New Roads and Streetworks Act 1991

Notes for Guidance to Applicants

1)  The person granted a Street Works Licence becomes an Undertaker for the purposes of the New Roads & Streetworks Act 1991 and therefore attracts the relevant duties imposed by the Act and associated secondary legislation and Codes of Practice. The requirements to obtain a Street Works Licence applies to any person or organisation (other than anyone acting under a statutory right) who wishes to place, retain and thereafter inspect, adjust or repair the apparatus.

Those applicants not familiar with the requirements of this legislation are strongly advised to appoint a contractor with the appropriate knowledge and accreditation to help complete the application and conduct the work on their behalf.

2)  The application form must be completed for authorisation to place and retain in the highway and must be submitted to the Highway Authority with:-

a)  1: 2500 plan of the proposed location, depth and size of the relevant apparatus

b)  Details of Public Liability Insurance – this must provide a minimum of £2 million cover and to be maintained from commencement of the work on the highway up to the end of the guarantee period.

Proof of Public Liability may be required.

c)  Payment in advance of £300 (inspection and administration costs)

3)  Applicants should note that special conditions may be imposed:

a) In the interest of road safety

b) To minimise the inconvenience to persons using the street having particular

regard to people with a disability.

d)  For Traffic Sensitive Streets and street with special Engineering Difficulty

(E.g. Bridges) to protect the structure of the street and the integrity of apparatus in

it.

The applicant must strictly adhere to these conditions.


New Roads and Street Works Act 1991

Conditions of Approval

1.  All work within the highway must be carried out in accordance with the Code of Practice for Safety at Street Works and Road Works and the Specification for the Reinstatement of Openings in Highways.

2.  No work may commence until approval is given in writing. Approval given must not be construed as conferring any right for the applicant to make connection to a sewer, drain, cable or other apparatus.

3.  Contact must be made with all other undertakers to ascertain whether their existing or proposed apparatus within the highway is likely to be affected by the works and shall abode by the requirements of any undertaker relating to protection of apparatus. If any damage is caused to such apparatus the undertaker concerned must be notified at once. The expense incurred in repairing any damage caused as a result of the works is your responsibility.

4.  No part of the existing highway drainage system may be disturbed or altered without the written consent of Wakefield MDC. Any drains, pipes or culverts encountered during the works must be adequately protected and supported. Ant damage caused shall be reported immediately.

5.  Any unidentified apparatus located during the works must be reported to Wakefield MDC.

6.  No wall retaining the highway or any structure maintained by Wakefield MDC may be interfered with without written consent. Permission to excavate near other structures not the responsibility of Wakefield MDC must be sought from the appropriate owner of the structure.

7.  The works must be supervised by a person accredited and registered by Scot Vec as required by Section 67 of the New Roads and Street Works Act 1991. Registration number must be provided after signature on application form.

8.  The work must be undertaken by a person accredited as a trained operative and registered by Scot Vec as required by Section 67 of the New Road and Street Works Act 1991. Registration number must be provided after signature on application form.

9.  The applicant will guarantee the reinstatement for the period of two years where depth of cover over the equipment is 1.5 metres or less, greater than 1.5m of depth the guarantee period will be three years.

10.  The cost of the application covers the three inspections required by the New Roads and Street Works Act 1991, if on inspection defects are found this will invoke the issuing of a defect notice and further defect inspections as per the Code of Practice for Inspections. These inspections will be charge for as the Code of Practice at the relevant rate as per the regulations.
