Attachedisthe“ApplicationforParticipationinCashManagementProgram”developedbytheOklahomaCommissiononSchoolandCountyFundsManagement.ThisapplicationhasbeendevelopedinkeepingwiththeOklahomastatutesthatprovideforoversightofpooledcashmanagementprograms.ApplicantsmustprovidealloftherequestedinformationandsubmittheirapplicationstotheStateAidSectionoftheOklahomaStateDepartmentofEducationnolaterthanMonday,April3,2017.Applicantsproposingadeficitborrowingforboththegeneralfundandthebuildingfundmustsubmitaseparateapplicationforeachlegalentity.However,arequestforauthorizationforparticipationforthebuildingfundonlywillnotbeapproved.

Withinfivedaysofreceipt,theDivision,actingasagentfortheCommission,willforwardtheapplicationstotheappropriatecertifyingauthority.Forschooldistricts,thecertifyingauthorityistheOklahomaStateDepartmentofEducation;forcareer-technologyschools,thecertifyingauthorityistheOklahomaDepartmentofCareerandTechnologyEducation;andforcounties,thecertifyingauthorityistheStateBoardofEqualization.Thecertifyingauthoritiesmustreturntheapplicationwitharecommendationwithinsixty (60)daysofreceipt.TheCommissionmusttheneitherapprove or rejectanapplicationwithinthirty(30)days.

TheeffortsoftheCommissionaredesignedtoprovidegeneraloversightofthestructureandadministrationofpooledcashmanagementprograms.TheactivitiesoftheCommissionarenotintendedtotaketheplaceoftheapplicant’sbondcounselandfinancialadvisors.Eachapplicantisexpectedtomakeagoodfaithefforttocomplywithallapplicableprovisionsoffederalandstatelaw,includingallregulationsoftheInternalRevenueServicewithrespecttoarbitrage.Thearbitragememorandumisbeingmailedtoyou.Thecertifyingauthorities’reviewandsubsequentCommissionapprovaldo not constitutevalidation ofanapplicant’sarbitragecomplianceefforts.TheCommissionassumesnoliabilityforanapplicant’scompliancewitharbitrage lawsandregulations.
