By entering “mX MoshtixPromotion”, you are agreeing to the following terms and conditions:

1.STANDARD TERMS

1.1Information on how to enter forms part of the terms of entry.

2.WHO CAN ENTER?

2.1Subject to clause 2.2entry is open to all residents of New South Wales, Victoria and Queensland.

2.2Directors, Management, Employees and their immediate families of Nationwide News, Queensland Newspapers and the Herald and Weekly Times and their respective related bodies’ corporate, associated agencies and companies are not eligible to enter.

3.HOW TO ENTER

3.1The competition commences at the following dates and times –

SYDNEY – 14:00pm on 10 December 2008 (AEDT) and closes at 11:59PM (AEDT) Friday, 12 December 2008.

MELBOURNE – 14:00pm on Thursday, 11 December 2008 (AEDT) and closes at 11:59PM (AEDT) Saturday, 13 December 2008.

BRISBANE - 14:00pm on Thursday, 4 December 2008 (AEDT) and closes at 11:59PM (AEDT) Saturday, 13 December 2008.

This is called the promotional period in each relevant market.

3.2To enter readers must SMS their details to the number printed within “mX”on the following days –

SYDNEY–10 December 2008

MELBOURNE – 11 December 2008

BRISBANE – 11 December 2008

3.4Entrants (including winners) in the competition may enter as many times as they like. However, only one prize per person is permitted. Prizes are non-transferable.

4.PRIZES

4.1There will be three (3) major prize winners in each market. Each winner will receive one (1)double pass to the following event –

Sydney

2009 Sydney Shakespeare Festival

From January 8th – February 15th

Each session starts 8pm and is held @ Bicentennial Park

Age restrictions: All Ages

Ticket Value: $25 each

Brisbane

Future Music Festival

March 7th @ Brisbane Turf Club

12pm – 10pm

Age restrictions: 18+

Ticket Value: $79 each

Melbourne

Tex Perkins

December 19th @ Ding Dong Lounge

8PM

Age restrictions: 18+

Ticket Value: $25 each

Total prize pool value is $774.00

4.2In participating in the promotion, the winners agree to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed and photographed. The winners agree to grant the Promoter a perpetual and exclusive licence to use such footage and photographs in all media worldwide and the winner (and their companions) will not be entitled to any fee for such use.

4.3The winners agree they will not sell or otherwise provide their story and/or photographs to any media or other organisation.

4.4The prize cannot be transferred and cannot be redeemed for cash.

4.5The winners must, on request by the Promoters, be able to provide evidence which, to the reasonable satisfaction of the Promoters, demonstrates that the winner is an eligible entrant (as per clause 2.1 and2.2) has complied with these Terms and Conditions.

4.6The prizes must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated. If a winner is unable to satisfy these terms and conditions or a prize is not utilised able to be taken as the prize will be forfeited by the winner and cash will not be awarded in lieu.

5HOW TO WIN

5.1Three (3) winners will be randomly selected from all valid entries received in each market. The draw will take place at Dialect Interactive at 190 George Street, Sydney NSW 2000 on the following dates/times –

SYDNEY - Monday, 14 December 2008 at 09:00AM (AEDT)

MELBOURNE – Monday, 14 December 2008 at 09:00AM (AEDT)

BRISBANE - Monday, 14 December 2008 at 09:00AM (AEDT)

5.2The winnerswill be notified by phone.

5.3The Promoters’ decision is final and the Promoter will not enter into correspondence regarding the result.

6.NO LIABILITY

6.1In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any written directions given under the Lottery and Gaming Regulation 1993 (SA).

6.2Nationwide News Pty Ltdtheir associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss or damage, loss of opportunity revenue or profit) arising out of or in connection with this promotion, including transportation to and from or during residency in the property or claim that may occur:

a)during the draw;

b)whilst undertaking any travel won on or connected with their entry into the draw;

c)in the participation in any prize;

d)as a consequence of late, lost or misdirected mail;

e)due to the broadcast of any program relating to the competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person;

g)arising from or related to any problem or technical malfunction of any telephone network or lines or mobile communications network related to or resulting from participation in this promotion.

6.3If for any reason this competition is not capable of running as planned, due to causes including but not limited to tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition.

6.4The Promoter reserves the right to redraw the prize draw in the event of an entrant being unable to satisfy these terms and conditions or not claiming a prize. If any prize remains unclaimed as at 9am (Sydney time) three days prior to the scheduled event, a second chance draw(s) will be conducted by the Promoter at the same place as the original draw(s) on that day at 10am (Sydney time)subject to any written direction given under applicable law. The unclaimed prize draw winner(s) will be notified by phone.

6.5The Promoter is Nationwide News Pty Ltd (ABN 98 008 438 828) of 2 Holt Street Surry Hills NSW 2010.

6.6Nationwide News Pty Limited Queensland Newspapers Pty Limited and Herald and Weekly Times (publisher of this newspaper) collects your information to include you in this competition and will disclose the information to others who help us run the competition. The winning entry will be as per paragraph 5 above. We may also use the information to assist us in improving our goods and services and to contact you in the future in regard to our other goods and services. We may share your information with other persons or entities who assist us in performing the above or with another company which provides prizes for the competition or reader offer. Nationwide News Pty Queensland Newspapers Pty Limited and Herald and Weekly Times is part of a global media and entertainment company which, in Australia, publishes newspapers, magazines and distributes movies (among other things).
