SOUTH NYACK BOARD OF TRUSTEES

At 7:30 pm, following the Pledge of Allegiance, Mayor Christian called the regular meeting to order.

OPEN SESSION:

Greg Mitchel of Townsend Avenue, Upper Grandview commented about the vibrations felt at his hillside home and spoke of the loud pile driving sounds and asked what the village is going to do about it. He said that he was offered new windows to help block sounds.

Hope Cameron spoke of heavy vibrations felt inside her home and her calls to Carla Julian.

Dee O’Hagen questioned why the ginko tree on White Avenue was removed and asked when it would be replaced. She said that before a tree is taken down there should be a plan for its replacement. Trustee Leinbach replied that the female ginko’s fruit that falls to the ground presents a danger to pedestrian. Ms. O’Hagen was invited to attend a meeting of the Tree Committee.

John Cameron expressed concern that NYS defends TZ Constructors, which has the appearance that the state is not on the side of the taxpayers.

SOUTH NYACK TASK FORCE: Task Force Chairperson Jerry Ilowite summarized the activities of this group and their work over the past few months, particularly regarding noise and the enforcement of noise limits. He spoke of the meeting in July with the compliance teams of TZ Constructors and the NYS Thruway where the method of measurement was questioned. Raw data was requested, but when not received, the village hired sound consultant Brook Crossan and sound monitors were set up. Trustee Goodwillie thanked the engineers from Bruel & Kjaer who for their sound monitors. Mr. Ilowite said that the goal is to gain confirmation that the TZ Constructors work is in compliance with their contract with NY State.

MINUTES: Upon motion made by Trustee Neff, seconded by Trustee Leinbach, the minutes of the regular meeting of July 22, 2014 were approved with Trustee Goodwillie abstaining as he was absent from that meeting.

REPORTS:

POLICE: Chief Newbury reviewed the June report showing $102.89 received in fees. He spoke of the successful South Nyack 10 Mile Run and of the upcoming film shoot in and around the Franklin Street Park.

D.P.W.: Mr. Johnson submitted and reviewed the July and August reports.

JUSTICE COURT: August receipts totaled $116,436.00.

BUILDING/CODE/FIRE INSPECTOR: July report submitted showing receipts of $1,776.50. The submitted August report showed $551.36 received.

OLD BUSINESS:

SALISBURY PLACE: The Village Engineer will be asked for a plan and the estimated cost of work needed for the long term solution to the drainage problem there.

STREET LIGHTS: Trustee Goodwillie spoke of Orange & Rockland’s web based program for street light issues through their Municipality Portal. DPW Superintendent Johnson has attended a class regarding this and will be the administrator of the village’s account.

FRANKLIN STREET FOOD WASTE: There was discussion regarding a solution to the food waste and trash in the parking area and the verge at 88-94 South Franklin Street.

VILLAGE TREES: No report submitted.

NEW BUSINESS…..

TZ BRIDGE UPDATE: No date yet set by the NYS Thruway for the next Community Meeting. There was discussion of TZ Constructors’ delivery vehicles entering South Nyack without prior notice.

BLOCK PARTY REQUEST: Trustee Neff moved as follows:

#57 RESOLVED, to approve the request of resident Joanne Mongelli to close Mansfield Avenue for a Block Party on Saturday, September 13, 2014 between the hours of 3 and 10 pm and to suspend the Open Container Law at that location during that time.

The resolution was seconded by Trustee Goodwillie and unanimously adopted.

ROCKLAND RIVERFRONT COMMUNITY COUNCIL: Trustee Goodwillie represented South Nyack at their recent meeting and spoke of the items covered and of South Nyack’s grant request for improvement to the Esposito Trail.

ELECTRONIC WASTE: Saturday, October 25th, from 11am to1pm was chosen as the date and time for residents to take their electronic waste and used appliances to the DPW for disposal.

VILLAGE NEWSLETTER: Trustee McCue will meet with the Village Clerks regarding the upcoming village newsletter. Articles to be included were suggested.

OTHER:

--Following discussion of services received from sound engineer Brook Crossan, Trustee Goodwillie moved as follows:

#58 RESOLVED, to approve 18 to 22 additional hours of consulting work from Brook Crossan of Sandstone Environmental Associates, Inc.at a rate of $180 per hour.

The resolution was seconded by Trustee Neff and unanimously adopted.

--Review of a letter from Attorney J. David MacCartney regarding Land Use Rights.

--Discussion of Bruce Forrest’s email expressing concerns for the planned observation deck in Nyack’s Memorial Park, including traffic and parking burdens on South Nyack streets and privacy issues.

--Possible solar panels for the fire house and the DPW building

--The historical importance of the wall map in the Board Room and the need for its protection and possible digital reproduction. Trustee Goodwillie is researching grants to cover this expense.

--Trustee McCue spoke of meetings regarding the Thruway trestle between the north span of the new bridge and Salisbury Point and her concern that there has been no response to Congresswoman Lowey’s letter requesting clarification on matters discussed.

PAYMENT OF ABSTRACTS: Upon motion made by Trustee Neff seconded by Trustee McCue and carried, the following abstracts of audited vouchers were approved for payment:
