An Act to make Temporary Provision with respect to the Powers of the Council of the Shire of Shepparton to obtain Allowances by Overdraft of Current Account and for other purposes.

Shepparton Abattoirs Act 1966
Preamble
WHEREAS the Council of the Shire of Shepparton (hereinafter called the Council) has operated an abattoirs since the year 1935:
AND WHEREAS the abattoirs have proved to be inadequate to meet the requirements of the district and the Council has found it necessary to reconstruct and enlarge the abattoirs:
AND WHEREAS the Council has now entered into an agreement to lease the abattoirs subject to the said reconstruction and enlargement to Anderson Meat Industries Limited for a period of seven years with an option of purchase:
AND WHEREAS the cost of the reconstruction and enlargement of the abattoirs is estimated to be $3,000,000 and the Council is not authorized to borrow sufficient money pursuant to the provisions of the Local Government Act 1958 to enable it to defray the cost of such reconstruction and enlargement:
AND WHEREAS it is expedient for the Council to be authorized to obtain additional advances by way of overdraft to enable the construction of the abattoirs to be completed:
BE IT THEREFORE ENACTED by the Queen's Most Excellent Majesty by and with the advice and consent of the Legislative Council and the Legislative Assembly of Victoria in this present Parliament assembled and by the authority of the same as follows (that is to say):
1. Short title

This Act may be cited as the Shepparton Abattoirs Act 1966.
2. Power to Council of the Shire of Shepparton to borrow additional moneys
(1) Notwithstanding anything in the Local Government Act 1958 the Council is hereby authorized and empowered—
(a) on or before the 30th day of June, 1968 to obtain advances from banks by overdraft of the current account of the Shire of Shepparton upon the credit of the said Shire to an amount not exceeding $300,000 more than the amount that the Council is authorized and empowered to obtain pursuant to the provisions of section 436 of the Local Government Act 1958; and
(b) to borrow money pursuant to the powers conferred by section 392 of the Local Government Act 1958 to liquidate any liabilities incurred in respect of any advances by way of overdraft obtained by the Council pursuant to paragraph (a) of this sub-section or borrowed pursuant to section 397 of the Local Government Act 1958 for the purpose of defraying the cost incurred in constructing the abattoirs.
(2) The Council shall repay any advances obtained from banks by overdraft pursuant to the powers conferred by paragraph (a) of sub-section (1) on or before the 30th day of June, 1968.
