SC201/95COMMUNITY CENTRE, JENOLAN WAY, MERRIWA [89016]
Council resolved at its meeting on 7 December 1994 (I91233) to seek the approval of the Minister for Local Government to pre funding electrical infrastructure for the Jenolan Way Community Centre up to $70,000.00. This was conditional on a legal agreement with the Smith Corporation to refund the pre payment and a caveat being placed on the Corporation's land.
The Smith Corporation has sold all land in the subdivision in which the proposed Community Centre is located, therefore, the Corporation is not in a position to grant authority for a caveat. The Minister has approved the proposal based on the arrangement that Council hold a caveat over the Corporation's land.
To advance the objective and obtain power to the Community Centre by pre funding of $21,664.30 a formal agreement has been prepared by Council Solicitors to secure Council interest. Appendix I refers.
MOVED Cr Dammers, SECONDED Cr Gilmore that Council:
1rescinds its resolution I91233 of 7 December 1994, viz:
"that Council authorises, under Section 547(12) of the Local Government Act, prefunding approximately $70,000, being part funding of the SECWA substation site in Deepwater Circuit, Merriwa subject to:

2legal agreement (to include caveat on part of the land) as an undertaking with Smith Corporation to refund this prefunding to the City of Wanneroo by 30 June 1995;
3sets aside its Policy A202 in this instance to allow its resolution to be communicated before 3.00 pm on Friday, 9December 1994";
