THE PARTIES HERETO AGREE AS FOLLOWS:

ARTICLE 1 – SUBJECT AND DURATION OF THE AGREEMENT

1.  The Parties have mutually decided to implement an exchange constituting the subject of this Co-financing Agreement, in compliance with the provisions of the Erasmus Charter for Higher Education (ECHE), within Mobility Projects in Higher Education, implemented by the Scholarship and Training Fund.

2.  The HEI confirms having accepted the contents and structure of the curriculum to ensure that the Individual Participant’s achievements accomplished in the course of the exchange are fully recognised.

3.  The purpose of this Agreement is to determine the obligations of both Parties relating to the Individual Participant’s mobility for studies as part of the measure Mobility Projects in Higher Education implemented by the Scholarship and Training Fund [optionally: and participation of the Individual Participant in an intensive language course].

4.  The mobility to the Receiving Partner Institution named in Art. 1 point 5 of this Co-financing Agreement must commence and finish within the period from 1st July 2015 to 30th September 2016.

5.  The Individual Participant undertakes to implement the study programme as set out in the Learning Agreement, which constitutes an integral part of this Co-financing Agreement, in the course of his/her mobility lasting

ARTICLE 2 – THE CO-FINANCING AND ITS PURPOSE

1.  The co-financing of travel, insurance and subsistence [optionally: including the language course] cannot exceed ______PLN, including:

·  Subsistence lump sum covering the period of the study and the language course: ______PLN,

·  Travel and insurance lump sum: ______PLN,

2.  On returning to the HEI the Individual Participant undertakes to supply a confirmation letter from the course organiser containing the date of commencement and completion of the language course.

3.  The Individual Participant acknowledges that the amount stipulated in Article 2 point 1 forms the basis for the calculation of the final grant amount.

4.  The final grant amount shall be calculated on the basis of a confirmation letter from the Receiving Partner Institution indicating the date of commencing and completing the study period, that the Individual Participant is obliged to submit after completing the mobility. The HEI guarantees payment of the grant for the mobility period at the Host Partner Institution set out in Article 1 point 5.

5.  The co-financing from the Scholarship and Training Fund is awarded for the mobility set out in Article 1 point 5 to cover additional, but not total costs relating to the mobility and study period at the Receiving Partner Institution.

6.  The grant shall be paid in monthly/bimonthly/trimonthly instalments (please quote the number of instalments) in the way that has been agreed between the Parties (please give details of transferring the grant).

ARTICLE 3 – BANK ACCOUNT

2.  The clearing of the co-financing paid shall take place after the Individual Participant submits the documents listed in Article 5 points 4 and 5.

ARTICLE 4 - INSURANCE

1.  The Individual Participant confirms having been informed about the rules governing the issue of insurance. Compulsory insurance is European Health Insurance Card (EHIC), recommended insurance is equivalent private insurance policy for mobilities to countries outside the EU. Compulsory insurance is the responsibility of the Individual Participant].

2.  The Individual Participant declares being in possession of a valid medical expenses insurance policy and being aware of its contents: European Health Insurance Card (EHIC) or equivalent private insurance policy for mobilities to countries outside the EU. Taking out a private medical insurance policy covering costs of possible additional medical intervention or transport back home is recommended.

ARTICLE 5 – OBLIGATIONS OF THE PARTIES TO THE AGREEMENT

1.  The Individual Participant declares having acknowledged the formal criteria that are to be fulfilled by students who have successfully applied for mobilities under the measure Mobility Projects in Higher Education implemented by the Scholarship and Training Fund and that he/she fulfils these criteria.

2.  The Individual Participant declares having acknowledged the principles of the Mobility Projects in Higher Education implemented by the Scholarship and Training Fund pertaining to mobilities and that he/she shall obey these principles.

3.  The Individual Participant undertakes to implement the study programme agreed in the Learning Agreement (LA) prior to the mobility. The Individual Participant must promptly notify the HEI of any changes to the Learning Agreement. If the HEI consents to the proposed changes, the Learning Agreement shall be appropriately amended in writing.

4.  Not later than on (day, month, year) the Individual Participant undertakes to provide the HEI with a letter from the Receiving Partner Institution confirming the length of his/her study period at the Receiving Partner Institution and that the planned study programme was implemented within the time set out in Article 1 point 5, as well as with information about the subjects completed, examinations passed and grades obtained (Transcript of Records).

