The SC Personhood Bill has not been passed out of the Constitutional Laws Subcommittee, chaired by REPUBLICAN Representative Greg Delleney (R-Chester, SC), since the 2005-2006 Session. In 2005, the SC Personhood bill passed the Constitutional Laws Subcommittee, and

then it passed the full Judiciary Committee (REPUBLICAN Chairman Jim Harrison (R-Columbia, SC), with no amendments. Then the bill passed the full SC House, but not before it was amended with a fatal flaw amendment on the House floor. Since then, in 2007, 2008, and 2009, the House version of the SC Personhood bill has been held captive in REPUBLICAN Rep. Greg Delleney's Constitutional Laws Subcommittee.

"Accordingly, it is our opinion that the Right to Life Act is constitutional."

The Right to Life Act of South Carolina (South Carolina Personhood Bill) is constitutional on its face,

however if applied to "abortion," would need to be adjudicated (tried in court). [ As Mississippi Lt. Governor Phil Bryant (R) said about the Mississippi Personhood Constitutional Amendment he is endorsing, it is a foregone conclusion that personhood legislation would face a legal challenge in court. ]
