Summary:

The Special Construction Counsel (“SCC”) will work collaterally with the SVP General Counsel and also independently to provide legal counsel to MTACC program managers, procurement personnel, senior management and other project participants in support of major infrastructure construction projects that involve tunneling, heavy civil and railroad construction and systems work. This includes contract formation for design, construction and construction management and commercial contracts, and other transactional matters. The SCC will also provide legal guidance to the Procurement Department in connection with contract changes and change procedures. In addition, the SCC will be responsible for making recommendations to the program managers regarding settlement of disputes and will provide legal guidance to agency department heads ensuring agency compliance with the relevant laws, codes, regulations, guidelines and policies. The SCC will work with other MTA agencies, public agencies/authorities and private entities to advance and complete MTA Capital Construction projects.

Responsibilities:

Works with procurement personnel and design managers to determine most advantageous procurement methods.

Drafts design and construction contracts to ensure that the agency goals and objectives for the contract procurement are achieved with minimal risk to the agency. Participates in negotiations.

Advises senior management of potential contract and other construction risks and drafts contract language and other documents to mitigate such risks.

Investigates and provides legal analysis and advice with regard to construction claims and design errors and omissions claims and recommends resolution strategies.

Manages contract claims and disputes.

Retains and monitors outside counsel.

Provides training for project and agency staff on the issue of contract interpretation, agency contract management processes and other incidental matters.

Ensures compliance with applicable law, codes, regulations, guidelines and policies.

Interfaces with other MTA agencies, public agencies/authorities and private entities to advance and complete MTA Capital Construction projects.

Analyzes legislation and contributes comments to be forwarded to state and federal governments.

Work with MTA Risk Management to ensure project design and construction risks are adequately managed by proper indemnity and insurance requirements.

Review staff summaries and other MTACC agency legal documents prepared by procurement personnel.

Supervises assistant general counsel and other contract employees.

Qualifications:

Continuing education in construction law and negotiation skills useful.

Education and Experience

Law Degree and admission to New York State bar.

BS in engineering or related field preferred.

Minimum of 10 years construction law experience, technical knowledge of heavy construction design and engineering.

As an employee of MTA Capital Construction, you may be required to complete an annual financial disclosure statement with the State of New York if your position earns more than $91,821 per year or if the position is designated as a policy maker.
