Sample Contract Language

1.Purpose

This document establishes the minimum conditions of compliance that will satisfy the Owner’s expectations for the support of WorkFace Planning by “The ABC Company”.

2.Scope

This document contains the contract language that will appear in the contract for services that will be offered to the successful bidder. The language will require “The ABC Company”to structure their processes to support the application of WorkFace Planning.

3.Definition

The Application of WorkFace Planning is:

  1. A best practice developed by the COAA based upon research conducted across the industry over a five year period, between 2002 and 2007. The process prescribes the size and contents of Field Installation Work Packages and the constraints that must be removed before the work is released.
  2. The Best Practice also describes the process for identifying and training WorkFace Planners and their position and responsibilities within the construction organisation
  3. The Owner and the Project Management Team require that all of the Project Stakeholders engaged for this project, indicate that they are willing and capable of supporting the application of WorkFace Planning.
  1. Stipulations – all contracts

“The ABC Company” will be expected to adjust their existing processes or develop new processes that satisfy the following conditions:

  1. The Project Management Team and the Owner require that “The ABC Company” support the implementation of WorkFace Planning, in accordance with the WorkFace Planning Project Procedures.
  1. “The ABC Company” will submit an execution strategy for the support/application of WorkFace Planning, based upon the project procedures, to The Project Management Team for review and approval no later than 60 days after the contract is awarded.
  1. The approved “ABC Company - WorkFace Planning Execution Strategy” will be integrated into the “Project Wide - WorkFace Planning Execution Strategy” and will form the basis of the contractual obligations of the ABC company’s commitment to facilitate/execute the application of WorkFace Planning.
  1. The “ABC Company - WorkFace Planning Execution Strategy” will include but not be limited to:
  2. A chronological list of activities, identifying the phase of the project, responsible stakeholders and relevant procedures that will be applied to support WorkFace Planning.
  3. A proposal for participation during the development of the Work Breakdown Structure with the Project Management Team.
  4. A proposal to participate in and respond to audits conducted by the WorkFace Planning Manager (PMT) and 3rd party auditors.

  1. Engineering contract specific:
  2. The intent to build a plan for the integration of the Construction Contractor representatives into the engineering office for the purpose of facilitating constructability.
  3. A proposal that shows the outline of EWP development that will support the CWPs release plan.
  4. A project life cycle plan for the 3D model that shows the integration of the WBS, the facilitation of WorkFace Planning software, the modeling of electrical components, the addition of electronic vendor information, the process for live maintenance of the model through red lines and asbuilt drawings and the turnover process to the owner.
  5. An execution strategy that identifies how the Document Control database will be developed to satisfy the total management of all project documents for the entire project across all project stakeholders.

  2. A plan to apply the Work Breakdown Structure as the standard nomenclature for all vendor components.
  3. A proposal on how to develop vendor contracts that stipulate electronic information as a deliverable for all components.
  4. A process that shows how electronic information will be collected from the vendors and entered into the 3D model.
  5. A plan that will ensure that materials are procured in a sequence that supports the CWP release plan.
  6. A project life cycle design that shows the plan for the total management of information.
  1. Material Management contract specific
  2. A proposal that outlines the total management of material based upon the nomenclature established in the WBS and represented in the 3D model.
  3. The design of a web based material management database that will populate from the 3D model and receive components against those items.
  4. The map of interaction that identifies electronic submission of FIWPs into the material management database and the production of reports that show the availability of materials by FIWP.
  5. A commitment to build a comprehensive plan that will satisfy all of the Project Stakeholder material requirements.

  2. A commitment to develop and follow a complete set of WorkFace Planning procedures that support the Project’s WorkFace Planning procedures.
  3. The commitment to apply Workface Planning to all direct work.
  4. The outline of interaction that will ensure that only work that is free of constraints is released to the field.
  5. A commitment to follow the Path of Construction
  6. A proposal that will ensure that progress is recorded and reported accurately
  7. A notice of intention to apply workface planning software.
