The conditions of this sale are subject to the following terms, and are agreed to by the buyer and WinkChows.

  1. This dog is being sold as a pet. Buyer agrees to spay / neuter the dog by the age of 6 months. AKC registration papers will be supplied when proof of sterilization is received.
  2. WinkChows has the right of first refusal if this dog becomes available for sale and must be returned to WinkChows if said dog is to be given away or sold. Failing to let WinkChows know of intend to sell or give away this dog, will result in court action and all costs from this are to be paid by buyer. If at any time buyer feels because of health or temperament problem or any other problem arises they feel they must euthanize this dog, then buyer MUST give WinkChows first option to take said dog to work with, to place in new home, or to do whatever WinkChows deems necessary.
  3. This dog is to be kept in a healthy environment, supplied good food and shelter and proper veterinary care. This dog is not to be kept on chain or rope at anytime or knowingly allowed to roam unattended and should have a fenced yard or be walked on a regular basis. WinkChows has the right to reclaim this dog if these conditions are not met, even if it means coming onto the buyer’s property and reclaiming the dog. The buyer would at that time turn over all American Kennel Club (AKC) papers and relinquish all ownership rights with no reimbursement of money spent on this dog due from WinkChows.
  4. This dog is FULLY GUARANTEED. If at anytime buyer is not happy with this dog, this dog will be replaced with a dog of equal value of the original sale. WinkChow holds the right to refund money up to purchase amount rather than replacing the dog. This guarantee includes any health problems, temperament problems, or any other problem. If at anytime buyer does not want this dog, it is to be returned to Winkchows, and all AKC papers with the proper signatures will be returned with the dog. Expenses to return the dog to WinkChows are those of the buyer. Expenses for any replacement puppy is the responsibility of WinkChows.

Release of Liability and Indemnification

In purchasing this dog, I agree that I am to be solely responsible for this dog and indemnify and hold WinkChows, Salome and Richard Winker, harmless from any and all claims of liability for the conduct of this dog on and after the date of this contract. I further agree and intend that this release of liability and indemnification shall apply to known, unknown and unanticipated damages resulting from my purchase, ownership and control of such animal.

I have read this contract before signing and agree to all conditions listed therein. This is a binding contract enforceable by civil law. If this contract is breached and court action occurs, court action will be taken in Elbert County, CO.