5.  The Individual Participant undertakes to complete an ex-ante evaluation questionnaire on (day, month, year) at the latest, and not later than on (day, month, year) – an ex-post evaluation questionnaire of the Scholarship and Training Fund published on https://ankiety.frse.org.pl/users/login

6.  On the basis of the Transcript of Records provided, the HEI undertakes to guarantee the Individual Participant that it shall recognise credit obtained in the Receiving Partner Institution for completion of the course as equivalent to one obtained for the study period/subjects/examinations at the HEI. The HEI may refuse to recognise credit only when the Individual Participant’s results are not satisfactory and he/she does not fulfil the requirements that the Parties deem indispensable to obtain credit.

7.  The Individual Participant’s unsatisfactory achievements may form the basis on which the HEI may demand the reimbursement of the full grant or a part thereof. In the case of reasons beyond the Individual Participant’s control, defined as “force majeure” (that is a situation beyond the Individual Participant’s control, connected with a serious illness or accidental events), the HEI may waive the right to demand reimbursement of the grant or reduce its amount. Such cases require the Programme Operator’s written consent. The HEI shall promptly notify the Individual Participant of the Programme Operator’s decision.

8.  The Individual Participant declares that he/she has not obtained any other funding to finance the same costs resulting from the mobility described in Article 1 point 5 under any other community programmes or under other European Commission initiatives.

9.  Should the Individual Participant fail to deliver the required documents described above or fail to fulfil other provisions of this Agreement, the HEI has the right to terminate the Agreement.

10.  In cases other than the force majeure described in Article 5 point 7, the Individual Participant undertakes to:

·  reimburse the total or partial amount of the grant obtained, on demand of the HEI, in the case of failing to fulfil any requirement resulting from this Agreement;

·  reimburse the total or partial amount of the grant obtained, on demand of the HEI, in the case of cancelling the Agreement by the HEI

The amount to be reimbursed shall be set by the HEI.

11.  The Individual Participant declares that all periods of exchange in which he has participated, including exchange under this Agreement and previous exchanges under Erasmus or Erasmus + programmes and under the Scholarship and Training Fund Mobility Projects in Higher Education, do not exceed 12 months altogether within his present level of study.

12.  The Individual Participant declares having received the Erasmus Student Charter.

13.  The Individual Participant acknowledges not being able to reapply for mobility for studies under the Erasmus + programme and under Mobility Projects in Higher Education implemented by the Scholarship and Training Fund during his present level of study, if the period of his mobility abroad under the above initiatives exceeds 12 months altogether (this also refers to mobilities with zero financing).

14.  In the course of the Individual Participant’s mobility to the Receiving Partner Institution the HEI shall continue to pay national scholarships (for example for maintenance or outstanding learning achievements), for which the Individual Participant had become eligible before his/her mobility. The HEI shall ensure that on return from the Host Partner Institution the Individual Participant can apply for the above mentioned scholarships.

ARTICLE 6 – GENERAL TERMS AND CONDITIONS

1.  All personal data contained in this Agreement shall be processed in accordance with the Regulation (EC) No 45/2001 of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data by the Community institutions and bodies and on the free movement of such data. Data shall be processed only in connection with the execution of this Agreement and activities in addition to the Agreement execution by the Programme Operator, National Focal Point (NFP), Financial Mechanism Office (FMO), EEA Financial Mechanism Committee (FMC) /Norwegian Ministry of Foreign Affairs (NMFA). Data may be passed to authorities responsible for inspection and audit under EU law (European Court of Auditors or European Anti-Fraud Office OLAF).

2.  Following an application in writing the Individual Participant may access his/her personal data and amend all information that is incorrect or incomplete. The Individual Participant should address all questions relating to the processing of his/her personal data to the HEI and/or the Programme Operator. The Individual Participant can complain about processing his/her personal data by the HEI and/or the Programme Operator to the Inspector General for the Protection of Personal Data or to the European Data Protection Supervisor.

3.  Any amendments hereto shall be made in writing under pain of nullity.

4.  All disputes arising from this Agreement shall be settled under Polish law.

5.  This Agreement has been drawn up in duplicate, one copy for each Party. This Agreement becomes effective on the day of its being signed by both Parties.
