(ii)  Maintain the reinstatement in good condition during the maintenance period of 24 months after the date of completion of the works is notified to the office issuing this Permit or 36 months if the depth of cover exceeds 1,5m.

(iii)  Relieve South Ayrshire Council of all liability for any loss, injury or damage due to my/our operations either during the opening or during the period of maintenance.

STATUTORY UNDERTAKERS

Applicants must ensure that all relevant Statutory Undertaker information has been obtained prior to the commencement of works by contacting the Dial before you Dig service on 08000 231 251

GENERAL CONDITIONS

1. All works must be signed and guarded as stated in the booklet “Safety at Street Works and Road Works - A Code of Practice” obtainable from TSO (The Stationery Office), Bookshops, Accredited Agents or through good booksellers. (ISBN 978-0-11-551958-1)

2. This permit does not carry with it any right to interfere with any apparatus in or above the carriageway, footway, footpath or verge.

3. No openings shall be permitted on bridges nor shall any tunnelling be allowed unless special detailed application is made and approved.

4. All applicants shall have third party public liability insurance and a RAUC(S) qualified operative shall be on site during all operations.

5. All works shall be completed to current RAUC(S) specifications or other as specified by Roads Services below.

6. Within 3 months of the expiry of the maintenance period South Ayrshire Council, Roads Services will, where necessary make a permanent repair at the applicants expense.

7. A minimum of six weeks notice is required for all applications involving a road closure.

NOTES : ROADS (SCOTLAND) ACT 1984 SECTION 56 STATES

1. No works shall be executed in, or excavation made under, a public road except with the roads authority’s consent in writing and in accordance with any reasonable conditions which they think fit to attach to the consent.

NOTE: Persons contravening this section shall be guilty of an offence and shall be liable to a fine not exceeding £1,000 (April 1996).

2. A person shall, as soon as reasonably practicable make good any damage to the road occasioned by the works or excavation and shall immediately thereafter give notice to the authority that the damage is made good; and until twelve months have elapsed from the authority certifying that the damage has been made good to their satisfaction the person shall maintain so much of the road as is made good.

3. Works executed, or an excavation made, in contravention of 1 above may be removed, or as the case may be filled in, by the roads authority.
