Confirm the outcome of the Appeal against termination

I am writing to you following the Appeal Hearing held on (date) in order to confirm the decision of the panel.

After careful consideration of the issues put forward by all parties at the Appeal Hearing,the panel’s decision is as follows.

Upholdoption

Your Appeal has been upheld and the decision to dismiss you on grounds of capability due to your absence levels has been revoked. However, the Appeal Panel decided that in this case it was appropriate to apply a lesser sanction. Therefore, under the Attendance Management Policyyou would be issued with a Final Notification from the date of the Appeal Hearing decision. Please take this letter as the final notification.

During this period you will be required to meet monthly with your manager and your attendance will be supported and monitored for improvements. In order to assist you, a plan of action and support will continue to be implemented, as discussed at the Appeal Hearing. You will meet with your manager shortly to agree a plan.

I would remind you that there is a need for your attendance level to improve significantly and where this does not take place your employment will be seriously at risk. Failure to make improvements in your attendance is likely to result in your dismissal.

Your appeal is not upheld and the decision to dismiss you for reason of capability still stands. As previously notified to you in the letter of(date) you are dismissed by reason of capability due to your level of sickness absence under the Attendance Management Policy of North Yorkshire County Council and your final date of employment will be (date).
