Dear Sirs,
Subject/State Company for Agricultural Supplies (SCAS)/ International/ General/ Tender No. Veterinary Drugs /Commodity/2/2017 for providing Various Veterinary Drugs (VVD).
SCAS has a pleasure to invite eligible & professional bidders to submit their bids to supply the above goods,with noting the following:-
1-If bidders desire to obtain an additional information, contact with SCAS (from Sunday to Thursday during the official work days) as specified in Bidding Data Sheet (BDS).
2-Offers be accepted from well-known producers, manufacturers or their official agents as per BDS/ Evaluation and Qualification Requirements.
3-Final balance sheets for the last two years attested by concerned authorities state & clarify the bidder's profits & revenues not less thanID (99125000) (ninety nine million one hundred twenty five thousand Iraqi Dinar).
4-Submission of a proof confirms funds be available & not less than ID (1982500000) (one billion nine hundred eighty two million five hundred thousand Iraqi Dinars).
5-The bidders who interested to purchase the bid documents, present written application to address mentioned in ITB and pay non-returnable value of documents of ID (100000) (one hundred thousand Iraqi Dinar) plus services of selling the documents ID (198250) (only one hundred ninety eight thousand two hundred fifty Iraqi Dinar).
6-The estimated cost for supplying the said goods is ID (19825000000) (only one billion nine hundred eighty two million five hundred thousand Iraqi Dinar) within Farmer Supporting Allocations/ 2017 of the Beneficiary (Veterinary Directorate (VD)).
7-Exclusively, the bidders, managing director or who establishes the biding company submit preliminary deposits of ID (40000000) (forty million Iraqi Dinar) being Bid Bond under certified cheque or covered and unconditioned bank guarantee paid as requested and issued by an untroubled Bank accredited by Central Bank of Iraq (CBI) to the order of SCAS indicated to tender title and number. The foreign companies may submit covered and unconditioned bank guarantee paid as requested by one of Foreign Banks or their branches accredited in Iraq or have a contact with the foreign bank to issue L/G against the preliminary deposits to one of Iraqi Bank accredited by CBI attached with copy of counter-L/G notification in his bid. The L/G be valid for twenty eight (28) days from bid expiry date.
8-Prior submitting preliminary deposits, the bidder inquiries about the untroubled Banks licensed & accredited by CBI through contacting the Relation Section.
9-The Bid shall be valid for ninety (90) days from tender closing date on 1st of August, 2017.
10-The advertisement charges shall be on account of successful bidder.
11-Bids be delivered to the Relation Section at SCAS headquarters as specified location in deadlineon 1st of August, 2017at 11:00 a. m. Baghdad local time. Late bids will be rejected.
12-Conference be held at SCAS headquarters to answer bidder's inquiries on 23rd of July, 2017 at 10:00 a.m. Baghdad local time.
13-Bids be opened at MOA headquarters/ Republic of Iraq/ Baghdad/ Al Andulus square/ near Al Sadeer Hotel 1st of August, 2017 at 12:00 midday.
14-If the closing and opening dates are a holiday, they will be a day after.
15-Our company is not obligated to accept the lowest prices.

A. General
1Scope of Bid
1.1The Purchaser indicated in the Bidding Data Sheet (BDS), issues these Bidding Documents for the supply of Goods and Related Services incidental thereto as specified in Section VI, Schedule of Requirements. The name and identification number of this General Competitive Bidding (GCB) procurement are specified in the BDS. The name, identification, and number of lots of are provided in the BDS.
1.2Throughout these Bidding Documents:
(a)the term “in writing” means communicated in written form (e.g. by mail, e-mail, fax, telex) with proof of receipt;
(b)if the context so requires, “singular” means “plural” and vice versa; and
(c)“day” means calendar day
2Source of Funds
2.1The source of fund for this project is allocated through the federal budget of the Government of Iraq (GOI). The name of the project and its number is as stated in BDS .
3Fraud and Corruption
3.1The purchaser requires that bidders, suppliers, contractors, and consultants, observe the highest standard of ethics during the procurement and execution of such contracts. In pursuit of this policy, the purchaser:
(a)defines, for the purposes of this provision, the terms set forth below as follows:
(i)“corrupt practice” means the offering, giving, receiving, or soliciting, directly or indirectly, of anything of value to influence the action of a public official in the procurement process or in contract execution;
(ii)“fraudulent practice” means a misrepresentation or omission of facts in order to influence a procurement process or the execution of a contract;
(iii)“collusive practice” means a scheme or arrangement between two or more bidders, with or without the knowledge of the purchaser, designed to establish bid prices at artificial, noncompetitive levels; and
(iv)“coercive practice” means harming or threatening to harm, directly or indirectly, persons or their property to influence their participation in the procurement process or affect the execution of a contract;
(v)“obstructive practice” is
(aa)deliberately destroying, falsifying, altering, or concealing of evidence material to the investigation or making false statements to the investigators in order to materially impede a Bank investigation into allegations of a corrupt fraudulent, coercive or collusive practice; and/or threatening, harassing or intimidating any party to prevent it from disclosing its knowledge of matters relevant to the investigation or from pursuing the investigation; or
(bb)acts intended to materially impede the exercise of the purchaser’s inspection and audit rights provided for under sub-clause 3.1(d) below.
(b)will reject a proposal for award if it determines that the Bidder recommended for award has, directly or through an agent, engaged in corrupt, fraudulent, collusive or coercive practices in competing for the Contract in question;
(c)will sanction a firm or individual, including declaring them ineligible, either indefinitely or for a stated period of time, to be awarded a contract, if it at any time determines that they have, directly or through an agent, engaged, in corrupt, fraudulent, collusive or coercive practices in competing for, or in executing, a purchaser financed contract; and
(d)will have the right to require that a provision be included in Bidding Documents and in contracts financed by the purchaser, requiring bidders, suppliers, contractors and consultants to permit the purchaser to inspect their accounts and records and other documents relating to the Bid submission and contract performance and to have them audited by auditors appointed by the purchaser.
3.2Furthermore, Bidders shall be aware of the provision stated in Sub-Clause 35.a (iii) of the General Conditions of Contract.
4Eligible Bidders
4.1 A Bidder, and all parties constituting the Bidder, may have the nationality of any country, subject to the restrictions specified in Section V, Eligible Countries. A Bidder shall be deemed to have the nationality of a country if the Bidder is a citizen or is constituted, incorporated, or registered and operates in conformity with the provisions of the laws of that country.This criterion shall also apply to the determination of the nationality of proposed subcontractors or suppliers for any part of the Contract including Related Services.
4.2A Bidder shall not have a conflict of interest. All bidders found to have conflict of interest shall be disqualified. Bidders may be considered to have a conflict of interest with one or more parties in this bidding process, if they:
(a)are or have been associated in the past, with a firm or any of its affiliates which have been engaged by the Purchaser to provide consulting services for the preparation of the design, specifications, and other documents to be used for the procurement of the goods to be purchased under these Bidding Documents; or
(b)submit more than one bid in this bidding process, except for alternative offers permitted under ITB Clause 13. However, this does not limit the participation of subcontractors in more than one bid;
4.3A Bidder that is under a declaration of ineligibility by the purchaser in accordance with ITB Clause 3, at the date of contract award, shall be disqualified. The list of debarred firms is available at the electronic address of the purchaser specified in the BDS. Similarly, a Bidder that is under a declaration of ineligibility, suspension or debarment by the legal department of the Ministry of Planning and Development Cooperation at the time of contract award, shall be disqualified.
4.4Government-owned enterprises of Iraq shall be eligible only if they can establish that they:
(a)are legally and financially autonomous,
(b)operate under commercial law, and
4.5Bidders shall provide such evidence of their continued eligibility satisfactory to the Purchaser, as the Purchaser shall reasonably request.
5Eligible Goods and Related Services
5.1 All the Goods and Related Services to be supplied under the Contract and financed by the purchaser by eligible countries.
5.2For purposes of this Clause, the term “goods” includes commodities, raw material, machinery, equipment, and industrial plants; and “related services” includes services such as insurance, installation, training, and initial maintenance.
5.3The term “origin” means the country where the goods have been mined, grown, cultivated, produced, manufactured or processed; or, through manufacture, processing, or assembly, another commercially recognized article results that differs substantially in its basic characteristics from its components.
