Category D Vouchers

Type Fee / Definition
Basic Fee / Includes Pre-Trial, First day of Trial and Initial Disposition Hearing; Also includes review of reports and relevant statutes; consultation with client and witnesses, and general office preparation time
Note: If more than 1 pre-trial is required, then subsequent pre-trials should be billed under extraordinary expenses
Preliminary Exam - Held / Legal and Procedural issues were raised and argued
Trial / Actual court or jury trial (includes time in voir dire and in-chamber conferences, as well as collaborative review and discussion of jury instructions)
Dispositional Review Hearing / Periodic hearing to review current disposition as required by court rule; or any motion to amend, add, clarify or terminate conditions of disposition or any motion to enter adjudication previously withheld
Commitment Review Hearing / Periodic review hearing as required by court rule; or hearing on any motion to change or modify placement or any motion to discharge juvenile from commitment.
Show Cause Hearing / Contempt hearing on the merits of alleged non-compliance, including hearings when the contempt motion is dismissed by the moving party
Note: If the case is adjourned pending compliance and is later brought back due to failure to meet purge conditions, it should be billed as a 2nd Show Cause Hearing
Probation Violation Hearing / Hearing on the merits of the alleged violation; child enters admission or is found in violation and re-sentenced or parties are present and violation is dismissed by prosecution without a hearing on the merits;
Note: If re-sentencing is scheduled for another date and time, it should be billed as a 2nd probation violation hearing
Appeals / Includes any post-judgment motion for new trial, motion to set aside adjudication or appeal to a higher court.
Waiver or Designation Hearing / Hearing on motion for waiver of juvenile jurisdiction or petition for designation as an adult, whether or not motion or petition withdrawn by the prosecutor at time of hearing, or is stipulated to or denied following hearing.
Motions / Paid as extraordinary expenses only if not heard in conjunction with other proceedings
