We, the undersigned, on our behalf and on behalf of the Merchant, request you to ship cargo in our Shipper owned/operated Container(s) (SoC) with the technical details as per page 2 for booking no:Click here to enter text.
We hereby indemnify MACS Maritime Carrier Shipping GmbH & Co as carrier, its agents or subcontractors and the vessel as follows, and the following is herewith understood and confirmed.
A)The SoC has undergone inspection and subsequent controls in compliance with The International Convention for Safe Container (CSC)
A.a)☐ The validity of the CSC for each container will exceed 3 (three) month at the time of delivery at the place of receipt.

A.b)☐ The SoC is operated under an Approved Continuous Examination Program (ACEP).
[If the exporter is not the owner of the container(s) and the container(s) are operated under an ACEP system of the owner the exporter must provide his own ACEP certificate or has to comply with clause A.a.]
B) We also confirm that:
a)The compliance with the rules established by the International Tank Container Organization (ITCO) in case tank containers are provided
b)The container(s) comply with ISO standards such as but not limited to handling, securing and stacking abilities
C)We hereby indemnify the carrier, its agents and subcontractors against any loss or damage which may ariseincluding but not limited to any claims, damages to vessel or other third party property, loss of life/personal injury, fines or tax penalties due to any non-compliance with CSC, ISO or TIR standards or by any structural deficiency of the container or contents thereof including but not limited to latent defect as well as false and/or incorrectly completion of this Shippers Own Container Form.
D)In the case of shippers owned reefer/tank container we further acknowledge that bothneither you nor your agents nor sub-contractors are in any way responsible for the technical condition of the container and/or machinery, and we confirm that the correct functioning of the machinery itself as well as correct setting will fall under our exclusive responsibility. The carrier may attempt to, but not be obliged to, carry out repairs at our risk and expenses and carrier will be indemnified and held harmless by us from any liability or damage to cargo arising from repairs.
E)It is herewith agreed that the SoC is treated as part of the cargo description in the relevant Bill of Lading. If any loss or damage occurred to the SoC any liability of the carrier will be subject to the same defenses, exemptions, exclusions and limitations of liability as applicable to the cargo as per the terms of the Bill of Lading.
F)This Shippers Own Container Request Form shall be considered to be part of the shipping contract. The law and jurisdiction applicable to this Request shall follow the law and jurisdiction applicable to the respective Bill of Lading.
