SIMONTON FARMS Puppy Guarantee:

This guarantee is issued to: ______here-in-after known as 'buyer' for the puppy described thus: breed______; sex___; color ______; registry & litter number______;

dam & sire______; D.O.B______; by: ______herein after known as 'seller' effective from this day forth: ____month:_____ in the year: 20___.

Buyer, by signing this document, agrees to be bound to, and by, the terms and limitations here-in-after stated, and specifically understands that this guarantee limits the amount of compensation buyer may be entitled to, to no more than the amount promised in this guarantee, as described by the following terms and conditions; and buyer specifically agrees that this guarantee shall never entitle buyer to more than the refund of the puppy purchase price of $ ______. WE DO NOT PAY VET BILLS.

TERMS and CONDITIONS:

For a time period of three weeks following the purchase date of this puppy, buyer may return the living dog, unconditionally, and receive the purchase price back, minus $200.00 (two hundred dollars handling costs), unless other wise stated hereinafter in writing.
Due to obvious constraints pertaining to international and continental shipping our guarantee does not include return shipping costs. The buyer is responsible for all shipping costs.

This puppy is guaranteed not to die of “puppy-hood” diseases, such as: Parvo virus, Distemper, etc... AS LONG AS buyer follows the following vaccination schedule: next puppy shot due 2 weeks after the date of original health certification exam (which is included with puppy purchase), rabies shot due at 4 months of age. Buyer is responsible to vaccinate this puppy for puppy-hood diseases according to schedule, and failure to do so negates this guarantee. For a period of 12 months this puppy is guaranteed to be free of genetic defects which radically impair normal function, such as but not limited to: hip displacement, 'patella' or heart problems of grade 3 or greater, etc... This does not include genetic conditions that do not impair normal function of the dog. (We do not guarantee characteristics inherent to the specific breed, such as pinched nostrils, narrowed airways, excessive wrinkling, etc., as in Pekingese and Pugs.)

This puppy is not warranted to be completely free of common parasites, such as, but not limited to: worms, fleas, ticks, ear mites, or minor fungal, bacterial, or protozoan infections, etc., nor is the puppy warranted against developing allergies, or dermatitis conditions.

This puppy is being sold to Buyer as a pet. No guarantee is given as to its show quality, size at maturity, or to its suitability in a future breeding program.
This puppy’s registration application paper will be provided within one year of issuance of puppy guarantee.

This puppy is not warranted against accidental death after delivery to the buyer.
Necropsy is required as proof of death due to a genetic defect.

It is agreed between buyer and seller that buyer becomes completely and fully responsible for any and all charges, of any kind, including, but not limited to, Veterinary charges, incurred pertaining to the puppy, after buyer purchases the puppy.
It is agreed between buyer and seller that buyer becomes responsible for the purchase and administering of NuVet Vitamins until the puppy is one year ofage(please retain proof of purchase).

Furthermore, buyer, in consideration of being able to purchase the above described puppy according to this specific limited guarantee, agrees to indemnify and hold harmless, seller, seller's business associates, seller's family and heirs, for anything of any nature not specifically, covered by the terms of this guarantee.

I, the buyer, have read and I agree to be bound to and limited by the terms and conditions of this guarantee. I, the seller, agree to honor the terms of this guarantee. In token of which we affix our signatures to this document:
