-Pursuant to the Pricing Ordinance No.40/2002/PL-UBTVQH10 dated 26/04/2002

-Pursuant to the Decision No.98/2008/QĐ-BTC dated 04/11/2008 of the Ministry of Finance stipulated on fees, charges and tariff of collecting fees and charges of the Minister of Ministry of Finance

-Base on the actual situation.

DECIDES:

Article 1:Now promulgate together with this Decision: the Table of Seaport Service Chargesof Saigon PortJoint Stock Companyto be collected in foreign currency (USD)

Article 2:Subjects for the application of this Decision include:

  • Ships operating in the transportation of cargoes (including container), import, export, transit, international transshipment, entering or leaving at Export Processing Zone.
  • Cargoes (including containers), which are exported or imported, in transit or transshipment by the carriers (or those authorized by the carriers) shall be paid by their carriers (or those authorized by the carriers).
  • Passengers, officers, crews of passenger ships, army and training vessels entering Vietnam from foreign countries by sea or vice versa

Article 3:The rates prescribed together with this Decisionare not inclusive of VAT;

Article 4:Therelevant departments, subsidiary companies of Saigon PortJoint Stockare to execute the Decision accordingly.

Article 5:This Decision becomes effective from January 01st, 2016. Decision No. 774/QĐ-TGĐdated 15/12/2014 promulgating the Table of Seaport Service Charges of Saigon PortCo., Ltd.and the previous Decisions contrary to this Decision are to be canceled.

TABLE OF SEAPORT SERVICE CHARGES

(CHARGES ARE QUOTED IN U.S. DOLLARS, VAT IS NOT INCLUSIVE)

To be promulgated under the Decision No. 229/QĐ-TGĐ dated December25th, 2015

by the General Director of Saigon PortJoint Stock Company

PART A

GENERAL PROVISIONS

I/ Working time:

  1. Administrative working time: 7:30 am to 4:30 pm
  2. Working time in shift: 1st shift from 6 am to 6 pm, 2nd from 6 pm to 6 am applied for stevedores and additional services. Saigon Port’s workers: consecutive (including Saturday, Sunday, holidays, except the 30th and the first day of Lunar New Year)

II/ Unitsfor calculating seaport service charges and round–up method:

  1. The tonnage unit
  2. The tonnage being charged is based on the gross tonnage of water transportation means (Gross tonnage –GT) noted in the Certificate of Registration.

1.2For military ships: the tonnage for calculating seaport service charges is equal to 200% of the maximum tonnage inscribed in the Certificate of Registration.

1.3 Converting: decimal less than 0.5 GT is ignored, from 0.5 GT to less than 1 GT is rounded to 1 GT.

1.4For ships without GT inscription: the tonnage for calculating seaport service charges is converted as follows:

  • Cargo ships: 1.5 ton of registered tonnage is equal to 1 GT
  • Tug boats, push boats: 1 HP/CV is equal to 0.5 GT
  • Barges, boats: 1.5 ton of registered tonnage is equal to 1 GT
  • The engine capacity unit

2.1The engine capacity is calculated by horse power (HP) or cheval vapeur (CV) of the main engine of ships or kilowatt (KW).

2.2Converting: any oddof less than 1 HP/CV/KW shall be rounded to 1 HP/CV/KW.

  1. The cargo tonnageor volume unit:

-The tonnage for calculating service charges is ton (Metric ton – MT), including both cargoes and packages (Gross weight – GW) inscribed in the Delivery Order (DO) of shipping agents or Bill of Lading (B/L). Anyodd of less than 0.5T shall not be counted, from 0.5T ormore shall be rounded to 1T.

-The volume for calculating service charges is cubic meter (m3), the oddpart of under 0.5 m3 shall not be counted, from 0.5 m3 or more shall be rounded to 1 m3

-For one single bill of lading, the minimum tonnage or volume for calculating seaport service charges is 1T or 1 m3

  1. Time unit
  1. For time unit being day: one day is calculated with 24 hours, the odd part of 12 hours or less shall be calculated as ½ day, more than 12 hours shall be rounded up to one day.
  2. For time unit being hour: 1 hour is calculated as 60 minutes, the odd part of 30 minutes or less shall be calculated as ½ hour, more than 30 minutesshall be rounded up to 1 hour.
  3. For time unit being shift: a shift is calculated equal to 8 hours, ½ shift is calculated as 4 hours.
  1. Currencies for calculating seaport service charges:

US dollar (USD) shall be collected. The payment of seaport service charges shall be compliant with the Vietnamese State’s current regulations on foreign currency management. In cases of changing from US dollar to Vietnam dong, the conversion shall be made base on the current regulation of the Ministry of Finance.

  1. Cargoes with volume to be convertedto prescribe handling, warehouse/yard storage charges

After changing from m3 to tons, if the conversed tons are still higher than the real number of tons, the weight for calculating service charges is based on the conversed tons.

PART B

SERVICE CHARGES FOR SHIPS, WATERWAY TRANSPORT MEANS

I/ Rates for using wharves, mooring buoys in the port areas:

For vessels, including river means, cruisers

3. Other cases
- In the case of using more idle wharves for safe corridor / 500 USD/100m/day
- In the case of ship berthing at many places within the port area: the wharfage shall be totally charged on actual time and rate at each berth
- In the case of not being able to handle cargoes due to weather condition for more than 01 day (24 consecutive hours) wharfage shall be exempted for the period of no handling.
4. For Passengers
- Passengers passing through the wharf/berth (on arrival or departure) including crew members and officers of passenger vessels or seafarers, officers of military and training ships. (Children under 12 years old shall not be charged) / 2,00 USD/person/time
- In case a ship allowed to berth at anchorage area using other facilities to transport passengers to shore for sightseeing, the wharfage shall be charged at the rate / 3 USD/person
(including both entry and exit)

2. For Passengers

(Passengers include crew members and officers of passenger ships or seafarers, officers of military and training ships)

2.1Passengers passing through the wharf/berth (on arrival or departure) shall be charged as the following rates:

On entry:2 USD / person

On exit:2 USD / person

(Children under 12 years old shall not be charged)

2.2In case a ship allowed to berth at anchorage area using other facilities to transport passengers

to shore for sightseeing, the wharfage shall be charged at the rate of 3 USD/person (including both entry and exit)

II/ Charges on tugboat assistances

  1. Ships using tugboat assistance

Ships using tugboat assistances for entering/departing or maneuvering between wharves/buoy under the management of Saigon port shall be charged at the following rates:

In case the tugboat has arrived on time at the meeting point as ordered by the ship agents, but with any reason the ship has not yet arrived, or does not arrive on time, or departure cancelled, or tugboat changed under the pilot’s requirement: to be charged 50% of the rate in Table 3.

tugboat services to ships entering (leaving) dry-dock for repairs.

3.3 Tugboat serviceson Nha Be river, Thieng Lieng areas under Saigon Port’s management

3.4 Tugboat assistance in case of salvation, in wind force of scale 7 and above

3.1 In case Canoes has already come to the point of mooring/unmooring under the requirement of agents

but ships does not come or come late or change the time as the pilot’s requirement, the rates shall be

charged equal to 50% of the ratesinTable 5.

3.2 Charges on mooring/unmooring for ships berthing alongside another ship shall be

equal to the rates for ships berthing at wharf.

IV/ CHARGES ON OPENING/CLOSING HATCH: charged as requirement

V/ CHARGES ON FRESH WATER SUPPLY AND DUMPING SERVICES

The services provide for ships berthing at the area of Saigon Port. Service charges shall be calculated base on the Order confirmed by ship’s representatives or agents.

From the third day: 22 USD/cont/day

VII/ CHARGES ON OTHER SERVICES

  1. Anchoring at wharf:

-Length (LOA) < 50m 550 USD/day

-Length (LOA) from 50m to > 100m 880 USD/day

-Length (LOA) > 100m agreed rate

Applied for vessels anchoring at berth without discharge cargo, no passengers passing terminal, yacht including crews and passengers.

  1. In case as required by the shipowner, Saigon Port and shipowner shall come to agreement prices for the following services:

-Cleaning cargo holds. Sweeping, washing ships’ deck

-Lashing cargoes

-Other services not mentioned above

PART C

HANDLING SERVICES CHARGES

I/. CHARGES ON HANDLING CARGOES: ( Except Container )

Group 5: / - All kinds of assorted cargoes, sundry goods, flooring woods, wooden materials, handicrafts, all kinds of rubber... (except rubber packed in pallet), food and industrial cargoes in all kinds of packing, cases, or without packing, polyethylene, white candle in bag, except uncommon cargoes as specify detailed such as: household effects, sport appliances, stationary, paper roll, garments, textiles, fibre, paper-cover, soap, cigarettes, cannedfoodstuffs…
- Products made of enameled tile, terra-cotta, ceramic, glass, plastic, polyethylene, briquette...
- All kinds of Oriental/Western medicine, live animals, fresh fruits, flowers and vegetables, honey, plants…
Group 6: / - Bulky/heavy cargoes bared or packed such as: conveyor belts, girders, boilers, turbines, housing frames, and cargoes with one of these factors: weight of above 20Mt to 30MT, or length of above 12 M to 15 M; width of above 2,5 M to 3,5 M; height of above 2,5M to 3,5 M. Waterpipes with Ø >500mm.
- Cargoes of high values such as: ginseng, deer antlers, foreign wines, beer, cigarettes, swallow-nests…
- Crystals, sophisticated devices: Television, electronic machinery, projectors, communication equipment, medical machinery/instruments.
Group 7: / Means of transportation (under 30 MT)
Other cases / Other kinds of cargoes not mentioned above are based on quality, packaging, handling rate to insert into equivalent group.

2. Charges on cargo unloading/loading:(Using ship’s derricks)

rates shall be charged

  • For cargoes handling, shifting:

+ In the same ship’s hold : 50% of the rate Ship -> truck/barge

+ From one hold to other hold in the same ship : 70% of the rate Ship->truck/barge

+ Passing through wharf : 150% of the rate Ship-> truck /barge

  • Material arising during the time of handling, according to market price.
  • For cargoes handling packed in big bags, Jumbo bags, pallet bags: decrease 30% of the rates in

group 2-table 9.
