13.Assembly Requirements

All steel and iron used must be produced in the United States in accordance with the Buy American definition in Federal Transit Administration (FTA) 49 U.S.C. § 5323(j); 49 C.F.R. Part 661

13.Assembly Requirements

Furnish steel and iron materials to be incorporated into the work with certificates of compliance. Steel and iron materials must be produced in the U.S. except:

a.Foreign pig iron and processed, pelletized, and reduced iron ore may be used in the domestic production of the steel and iron materials [60 Fed Reg 15478 (03/24/1995)]

b.If the total combined cost of the materials does not exceed the greater of 0.1 percent of the total bid or $2,500, materials produced outside the U.S. may be used

Production includes:

a.Processing steel and iron materials, including smelting or other processes that alter the physical form or shape (such as rolling, extruding, machining, bending, grinding, and drilling) or chemical composition

b.Coating application, including epoxy coating, galvanizing, and painting, that protects or enhances the value of steel and iron materials

The quantity of this item set forth on the Bid Formis nominal only. These quantities may be greatly increased or decreased depending upon the actual field condition or as directed by the Engineer. The increase or reduction of these quantities as compared with those set forth on the BidForm shall not constitute a basis for claim by the Contractor for extra payment or damages. Payment for the actual work performed based upon the prices bid for the items of work involved will be considered full compensation to the Contractor for the work.

Changes have been made to the bid form including quantities and line item descriptions.

Responses to Questions:

Q1)Will participating agencies or municipalities be adding any sales taxes for this contract?

A)Yes. Since there are 10 different sales tax rates from the different agencies and municipalities, sales taxes were excluded. The sales tax will be added by each agency or municipality when the awarded vendor enters in a contract with them.

Q2)If a bidder is organized outside of California are they required to register with the State as a foreign corporation? If yes, at what point of the bid process?

A)Page 5 of Exhibit A, Item 6. states:

The undersigned acknowledges that Bidder will be in good standing in the State of California, with all the necessary licenses, permits, certifications, approvals, and authorizations necessary to perform all obligations in connection with this RFQ and associated Bid Documents.

Out-of-state vendorswill need to register with the State of California only if they are awarded the contract and as part of final contract negotiations.

Q3)Is there a SLEB requirement for this RFQ?

A)No.

Q4)Since the bid includes all the participating agencies for the same price, will the contractor enter into a contract with each different agency?

A)Yes. There is one award for all 10 agencies but the contractor will enter into 10 separate contracts with all the agencies.

Q5)Page 9 of the RFQ, Section D (SPECIFIC REQUIREMENTS), Item 10, a.16states:

Demand response events

Is the County looking for the ability to perform demand response control? If yes, does the software package with this option need to be included in the pricing?

We have chosen to remove Item 10, a16 from Section D, Specific Requirements.

Q6)Is the RFQ for equipment only, or is it for equipment and services (i.e. provide, install, maintain and operate the charges over the term of the contract)?

A)This contract is for the purchase of EV charging stations. Warranty and software are also included. Installation is completely separate and isnot included in this bid. A three (3) year minimum warranty is required with additional pricing option for additional years. Certain participating agencies may request additional years of warranty.

Q7)Will the individual agencies own and operate the charging stations?

A)Yes the individual agencies will own and operate their charging stations.

Q8)On the bid form, is the price for the extended length power cord (25’) the differential cost between the standard charging stationmodel and the charging station model with the 25 foot power cord? If no, can the bid form be revised to reflect separate models with the extended length power cord? With the ChargePoint system the cords are not easily interchangeable and are treated as separate models.

A)The pricing used should reflect the cost to add a single/dual 25 foot power cord(s). There is not a need or request for an extra cord to be delivered. If there is an added cost over a shorter cord, then the total cost of the 25 foot power cord should be reflected in your bid response.

Q9)In regards to the vendor list on EXHIBIT C, does the vendor need to be on the vendor list in order to bid?

A)No, you do not need to be on the vendor list in order to be eligible to bid. The vendor list on Exhibit C is for informational purposes only and lists vendors that were sent the RFQ directly. Vendors who are not on the list but attended the bidders conferences will be added on the vendor list and the list will be shown in the addendum.

Q10)Is the County looking for three (3) year terms on everything (software, warranty, etc.) and then an add-on for options ofyear four (4) and year five (5)?

A)Yes.The bid requires a three (3) year term for both software and warranty. There is a bid line for an optional extension of the software and warranty to a five (5) year term

Q11)Can the County describe the open access mentioned in reference to Chargepoint? Does ChargePoint offer the Open Charge Alliance type of OCPP? Please describe ChargePoint’s open access capability.

A)The OCPP refers to the protocol of communications between EV Charging Stations and a central management system. This bid opportunity does not specifically mention OCPP in the Specific Requirements. However, we do require that the EVCS network be able to support EV charging stations hardware from multiple manufacturers. Furthermore, we require that any charging station be accessible by non-subscribers (such as through the use of a credit card or by calling to activate a charging session) as defined in section 6.F.

Q12)Why is ChargePoint called out? Does the charger networking have to be ChargePoint? ChargePoint is not Open Charge Point capable. This eliminates many charging stations that are Open Charge Protocol capable. This is exclusive and restrictive. The state of CA mandated OCPP specifically.

A)The EV charging stations can be from any manufacturer and model so long as the specifications are met. The charging station software does not need to be ChargePoint specifically but it must be compatible and able to be utilized with the ChargePoint network. This is because several partners in this collaborative bid and demonstration project are currently using the ChargePoint network to administer existing charging stations and it would be prohibitively difficult to administer multiple networks.

Q13)If a vendor is planning on using a subcontractor to meet the customer support requirements doesthe subcontractor need to be identified now?

A)Page 10 of the RFQ, Section D. (SPECIFIC REQUIREMENTS), Item 16a. states:

Each bid shall include the phone number, email, and address of nearest service rep to each Participating Agency.

Yes, if your subcontractor will also be your service rep then their information must be included in your bid.
