Selective Tenders – Select a tenderer panel
This form is to be completed by a NSW Government Agency, NSW State Owned Corporation, NSW Local Government,NSW Tertiary Institution (the Client) when requesting a list of Contractors or Consultants from the Department of Finance, Services and Innovation (DFSI) to be used for selective tenderingon a Contractfor Construction and related works.
MEETING SCHEDULING: A request to conduct a selection is be submitted five (5) full business days prior to the date of the selection meeting. Meetings are generally conducted 2pm Monday afternoon, or Tuesday where the prior Monday is a public holiday. E.g Submit by Close of business Tuesday for a selection on the following Monday. All meetings are subject to confirmation.

Only firms prequalified with the relevant DFSI Scheme for Construction will be considered for selection.
Conditions for Selective Tendering: agreement by the Client
The Client is committed to:
  • the NSW Government Code of Practice for Procurement
  • Proceedto tender andthe award of a contract. Funding has been approved.
  • Not requesting a selective tendering list for a Contractor until the Development Application has been approved.
  • Attend a Tenderer Selection Committee meeting (chaired by DFSI)witharepresentative having authority to decide on firms to be offered an opportunity to tender.
  • Not changing a selection decision once made (unless more than 2 months old).
  • Requesting a new list where a previous list has not been used within 2 months.
  • Consider only firm’s prequalified under the relevant DFSI Scheme for Construction and related works (and for the contract parameters identified by the Client).
  • Not communicatewith any of the prequalified Contractors or Consultants on the list until formally instructed to by DFSI.
  • Have DFSI make first contact with the selected tenderers (known as the offer to treat).Once the tender panel has been confirmed, DFSI will provide the Client with the list to conduct the tender process (generally within 24-72 hours subject to response rate).
  • Make use of the list only for the contract as advised by the Client.
  • Provide DFSI(within 10 business days following the award of the contract), a list of tenderers and the prices tendered; the name of the successful tenderer, the contract price and the date of award of the contract.
  • Provide performance reports to DFSI on the first week of February, May, August and November each year,using the relevant DFSIstandardised template available through the NSW Government Procurement System for Construction web site. A report will also be provided at any time where any single performance criteria was considered to be unsatisfactory and, when the contract is fully completed.
  • The DFSICode of Conduct for the Tender Processwhich is to be signed by all personsthat have access to the list of potential tenderers.
