ORDER

The Appellant is present. Shri Net Ram Gram Sachiv-ASPIO Block Mustafabad Distt. Yamuna Nagar is present.

2.The Appellant filed his seven points’ Application dated 16.5.2015 under the RTI Act,2005 before the SPIO-BDPO seeking certified copy of charge reports from 1990 to 2014, BPL Survey from 1975 to 2014, map and field book abadi deh etc. in respect of Gram Panchayat Bal Chhapar. Finding no response within the stipulated time frame, the appellant filed Appeal dated 19.6.2015 before the First Appellate Authority. Aggrieved with the response of the SPIO and the FAA, he filed Second Appeal dated 20.7.2015 before this Commission, which had been fixed for hearing today before this bench.

3.The Appellant admitted that he has received information dated 17.9.2015 from the Respondent. However, the information, according to him, was incomplete and misleading in certain ways.

4.The Respondent representative of the BDPO Administrator informed the Commission that the information provided had been after due examination. However, in case there were any shortcomings the same can be corrected after hearing from the Appellant.

5.He also clarified that in Point No.1 regarding chulha tax details, information has already been provided earlier. The Appellant, indicated various points including incomplete charge report, village street plans etc which were not provided in terms of information.

6.The Commission disposes of the appeal by giving the following directions:-

i)The Appellant shall provide to the Respondent a list of shortcomings/deficiencies that he has found in the reply given by the Respondent by 20.10.2015. The Respondent-BDPO shall reply to all these points by 5.11.2015 giving complete information. He is being given the option of improving the information he has already provided to the Appellant.

ii)The Respondent BDPO-Administrator shall furnish an affidavit with regard to the information being complete and nothing being hidden with regard to the reply to the Appellant. This should be done before 20.10.2015.

iii)With regard to the fact that delay has occurred in provision of the information on the RTI Application filed on 16.5.2015. First Appeal filedon 19.6.2015 and second appeal filed on 20.7.2015. The Respondent has submitted that he would like to give an explanation in this regard which should be given today itself.

iv)If the appellant is not satisfied,he can approach the DDPO by 15.11.2015.
