Minutes of the Council Meeting held on Thursday 2 February 2017 in Porthallow Village Hall at 7.00pm.
The following Councillors were present:-

1. To accept apologies for absence
Apologies for absence were received from Cllrs W Frisken and R Combe.
2. Members to declare disclosable pecuniary and prejudicial interests (including details thereof) in respect of any item on this agenda and any dispensations thereon previously granted or requested now
There were no declarations.
3. To receive Cornwall Cllr Walter Sanger’s report.
Cwll Cllr Jim McKenna had been elected new chairman of Royal Cornwall Hospitals Trust (RCHT) and would be leaving Cornwall Council. As a Cornwall Council election was due in 3 months time 2 existing Cwll Cllrs – Jeremy Rowe and Andrew Wallis would cover his Cornwall Council work in the interim. A decision on the electoral review into the future number of Cwll Cllrs had been deferred to February 6th. The Community Infrastructure Levy (CIL) amount to pay on developments was currently being consulted on. There would be a fixed rate per m2. The Cornwall Council Off-Street Parking Order consultation was complete. There was huge furore from Cwll Cllrs as charges in all car parks would go up. The free parking period, such as in Helston would be reduced to commence 11pm instead of the present 4pm. It had been suspended for now – a tactical back down. Job Centres and libraries were joining forces in the County; this included Helston where the Job Centre would move into the library. The One Stop Shop currently in Isaac House would also be moving to the library. A member asked about the contribution from Cornwall Council towards clearing up after the travelers in N Corner car park. There had been no reply yet, but no refusal either. In the essence of fairness Cornwall Cllr Walter Sanger had requested that the offer made by Cornwall Council be switched to St Keverne Parish Council paying a maximum of £500, rather than Cornwall Council. Cormac had been advised that the stones at Traboe Cross could be moved now. However it had to find the money to move them. The Chairman enquired whether the ROMPs that was renewed for Dean Quarry last October would have to be renewed again this October. It did not; as the quarry had ‘proved’ that it was carrying out quarrying last year and was now live as ‘substantial’ quarrying had taken place. The enforcement on camping, etc at Tregaminion did not expire until 20th March.
4. Public Question Time
A member of the public started by questioning whether the CIL applied to agricultural development. Cornwall Cllr Walter Sanger stated that it applied to domestic and non domestic but he did not know about agriculture.
The Vice-chairman of CADS spoke about the retrospective planning application for the fence at Dean Quarry. The group questioned why it was ever erected 15 months earlier, when the judicial review quashed the planning permission for it. CADS felt it an eyesore, unnecessary and urged members to reject it. It was also not serving its purpose as it was not providing security. Cornwall Cllr Walter Sanger stated that a fence was not needed to operate a quarry.
The owner of a private helicopter at Tregarne was present and stated he only used it 2/3 times a month for personal use.
5. To confirm the minutes of the previous meeting
It was RESOLVED that the Chairman sign the minutes of the previous meeting as a true and correct record.
6. To receive the following pre-planning applications
There were no pre-planning applications.
7. To receive the following planning applications
a) PA16/11638 Alterations and extensions of existing annex to form two storey music room and annex space and single storey garden storage shed, Silvermere, North Corner, Coverack, Mr C Hutchinson
No objections had been received and it was RESOLVED to support the application.
b) PA16/11992 Proposed Recreational Building, land at Roskorwell Barns, Roskorwell, Mr John Slade
The Chairman had received 2 verbal complaints plus a letter from a neighbour. The friendly link planning officer felt it was too far from the existing holiday complex. There was the possibility to extend the existing games room instead and there was also a nearby barn that was only being used for storage. It was RESOLVED to recommend refusal of the application on the grounds of siting.
c) PA16/12108 Proposed agricultural workers dwelling, land At Trelaminney, Trelaminney, St Martin, Mr R & Mrs E Williams
Council had supported this before and this time the dwelling was slightly smaller. It was RESOLVED to support the application.
d) PA17/00257 Retrospective application for the installation of two sections of metal chain link fencing approximately 2m high. Section 1 of the fence is approximately 130m in length with a gate at the site entrance. Section 2 is a further 570m length of fence at the seaward end of the site with gate access for the existing jetty, Dean Quarry, Shire Oak Quarries
There had now been a judicial review on this matter. One member felt it was ‘salami slicing’ planning. Cornwall Cllr Walter Sanger offered help by saying that retrospective should be considered as if it was not there at all. Another member noted that the whole quarry was in Cornwall AONB and in an AONB any planning should act to conserve and enhance the AONB. Porthoustock quarry did not have a fence and was operational. It was RESOLVED not to support the application on the grounds that it did not conserve and enhance the AONB.
e) PA16/11924 Demolition of bungalow and erection of two storey replacement dwelling, Chy An Brea, Chymbloth Way, Coverack, Mr & Mrs K Ray
Several residents were concerned about the proposed height of this dwelling. A member noted that this was becoming a familiar story in Coverack and it was gradually turning into a different place. Another member stated that Council did not hold site meetings – it would be fairer to people if it did. Cwll Cllr Walter Sanger added that some councils did have planning committees that went out on site meetings. It was agreed to put this on the next agenda for discussion. It was RESOLVED to recommend refusal of the application on the grounds of height and mass.
f) PA17/00647 Application for approval of reserved matters of appearance, landscaping, layout and scale for erection of dwelling (following outline approval PA16/03726 dated 05.07.16), Land adj 16 Tregonning Parc, St Keverne, Mr David Tonkin
Members were concerned about the possible height of this proposal, although it was for a single-storey dwelling. Cwll Cllr Walter Sanger stated that it would have to be well dug into the ground to keep it down. It was RESOLVED to support the application whilst requesting that the roof level be kept the same as surrounding properties.

