randall and asked him “is it cause what I done to him”. Officer Randall said Cline appeared scared, but he was unsure what Cline meant by the statement at the time.
4. REACT EMTs transported Cody to Unity North Hospital then onto Children's Hospital in Oklahoma City. While Cody was at Unity North, Chief Gary Roe observed only a small abrasion on Cody's forehead and a small abrasion on the left side of his scrotum.
5. On 10/05/2010, Cody's attending physician Dr. Henry with Children's Hospital/OU Medical Center, said Cody's CT scan showed a brain bleed. Dr. Henry said Cody was acting brain dead, but further testing needed to be done to determine this. Dr. Henry stated Cody has severe, bilateral retina hemorrhaging in both eyes, and he was not responsive to pain. Dr. Henry stated Cody's injuries were consistent with child abuse.
6. On 10/05/2010, Chief Gary Roe went to Children's Hospital to observe visible injuries on Cody's body. While examining Cody, Chief Roe saw injuries that were not previously visible earlier that day when Chief Roe responded to the 911 call at Cody's residence. Chief Roe described these injuries as both bruising and swelling on Cody's forehead as well as scratches and inflammation to his genitalia. Chief Roe later returned on 10/06/10 and photographed the above mentioned injuries. On 10/06/2010 at about 3:23 pm, Cody Chama died as a result of these injuries.
7. On 10/06/10, at about 2:45 pm, Child Welfare Specialist Wes Priest conducted a forensic interview with Jason Cline's six year old daughter, Madison Cline. During this interview, It was learned that Jason Cline along with his daughters, Madison and Audrey Cline, Jason's girlfriend, Amanda Cheek and her 3 year old son, Cody Chama all live together at 30210 Oklahoma St. in McLoud, Oklahoma. Madison said Cody was scared of Jason and thought he was gonna hit him. Madison said she did not know that Cody was sick but heard Jason tell the judge that he had thrown up.
8. After Madison's interview, a forensic interview was also conducted with four year old Audrey by Child Welfare Specialist Dee Vanduser. During this interview, Audrey said that she and Madison never get in trouble but then pointed at the drawing identifying Cody and said he is always in trouble. She also said when Cody gets in trouble, Jason is always the one who spanks him.
9. On 10/06/10, DA Investigator Brad Gaylord conducted post-miranda video/audio recorded interviews with both Jason Cline and Amanda Cheek. During these interviews, Jason said he has no idea what happened to Cody. He said he was playing on the computer on an on-line poker website when he decided to check on Cody and found he was not breathing. During these interviews, it was learned that Jason and/or Amanda both explained the injuries to Cody's genitalia as him pulling and tugging on his penis. They both stated they have video of Cody doing this and that is what they thought was the source of those injuries. Investigators also learned that Jason and Amanda were the only two adults that were in contact with and/or supervising Cody Chama on 10/5/10, the date Cody sustained the injuries that led to his death.
10. On 10-11-10 your affiant conducted an interview with Amanda Cheek at the Task Force office in Shawnee. During the taped interview Cheek advised your affiant that when she left to go for a doctors visit at about 8am on 10-5-10 Cody was awake and alert waiving at her before leaving him with Jason. Cheek advised that when she returned home at or about 10am Cody was asleep on the couch. Cheek stated that shortly after awaking Cody began to vomit and she noted that he was not responding as he normally would when he had vomited in the past or was “ Zoned Out”. She then advised that she had checked his temperature twice and noted that it was below normal she it was approximately 97 degrees the first time and 96 degrees the second time. When your affiant asked when Cheek noticed the wound on Cody's forehead she advised that it was not there when she left to go to the doctor but it was there when she returned home.
11. Based on the reports your affiant has reviewed along with interviews of persons related to the investigation it has been established that Jason Cline was the only adult with Cody Chama when he sustained the injuries that led to his death.
12. Jason Cline is a white male with brown hair and hazel eyes, SS# 459735156, DOB: 4-12-84, approximately 5'8',225 lb.,
13. I request the court issue upon probable cause, a felony warrant for arrest of Jason Cline for the charge of Murder in the 1st degree.
