Special Called Council Meeting – August 9, 2012

Mayor Thomas L. Hardesty called the special called council meeting to order at 6:30 p.m. with the following council members present: Alan Matthews, Mike Zoeller, Donna Eaton, Shane Suttor, Jon Swindler, and Frank Page.

City Employees Present: Barry Edington, Darrell Willard, Willard Tucker, Danny Goodwin, and Wendy Rutledge.

City Attorney: Steven Gregory

Councilmember Eaton gave the invocation.

All present pledged allegiance to the flag.

Minutes/ July 19, 2012

Councilmember Matthews moved to approve the minutes of July 19, 2012 as read by councilmembers prior to the meeting. Seconded by Councilmember Page.

All voted “aye” and motion carried.

Presentation

Nathan Riggs introduced the Code Enforcement board members: Pamela Larkin, Ann Morris, Lisa Hood, Wayne Anderson, Darrell Willard, and Barry Edington before the presentation began.

The board members came before the council to ask for backing in proceeding with foreclosures and repeat offenders (landlords) who fail to bring their properties up to code. Steven Gregory, City Attorney, recommended the current ordinance be expanded to give the board more authority to condemn said properties. The board currently has $131,000 in liens filed from overgrown grass to garbage/trash.

The Mayor recommended that the city attorney meet with Darrell Willard, Barry Edington, and Nathan Riggs to review the Code Enforcement Ordinance.

Bid Approval – Police Department Vehicles

The city received a bid from O’Brien Ford in Shelbyville of $17,987.19 for the 2013 Ford Fusions being purchased.

Councilmember Swindler made a motion to approve the bid. Seconded by Councilmember Eaton.

All voted “aye” and motion carried.

Ordinance No. 2012-08-16 – An Ordinance of the City of Shelbyville Levying Annual Assessment for the Clear Creek Subdivision Public Improvement Bonds – 1st Reading – Steven Gregory, City Attorney

Steven Gregory, City Attorney, read an ordinance levying the annual assessment for the Clear Creek Subdivision Public Improvement Bonds. The amount per lot for 2013 is $1,639.61.

It was introduced for first reading by Councilmember Zoeller. Seconded by Councilmember Suttor.

Appointment – George Best to City Tree Board to complete the unexpired term of Donald Cubert, Sr. to January 1, 2014.

Mayor Hardesty recommended George Best to complete the unexpired term of Donald Cubert, Sr. to the City Tree Board until January 1, 2014.

Councilmember Matthews moved to approve the appointment. Seconded by Councilmember Swindler.

All voted “aye” and motion carried.

Appointment – Dr. Ron Creque to the Joint City/County Recreational Board to complete the unexpired term of Donald Cubert, Sr. to December 31, 2013.

Mayor Hardesty recommended Dr. Ron Creque to the Joint City/County Recreational Board to complete the unexpired term of Donald Cubert, Sr. until December 31, 2013.

Councilmember Page moved to approve the motion. Councilmember Suttor seconded.

Proclamations

Mayor read two proclamations. Recognizing Donald Cubert, Sr. for faithful and distinguished service and Win the War Against Violence 2012 Ten Percent Challenge Week, August 13-17, 2012.

Department Reports

Major Danny Goodwin reported the horse show successful with very few incidents. Officer Kovacs and Officer Aikins passed the Sergeant’s test. Police Department responded to 1,065 dispatch calls for service in July and 6,663 for the year.

Chief Tucker reported Raymond Williams retired from the Fire Department with 25 years of service. The Firefighter for a Day program was a success. Chief Tucker met with Senator Hornback to discuss the Pension Reform Taskforce.

Mayor’s Report

Mayor pointed out the diligent work from the Police and Fire Departments during the horseshow, a wonderful job. Fish Fry at Lake Shelby on August 18, 2012. Street Party Concerts on Main Street will be on August 24th and 25th.

Council Reports

Councilmember Donna Eaton stated she advised residents, who have complaints regarding fireworks, to call dispatch.

Councilmember Page moved to adjourn at 7:40 p.m. Seconded by Councilmember Swindler.