9. Tregarne Mill barn conversion
The Chairman understood that one could build 1/3 more onto a barn conversion but this one seemed more than that. Cornwall Cllr Walter Sanger had taken photos and sent them to Forward Planning Officer Mark Broomhead who would check to see if it had been built according to the plans. He added that there was only 1 internal wall remaining and that would come down. Originally it was stated not to be a flood risk and could re-build as is. Meanwhile the agent stated; I can confirm that Tregarne Mill is only a single storey barn, but after having a flood risk assessment done, we had to raise the floor level so much to comply with the EA requirements, that the walls had to be slightly extended up as well. I think this may given the impression of a two storey barn, but I can honestly say that it will be only a one floor level. It was noted.
10. Excavations at Trewoon, Tregidden
A new entrance had been created into the field Tregidden side of Trewoon farm lane. A large area had been excavated out flat with an earth bund wall created around the sides. The Clerk advised that St Martin Parish Council had already raised the issue and an enforcement form had been submitted to Planning. It was noted.

12. To receive update on the clearance of N Corner car park
The car park was now totally cleared. Some of Coverack Christmas lights erection team had offered to help clear up. A site meeting would be arranged to decide on what needed to be done next.
13. To consider requesting Fire Brigade and Surgery to place their defibrillators on the outside of their buildings and Parish Council paying for cabinets and installation
This followed the unfortunate recent incident where a person with a heart attack was taken to the surgery on a Saturday when it was closed. By the time the Parish Council defibrillator was accessed it was too late. It was agreed to write to both the surgery and the fire brigade. Signage also needed addressing.
14. To receive update on the possibilities of a parish tree planting scheme from Cllr R Richards
Cllr R Richards had obtained information from a Grade Ruan Cllr on the scheme they had in place. They did not place trees near any buildings. They put £500/year towards it in their precept, obtained trees and volunteers planted them. They used them to screen planning application sites, etc. A member felt they needed to be careful – consult landowners, neighbours, etc. Cllr R Richards would bring forward more information at the next meeting so it would be put on the next agenda. Cllr R Richards now left the meeting at 7.50pm.
15. To consider dates for holding a ceremony for refurbishment of cannon
It was agreed to try for Easter Saturday and the Clerk would check whether there were any weddings booked in the church for that day. A firing might be possible, other ideas were requested. It would be placed on the next agenda.
16. Meeting re producing a joint Lizard-wide Neighbourhood Plan Wed 8th Feb 6pm Cury Hall
The Chairman, Cllr Mrs S Lyne and the Clerk would be attending.
17. To discuss possibility of moving chapel organ into church
The vicar had written to the Clerk stating the PCC had decided it did not want the organ. The Methodists were pleased it might be moved to the church. The Chairman stated the church had decided for the parish and this was not right. It was RESOLVED that Council carry on investigating the costs of moving (possibly £30k) and in the meantime ask for pledges of support.
18. Correspondence
a) Letter from Tregarne resident re helipad at former Rosebank
Council did not know what it was supposed to do. It was affecting the road (suddenly taking off just over the hedge from road where walkers/horse riders were going along). Did it need planning? How many flights were allowed? It was agreed to write back stating that maybe Council was not the correct place to write to as it was not in its remit and that maybe it was a Highways matter. When asked by the Chairman the owner stated he did not have a heliport and was not planning commercial flights. He quoted that large manorial estates which were registered helipads were allowed up to 28 movements in 12 months in a field or garden. He did not fly over Tregarne; he went out over the sea. He would be willing to speak to the concerned residents.

c) Cornwall Local Plan
This document, which had been consulted on many times, was now finally published and available in hard copy or online. This would now take preference over the National Planning Policy Framework (NPPF), which developers had been using to get large developments approved in Cornwall, and should be referred to in any comments made on planning applications in future. It was noted.
