SPECIAL TRAFFIC LAW ENFORCEMENT DEPUTY

TRAFFIC LAW ENFORCEMENT UNIT

The ______County Public Works Department agrees to fund one(?) Special Traffic Law Enforcement Deputy with County Road Funds, and to fund a portion of the Traffic Law Enforcement Unit subject to annual budgetary approval by the ______County Commissioners. Said funding is subject to the terms and conditions outlined below:

TERMS AND CONDITIONS

1.  FUNDING –

a)  The County Road Fund will reimburse the Current Expense Fund all payroll costs incurred monthly and a pro-rata share of the liability insurance premium, and vehicle usage fees for one (1) designated Traffic Law Enforcement Deputy. In addition the County Road Fund will purchase directly, for use by the designated deputy, all relevant Officer’s supplies, and pay all vehicle usage fees for the vehicle used by said Officer. It is agreed and understood that all supplies, equipment, and vehicle purchased directly by the Road Fund shall remain the property of the Road Fund unless reimbursement for its present value is made by the Current Expense Fund.

b)  The County Road Fund will reimburse the Current Expense Fund properly accounted and accrued direct and indirect labor cost, vehicle expenses, and other direct expenses incurred performing Traffic Law Enforcement up to a predetermined annual amount.

2.  TRAFFIC LAW ENFORCEMENT DEPUTY ASSIGNED TO PUBLIC WORKS – It is understood and agreed that the designated Traffic Law Enforcement Deputy shall be an employee of the ______County Sheriff’s Office. However, it is further understood and agreed that the designated deputy shall:

3.  TRAFFIC LAW ENFORCEMENT UNIT –

The planned number of personnel assigned to the traffic unit is __ deputies and these deputies are anticipated to be on duty ____ hours monthly per deputy. The duties and activities of the traffic unit which may qualify for reimbursement are listed in Section II of the ______County Traffic Law Enforcement for County Roads Agreement.

4.  REPORTING AND BILLING REQUIREMENTS –

a)  The Sheriff’s Office shall report to the BOCC and the County Engineer no less than bi-annually in sufficient detail the activities of, statistics, and effects of the Traffic Law Enforcement Unit and program. The County Engineer and the Sheriff’s Office shall meet and mutually determine “sufficient detail”.

b)  The Sheriff’s Office shall bill directly to the County Engineer no more than monthly and no less than quarterly on the attached approved form. Bills for the last month or quarter of the year shall be presented no later than the 10th of January of the following year.

c)  The Sheriff’s Office and the Public Works Department shall periodically exchange updated contact and policy information to promote an effective working relationship.

5.  TERMINATION OF AGREEMENT –

The agreement can be terminated by either party by providing written notice of the intent to terminate. Termination of agreement will occur no less than sixty (60) days after receipt of the notice.
