Article One

Headline:Controversial Ontario Adoption Law Quashed

Summary:

Two days after it went into effect, Ontario Superior Court Judge Edward Belobaba has struck down a new Ontario statute that allowed the opening of past adoption records. He ruled that the “Adoption Information Disclosure Act” would lead to the violation of privacy rights for birth parents who gave up their children for adoption years ago.

Toronto lawyers Clayton Ruby launched a constitutional challenge to the law on behalf of four Ontario residents – three adoptees and one who gave up a child for adoption.

The government is being urged to amend the law to allow people to block access to birth registration if they wish.

Analysis:

Source:This article touches all three sources of law since it includes a statute passed by the Ontario government and the application of the constitution by a judge who is, then, forming case law through his precedent setting decision to strike down the statute.

Category:This article is connected to Substantive Law as it relates to Public Law and its constitutional branch (the judge had to consider the constitutional legality of the new adoption statute)
